About modification of the Regulations on measurement of parameters of telecommunication networks for the purpose of implementation of the state supervision in the field of telecommunications

According to article 19 of the Law of Ukraine "About telecommunications" and to Regulations on the National commission performing state regulation in the field of communication and informatization to No. approved by the Presidential decree of Ukraine of November 23, 2011 1067, the National commission performing state regulation in the field of communication and informatization SOLVED:

1. Approve enclosed:

Changes in the Regulations on measurement of parameters of telecommunication networks for the purpose of implementation of the state supervision in the field of telecommunications approved by the decision of the National commission performing state regulation in the field of communication and informatization, of July 30, 2013 No. 487, registered in the Ministry of Justice of Ukraine on August 19, 2013 for No. 1426/23958;

Measurement technique of parameters of service quality of the fixed telephone communication;

Measurement technique of parameters of service quality of mobile (mobile) communication;

Measurement technique of parameters of service quality of data transmission and Internet access;

Measurement technique of parameters of telecommunication networks.

2. To provide to department of the state supervision in the procedure established by the legislation this decision on state registration to the Ministry of Justice of Ukraine.

3. This decision becomes effective from the date of its official publication.

Changes in Regulations on measurement of parameters of telecommunication networks for the purpose of implementation of the state supervision in the field of telecommunications

1. In the Section I:

 Item 1.1 to state 1) in the following edition:

"1.1. This Provision is developed according to the Laws of Ukraine "About telecommunications", "About metrology and metrological activities", "About the basic principles of the state supervision (control) in the field of economic activity", the Regulations on quality of telecommunication services approved by the decision of the National commission on questions of regulation of communication of Ukraine of April 15, 2010 No. 174, registered in the Ministry of Justice of Ukraine on June 23, 2010 for No. 429/17724, other regulatory legal acts and regulating documents in the field of telecommunications, establishes procedure for measurements of parameters of telecommunication networks and quality test of telecommunication services (further - measurements).";

2) in Item 1.2:

"the law of Ukraine "On telecommunications" shall be replaced with words words "the Laws of Ukraine "On telecommunications", "About metrology and metrological activities"";

shall be replaced with words abbreviation of "NKRSI" "The national commission performing state regulation in the field of communication and informatization";

 Item 1.4 to state 3) in the following edition:

"1.4. Measurements are performed during the actions of the state supervision of observance by operators, providers of telecommunications of certain parameter values of telecommunication networks, indicators of quality of telecommunication services, conditions of application of telecommunications of technical means of telecommunications by operators and include control of observance of procedure for routing of traffic in telecommunication network public.

Measurement is performed by means of the measuring equipment (further - SIT) which support technology which is applied in telecommunication network of the operator.";

 Paragraph one of Item 1.5 to state 4) in the following edition:

"1.5. Results of measurements in telecommunication networks are used for assessment of observance by operators, providers of telecommunications of the legislation in the relation:";

 The paragraph third Item 1.6 to state 5) in the following edition:

"parameters of alarm exchange between automatic telephone exchanges, other network equipment of telecommunication networks and the network equipment of telecommunication networks, including - establishment (determination) of the actual IP addresses and customer addresses (which cause and who are called), the identifiers specifying type of processing of challenge - international or national, connection establishment time, duration of conversation and the reason of separation, processing of category of telephone numbers, procedures of interaction, processing of additional services, processing of electronic codes (identifiers) of the final equipment (the IMEI codes, mac-addresses, SID, etc.);".

2. In the Section II:

  The word of "Procedure" shall be replaced with words 1) in Item 2.1 "article 19 of the Law of Ukraine "About telecommunications"";

 Item 2.2 to state 2) in the following edition:

"2.2. Measurements are taken by employees who had the corresponding training concerning operation of SIT used in case of these measurements.

Measurements are taken by means of SIT which meet the requirements  of the Law "About Metrology and Metrological Activities" and other regulatory legal acts containing requirements to such SIT and according to measurement techniques depending on the telecommunication services provided by operator, provider of telecommunications: Measurement technique of parameters of service quality of the fixed telephone communication, the Measurement technique of parameters of service quality of mobile (mobile) communication, the Measurement technique of parameters of service quality of data transmission and Internet access, the Measurement technique of parameters of the telecommunication networks approved by the solution of NKRSI.

Measurements of parameters which include temporary and/or electric characteristics or other characteristics of units of measure shall be performed with use of the corresponding SIT which conform to requirements of the Law of Ukraine "About metrology and metrological activities" and to other regulatory legal acts containing requirements to such SIT.

