About approval of Rules of rendering services in transportations on rail transport of passengers, and also loads, baggage and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity, and recognition voided some acts and separate provisions of some acts of the Government of the Russian Federation

The government of the Russian Federation decides:

1. According to article 3 of the Federal law "Charter of Rail Transport of the Russian Federation" to approve the enclosed Rules of rendering services in transportations on rail transport of passengers, and also loads, baggage and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity.

2. In paragraph three of Item 2 of the Regulations on features of agreement performance of transportation of the passenger by rail in case of threat of origin and (or) emergence of separate emergency situations, introduction of high alert or emergency situation in all territory of the Russian Federation or on its part, No. 901 approved by the order of the Government of the Russian Federation of June 20, 2020 "About approval of the Regulations on features of agreement performance of transportation of the passenger by rail in case of threat of origin and (or) emergence of separate emergency situations, introduction of high alert or emergency situation in all territory of the Russian Federation or on its part" (The Russian Federation Code, 2020, No. 26, the Art. 4127), words "approved by the order of the Government of the Russian Federation of March 2, 2005 No. 111 "About approval of Rules of rendering services in transportations on rail transport of passengers, and also loads, baggage and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity" shall be replaced with words "approved by the Government of the Russian Federation according to article 3 of the Federal law "Charter of Rail Transport of the Russian Federation".

3. Recognize invalid:

the order of the Government of the Russian Federation of March 2, 2005 No. 111 "About approval of Rules of rendering services in transportations on rail transport of passengers, and also loads, baggage and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity" (The Russian Federation Code, 2005, No. 10, the Art. 851);

Item of 30 changes which are made to acts of the Government of the Russian Federation concerning licensing of the separate types of activity approved by the order of the Government of the Russian Federation of December 14, 2006 No. 767 "About change and recognition voided some acts of the Government of the Russian Federation concerning licensing of separate types of activity" (The Russian Federation Code, 2006, No. 52, the Art. 5587);

Item of 8 changes which are made to acts of the Government of the Russian Federation, approved by the order of the Government of the Russian Federation of May 14, 2013 No. 411 "About introduction of amendments to some acts of the Government of the Russian Federation" (The Russian Federation Code, 2013, No. 20, the Art. 2504);

the order of the Government of the Russian Federation of June 17, 2015 No. 597 "About modification of Rules of rendering services in transportations on rail transport of passengers, and also loads, baggage and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity" (The Russian Federation Code, 2015, No. 26, the Art. 3892);

the order of the Government of the Russian Federation of December 26, 2018 No. 1678 "About modification of Rules of rendering services in transportations on rail transport of passengers, and also loads, baggage and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity" (The Russian Federation Code, 2018, No. 53, the Art. 8707);

the order of the Government of the Russian Federation of April 30, 2019 No. 545 "About modification of Rules of rendering services in transportations on rail transport of passengers, and also loads, baggage and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity" (The Russian Federation Code, 2019, No. 19, the Art. 2302);

the order of the Government of the Russian Federation of August 27, 2020 No. 1294 "About modification of Rules of rendering services in transportations on rail transport of passengers, and also loads, baggage and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity" (The Russian Federation Code, 2020, No. 36, the Art. 5614).

4. This resolution becomes effective since September 1, 2021 and is effective till September 1, 2027.

Rules of rendering services in transportations on rail transport of passengers, and also loads, baggage and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity

I. General provisions

1. The these rules developed according to the Federal Law "Charter of Rail Transport of the Russian Federation" (further - the Charter of rail transport), govern the relations arising between carriers and physical persons passengers, consignors (senders) and consignees (receivers) (further - users) when rendering services in transportations on rail transport, including on high-speed, passengers, and also loads, baggage and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity (further - services).

2. When rendering services to users identical terms of service and payments of the rendered services are provided. In accordance with the legislation of the Russian Federation and the legislation of subjects of the Russian Federation other payment terms of the rendered services can be provided to separate categories of users by services.

3. Services in transportations of passengers are carrier according to the transportation agreement of the passenger according to which the carrier shall transport the passenger in destination with provision to it places in the train (except for trains of the suburban message in which it is not provided to the passenger of the certain place), and in case of delivery by the passenger of baggage - to deliver baggage in destination and to issue it to person authorized on receipt of baggage.

Services in cargo haulings, cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity are carrier according to the transportation agreement of load or cargo baggage according to which the carrier shall deliver the load entrusted to it by the consignor (sender), cargo baggage in destination and to issue it to person authorized on receipt of load, cargo baggage.

The passenger shall pay according to the established rates the journey and conveyance (in case of its delivery), and the consignor (sender) - transportation of load and cargo baggage.

Rates, rates of payment and charges for services, and also procedure for their introduction (change) are established according to article 8 of the Federal law "About Rail Transport in the Russian Federation".

4. Relations of carrier and users when rendering the services which are not provided by these rules are regulated by the Civil code of the Russian Federation, the Charter of rail transport, and also rules of transportations of passengers, baggage, cargo baggage approved by the Ministry of Transport of the Russian Federation by rail (further - rules of transportations of passengers, baggage, cargo baggage) and rules of transportation of goods by railway transport (further - rules of transportation of goods).

II. Information on the rendered services

5. The carrier provides timely provision to users with services of the following reliable information (in evident and available form):

a) list of works and services, their cost;

b) the name and the location (legal address) of carrier, the location of division of carrier, authorized to accept and review the claim made to carrier;

c) data on the license of carrier for implementation of transportations of passengers, baggage, loads and (or) cargo baggage (number, term of its action, the name of the issued body);

d) fare of passengers and transportation of hand luggage over the established regulation, and also transportation of goods, baggage, cargo baggage;

e) departure time and arrivals of trains;

e) terms of sale of travel documents (tickets);

g) the list of things (objects) prohibited to transportation and storage as hand luggage, baggage, cargo baggage;

h) working hours of ticket and luggage offices, commodity offices and left-luggage offices of hand luggage;

i) arrangement of station rooms, places the public of railway stations intended for servicing of passengers, work with baggage, cargo baggage and places of weighing of hand luggage;

j) arrival time on railway station of destination of the baggage following without overload along the line;

k) procedure for provision of places in recreation rooms of passengers and rooms of mother and child;

l) the list of categories of citizens which are granted the right of free pass or the right of payment of journey at a discount in accordance with the legislation of the Russian Federation and the legislation of subjects of the Russian Federation;

m) data on the agreement (agreements) of compulsory and (or) voluntary insurance (number, date of the conclusion, effective period) and insurer (insurers) (name, location, postal address, phone number);

o) the list of the services which are included in fare in cars of the increased comfort;

o) data on possibility of acquisition of the travel document (ticket) in the long distance train on the rate providing condition about receipt back of fare in case of return of the unused travel document (ticket) according to provisions of part three of article 83 of the Charter of rail transport or on the rate which is not providing such condition;

p) other data on the rendered services.

6. Information specified in Item 5 of these rules is provided free of charge at railway stations, railway stations, in trains and other places of servicing of users in Russian, and also at the discretion of carrier - in addition in state languages of subjects of the Russian Federation and other languages of the people of the Russian Federation taking into account interests of the population, and information specified in the subitem "p" of Item 5 of these rules is provided also on the official site of carrier or person authorized by it on the Internet (further - Internet network).

7. The carrier shall provide on requests of users services (at railway stations and railway stations) for acquaintance these rules, and also rules of transportations of passengers, baggage, cargo baggage and the rule of transportation of goods.

8. Bringing to data of passengers of the schedule of movement of passenger, including suburban, and post and luggage trains is provided with carrier with use of wall data carriers, special information stands and reference books. About changes in the schedule of movement of passenger trains appears on public address system at railway stations and railway stations.