In case of measurements during the actions of the state supervision (control) the quantity of challenges, relative accuracy of assessment and level of credibility allowing to estimate compliance of the measured indicators to the established requirements shall be provided such.";

3) in Item 2.3:

in paragraph one of the word "the commission of NKRSI on check (further-the Commission)" shall be replaced with words "the officials authorized by NKRSI";

in the paragraph the second "creates" words and "determines" to replace respectively with words "create" and "determine", to replace words of "the measuring equipment" with reducing "SIT";

in paragraph three the word "does" to replace with the word "do";

 Paragraphs  of the first and second of Item 2.4 to state 4) in the following edition:

"2.4. Within implementation of actions of the state supervision access to the territory and to rooms of the consumer of telecommunication services and connection to SIT of telecommunication network from the consumer are performed in case of provision of written consent of the consumer of telecommunication services.

Measurements can be also taken according to the address of the consumer of telecommunication services in rooms where the equipment of this consumer, on condition of provision by it of consent to access to the territory, to rooms and connection of SIT is placed.".

3.  To state Item 3.2 of the Section III in the following edition:

"3.2. In case of detection during measurements of signs of making of criminal offenses in the field of telecommunications, NKRSI directs the available materials to relevant organ of National police of Ukraine for decision making according to the legislation of Ukraine.".

4. In the Section IV:

in Item 4.1:

in the paragraph the second "specialists" shall be replaced with words the word also in figures "workers who answer the requirements specified in Item 2.2 of the Section II of this provision,";

in paragraph three shall be replaced with words the word of "Procedure" "article 19 of the Law of Ukraine "About telecommunications"";

in paragraph four of the word "require maintenance" shall be replaced with words "receive from operators of telecommunications, their separate divisions in writing information for maintenance";

the fifth to state the paragraph in the following edition:

"involve representatives of operator of telecommunications (its separate division) to connection of SIT by them to telecommunication networks (equipment) of operators of telecommunications in the terms determined by representatives of NKRSI officials.".

5. In the Section V:

1) in Item 5.1:

in the paragraph the second ambassador of the word of "access" to add with words "representatives of NKRSI of the officials and workers specified in the certificate (direction) holding action of the state supervision", words and figures of "Item 8.2 of the Section VIII of the Procedure" shall be replaced with words "article 19 of the Law of Ukraine "About telecommunications"";

word in paragraph three of "the measuring equipment" to replace with reducing "SIT";

in paragraph four shall be replaced with words the word of "Procedure" "with article 19 of the Law of Ukraine "About telecommunications"";

in paragraphs five and pole shall be replaced with words the word of "Commission" to "the officials authorized by NKRSI";

in paragraph eight the word of "Commission" shall be replaced with words "the officials and workers involved to measurements specified in the certificate (direction) holding action of the state supervision authorized by NKRSI";

2) in Item 5.2:

state paragraph two in the following edition:

"get acquainted with documents on SIT compliance to requirements of the legislation on metrology and metrological activities;".

in paragraph three to exclude the word "second";

in paragraph four of the word and figures of "Item 8.1 of the Section VIII of the Procedure" shall be replaced with words "article 19 of the Law of Ukraine "About telecommunications"".

6. In the Section VI:

1) in Item 6.1:

in paragraph one after the word "persons" to add with the words "and the workers involved to measurements";

in the paragraph the second to replace the word of "devices" with reducing "SIT";

 6.2 figures and the words "9.3 Sections IX of the Procedure" to replace 2) in Item with figures and the words "3.2 this provision".

7. In the Section VII:

in Item 7.2:

in paragraph one of the word and figures of "Item 2.2 of the Section II of this provision" to exclude;

after paragraph two to add with the new paragraph of the following content:

"Results of the measurements executed according to requirements of Item 7.1 of this Section are drawn up by the protocol of measurement of parameters of telecommunication networks which form is given in appendix 3 to this Provision and used by operator, provider of telecommunications in case of creation of the act of abuse of regulations of the provision and receipt of telecommunication services provided by subitem 35-1 of Item 39 of Rules of provision and receipt of the telecommunication services approved by the resolution of the Cabinet of Ministers of Ukraine of April 11, 2012 No. 295.".

8. Add the Provision with new appendix 3, which is applied.

9.  To be reworded as follows appendix 1 to the Provision which is applied.

10. In appendix 2 to the Provision:

shall be replaced with words the words "Commission Chairman" and "Members of the Commission:" "The official person(s) authorized by NKRSI:";

replace the word "specialists" with the word "workers";

letters and the words "L. S. (in the Presence)" to exclude.