9. Data on changes of regulated rates, rates of payment and charges for services are published by the Ministry of Transport of the Russian Federation in the printing edition:

a) concerning transportation of passengers, baggage and cargo baggage - not later than 5 working days before enforcement of changes of regulated rates, rates of payment and charges;

b) concerning transportation of goods - not later than 10 working days before enforcement of changes of regulated rates, rates of payment and charges.

III. Procedure for rendering services in transportations of passengers and to storage of hand luggage

10. For travel by the long distance train the passenger shall have the travel document (ticket), and carrier or other person authorized by carrier shall process the travel document (ticket) in the presence of empty seat in the train to the railway station of destination specified by the passenger.

11. In case of travel by the long distance train and the train of the suburban message the passenger has the rights, stipulated in Article 83 Charters of rail transport.

12. Travel of the passenger by the train of the suburban message is performed based on the ticket for one-time trip there or there and back or the subscription ticket of the established form.

13. Transportation by the passenger in the train of the suitable message of children aged is not more senior than 7 years is performed free of charge.

Return of means under unused tickets is not made for one-time trip, except for receipt of journey by the passenger of all-in cost in case of unplanned traffic disturbance of local trains more than for one hour.

Return of means under unused subscription tickets is made according to the procedure and cases which are provided by rules of transportations of passengers, baggage, cargo baggage.

14. The carrier has the right to refuse to the passenger sale of the travel document (ticket):

a) in the absence of empty seats in the train (except for trains of the suburban message in which places are not provided);

b) in the absence of the parking of the train for landing and disembarkation of the passenger in the destination specified by the passenger.

15. The carrier has the right to refuse to the passenger sale of the travel document (ticket) with payment of fare at a discount or execution of the free travel document (ticket) in case of absence or presentation in an inadequate way of the processed document confirming the right of payment of fare at a discount or free pass.

16. Execution of the travel document (ticket) for the long distance train is made based on data on the identity document of the passenger, and for persons having the right of payment of fare at a discount or free pass, besides, - based on the documents confirming the specified right.

The list of identity documents based on which execution of the travel document (ticket) for the long distance train is performed is determined by rules of transportations of passengers, baggage, cargo baggage.

In case of execution of the travel document (ticket) for the long distance train specifying in it of surname, name, middle name (in the presence), birth dates, nationality, sex of the passenger and document number proving the identity is obligatory.

In case of execution of the travel document (ticket) for the long distance train with use of mobile application and (or) official site of the owner of infrastructure of rail transport public (further - the owner of infrastructure) in Internet network, mobile application and (or) the official site of carrier in Internet network for identification and authentication of the passenger the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically" and different ways of identification and authentication determined by the owner of infrastructure or carrier are used.

Execution of the travel document (ticket) for the long distance train from among disabled people is made for the passenger based on data on the identity document of the passenger, and also based on the information provided the insurance number of the individual ledger account of the passenger, in electronic form with use, by means of single system of interdepartmental electronic interaction by the operator of the state information system "Single Centralized Digital Platform in the Social Sphere" on the disability establishment fact, group of disability (category the handicapped child), extents of restriction of capability to independent movement, including the recommendation in providing with wheelchair.

Rendering infrastructure by the owner at stations and carrier in long distance trains to the passenger from among disabled people without collection of additional fare of services according to article 80.1 of the Charter of rail transport is made based on the identity document of the passenger, and also the document confirming disability, including confirming need of use of wheelchair, or the information specified in paragraph five of this Item provided the insurance number of the individual ledger account of the passenger, in electronic form with use, by means of single system of interdepartmental electronic interaction by the operator of the state information system "Single Centralized Digital Platform in the Social Sphere".

Execution of the travel document (ticket) for the long distance train aged up to one month can be made for children based on data on the health certificate on the birth granted by the medical organization or the individual entrepreneur performing medical activities, in accordance with the established procedure. In this case in the travel document (ticket) for the long distance train the surname of the child (the parent or the other person) specified in the health certificate on the birth and also series and number of such health certificate on the birth shall be specified.

The passenger in case of receipt of the travel document (ticket) shall check correctness of the specified in it to surname, the document number proving the identity and other personal data, trip details (date of departure, number of the train, railway stations of origin and appointments) and other information.

In case of execution of the travel document (ticket) for the long distance train it is allowed to perform identification and (or) authentication of the passenger with use of the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically" and the state information system "Single System of Identification and Authentication of Physical Persons with Use of Biometric Personal Data" in the presence at carrier of technical capability of implementation of such identification and (or) authentication.

17. Execution of the travel document (ticket) for the train of the suburban message to person having the right to payment of fare at a discount or free pass, is made in case of presentation of the identity document, and the documents confirming the specified right or based on the information about citizens to which the social service in the form of free pass by railway transport of the suburban message is provided, presented the insurance number of the individual ledger account of the passenger, in electronic form with use, by operators of the information systems containing the information about citizens to which the specified social service, the term of its action, and also data on the document confirming the specified right is provided.

In case of execution of the travel document (ticket) for the train of the suburban message with use of mobile application or official site of the owner of infrastructure, mobile application or official site of carrier in Internet network for identification and authentication of the passenger the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically" and different ways of identification and authentication determined by the owner of infrastructure or carrier are used.

18. Upon purchase of the travel document (ticket) by the passenger with use of mobile application or official site of the owner of infrastructure, mobile application or official site of carrier in Internet network the owner of infrastructure or carrier provide possibility of the direction of such travel document (ticket) in the federal state information system "Single Portal of the State and Municipal Services (Functions)".

19. On the child 5 years, passing with the adult in the long distance train aged are not more senior if he does not take the certain place, the travel document (ticket) is processed.

20. Separate categories of citizens have in accordance with the legislation of the Russian Federation the right to extraordinary acquisition of travel documents (tickets).

21. The procedure and terms of sale of travel documents (tickets), and also operating procedure of railway stations and railway stations are determined by rules of transportations of passengers, baggage, cargo baggage proceeding from technological features of functioning of rail transport.

22. The carrier can perform sale of travel documents (tickets) for transportation of groups of passengers in long distance trains and the suburban message according to requests of the organizations.

The procedure and terms of acceptance from the organizations of requests for sale of travel documents (tickets) for transportation of groups of passengers, and also procedure for their registration, return of unused travel documents (tickets) and payment of cost of the returned travel documents (tickets) are established by rules of transportations of passengers, baggage, cargo baggage.

23. In case of return to railway ticket office of the unused travel document (ticket) for the long distance train the passenger has the rights provided by part three of article 83 of the Charter of rail transport.

24. Return of receivable means for the unused travel document (ticket) is made in case of presentation of the passenger of the document proving the identity which number is specified in the travel document (ticket).

The statement on return of receivable means for the unused travel document (ticket) acquired by the passenger with use of mobile application or official site of the owner of infrastructure, mobile application or official site of carrier in Internet network can be submitted by means of the federal state information system "Single Portal of the State and Municipal Services (Functions)".

Return of receivable means for the unused travel document (ticket) acquired at a discount is made proceeding from the means paid by the passenger for journey. Return of means for the free travel document (ticket) is not made.

The procedure for return to the passenger of receivable means is determined by rules of transportations of passengers, baggage, cargo baggage.

25. The procedure for prolongation of effective period, renewal and renewal of the travel document (ticket) is determined by rules of transportations of passengers, baggage, cargo baggage.

Effective period of the travel document (ticket), including subscription, is not prolonged for the train of the suburban message.

If effective period of the travel document (ticket) for the train of the suburban message comes to an end at the time of finding of the passenger in transit, the travel document (ticket) is valid before arrival of the passenger on railway station of destination.

Effective period of the travel document (ticket) for the train of the suburban message is established by rules of transportations of passengers, baggage, cargo baggage.

26. Return of means to the passenger for the lost travel document (ticket) which can be recovered or identified by carrier is not made.

Return of means for the damaged travel document (ticket) which can be recovered or identified is made by carrier in the presence of mark about time of the address of the passenger to railway ticket office concerning return of means.