Measurement technique of parameters of service quality of the fixed telephone communication

I. Purpose of measurement technique

The measurement technique of parameters of service quality of the fixed telephone communication (further - the Technique) is developed according to the Law of Ukraine "About telecommunications", the Law of Ukraine "About metrology and metrological activities", the Regulations on quality of telecommunication services approved by the decision of the National commission on questions of regulation of communication of April 15, 2010 No. 174, registered in the Ministry of Justice of Ukraine on June 23, 2010 for No. 429/17724 (further - Regulations on quality), the Regulations on measurement of parameters of telecommunication networks for the purpose of implementation of the state supervision in the field of telecommunications approved by the decision of the National commission performing state regulation in the field of communication and informatization of July 30, 2013 No. 487, registered in the Ministry of Justice of Ukraine on August 19, 2013 for No. 1426/23958 (further - Regulations on measurement), The procedure for routing of traffic in telecommunication network public of Ukraine approved by the decision of the National commission performing state regulation in the field of communication and informatization of July 05, 2012 No. 324, registered in the Ministry of Justice of Ukraine on July 25, 2012 for No. 1252/21564 (further - the Procedure for routing of traffic), other regulatory legal acts and regulating documents in the field of telecommunications.

The technique determines set of procedures and the sequence of actions for measurement and calculation (testing) of parameters and temporary characteristics test method on real traffic, and also for measure calculations of quality of telecommunication services of the fixed telephone communication by method of the test control challenges (TCC) and by automatic method of measurement of quality of speech transmission.

1.3. Terms and determinations of concepts

In this Technique the terms established in the Law of Ukraine "About telecommunications", the Law of Ukraine "About metrology and metrological activities", Regulations on quality, Regulations on measurement, the Procedure for routing of traffic are used.

The terms which are in addition used in this Technique and determinations of the concepts designated by them are below included:

node long-distance (interzone) - basic and transit telephone exchange the OPTS/automatic long-distance telephone exchange (ALDTE) and/or long-distance (interzone) lock of telecommunication network of long distance (interzone) telephone communication;

node final and transit local (zone) - the basic and transit telephone station / the basic station (OPS) / automatic telephone exchange (ATE) and/or local (zone) lock of telecommunication network of local (zone) telephony and/or the center of switching of destination network (mobile (mobile) communication, satellite communication, and so forth);

node final local (zone) - automatic telephone exchange and/or local (zone) lock of telecommunication network of local (zone) telephone communication;

test (control) challenge - challenge which is performed when testing by specialized technical means.

1.4. Scope of application

The technique is used for measurement of parameters and measure calculation of the quality of telecommunication services (QTS) of the fixed telephone communication (FTC), in particular, by the TKV method and evaluation method of perception of quality of the speech (PESQ) which are provided with use of telecommunication networks of the fixed telephone communication (ТфМСК) public.

1.5. Object of measurement

The object of measurement by TKV method are temporary and frequency characteristics (parameters) of telecommunication networks which characterize KTU, corresponding TFMSK. The object of measurement by PESQ method is the frequency (spectral) characteristic of the signal transmitted to networks. The principle of the PESQ method (according to GSTU ITU-T G.862:2019) consists in comparison of frequency characteristics of initial signal of X (t) with frequency characteristics of the distorted signal of Y(t) which arises after passing of original signal through network, when comparing these signals the quality evaluation of speech signal of Y(t) is calculated.

1.6. Purpose of measurements

Measurement of the KTU parameters of the FCS is taken for measure calculation of KTU of the FCS and the subsequent establishment of their compliance by certain central executive body in the field of communication (further - TsOVS) to requirements concerning the KTU levels (Indicators of service quality of the fixed telephone communication and their extreme normalized levels approved by the order of the Ministry of Transport and Communications of Ukraine of February 22, 2010 No. 91, registered in the Ministry of Justice of Ukraine on March 15, 2010 for No. 220/17515 (further - the order TsOVS)).

II. Measurement methods

2.1. General provisions

Measurements of KTU on real traffic (IRT) apply according to GSTU ETSI EG 202 057-2:2015 (ETSI EG 202 057-2:2011, IDT), SOU 64.2-00017584-002:2009.

In case of measurements of the KTU parameters of the FCS the IRT method uses the networks this office interexchange alarm exchange which are saved up and kept during the session of monitoring of ASTS. Personal computers estimate by results of measurement and calculation of the parameters received in the course of IRT.

Measurement of parameters are performed by the IRT method automatically with use of PO ASTS.

Processing of results of measurements and measure calculation of KTU of the FCS on the basis of the measured parameters is perfromed in the automatic and automated PO ASTS operating modes.

The automated operating mode is applied when using ASTS in which the option for automatic measure calculation of KTU of the FCS on the basis of the measured temporary characteristics is not provided.