Recovery of the travel document (ticket) is made only in case of loss or damage of the travel document (ticket) processed to travel by the train (car) in which it is transported by carrier of the Russian Federation, from the railway stations located in the territory of the Russian Federation and to them.

Recovery of the travel document (ticket) is made in Items of acquisition of travel documents (tickets) or in railway ticket offices of railway station of origin of the passenger.

The lost or damaged travel document (ticket) for the train of the suburban message does not renew and return of means for it is not made.

27. Return of receivable means for unused travel documents (tickets) acquired on the rates which are not providing condition about receipt back of fare in case of return of the unused travel document (ticket) is not made, except as specified, specified in part five of article 83 of the Charter of rail transport.

28. Control of availability at the passenger of the travel document (ticket) is exercised at the railway station, the railway station and stopping points before landing in the long distance train, in case of pass of the passenger to the train of the suburban message through Item of control of travel documents (tickets) (in the presence of the specified Item), along the line the long distance train or the suburban message and in case of the passenger's exit through Item of control of travel documents (tickets) (in the presence of the specified Item) after the termination of trip in the train of the suburban message.

The passenger when landing in the long distance train, and also along the line trains shall show to employees of carrier to whom control of availability at passengers of travel documents (tickets) is assigned, properly processed travel document (ticket), the identity document based on data on which the travel document (ticket) is acquired (for children aged up to 14 years presentation of the notarized copy of the certificate of birth is allowed, for children aged up to one month presentation of the health certificate on the birth is allowed, based on data on which the travel document (ticket) is acquired, in the presence of the right of free pass or the right of payment of fare at a discount - as well the document confirming the specified right.

In case of discrepancy of surname, name, middle name (In the presence), birth dates, nationality, sex of the passenger or document number proving the identity, to surname, name, middle name (in the presence), birth date, the nationality, floor or document number specified in the shown travel document (ticket) in case of lack or change (correction) of the specified data in the travel document (ticket) the passenger in the long distance train and the suburban message with indication of places is not allowed to landing, except as specified, the transportations of passengers, baggage, cargo baggage provided by rules. Return of means according to such travel documents (tickets) is made according to the procedure and cases which are determined by rules of transportations of passengers, baggage, cargo baggage.

Landing of the passenger in the long distance train is allowed to be performed in case of presentation of the travel document (ticket) on condition of identification and (or) authentication of the passenger with use of the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically" and the state information system "Single System of Identification and Authentication of Physical Persons with Use of Biometric Personal Data" in the presence at carrier of technical capability of such identification and (or) authentication.

29. Each passenger has the right in the presence of the travel document (ticket) to take one place in case of journey. In the presence of empty seats occasional seats in case of payment term can be provided to the passenger them all-in cost and execution of additional travel documents (tickets).

Journey of children aged up to 10 years in long distance trains without adults is not allowed, except as specified journey of the pupils using railway transport for visit of the general education organizations.

30. In case of travel by the long distance train by the car with places for lying the passenger is voluntarily and at additional expense provided with bedding set if the cost of bedding set is not included in fare.

31. In the long distance train having cars of the increased comfort in structure, to the passenger paid field service which cost joins in fare is provided. At the same time to the passenger having the right of free pass or journey at a discount in cars with 2-seater compartments (SV) and in cars with 4-seater compartments such field service is provided on condition of introduction of the corresponding payment.

The procedure for provision to passengers of range of services whose cost joins in fare in cars of the increased comfort is established by rules of transportations of passengers, baggage, cargo baggage, and the structure of range of services is determined by carrier.

32. In the long distance train the passenger is at additional expense provided with food in dining-car (car cafe) in the presence of it as a part of the specified train. The procedure for the organization of work of dining-car (car cafe) is determined by carrier.

33. The passenger can be removed from the train:

a) employees of law-enforcement bodies, if when landing in the train or along the line the passenger violates rules of journey, public order and disturbs tranquility of other passengers. At the same time means in the amount of fare for neprosledovanny distance and the freight charges of baggage do not return;

b) and refuses to pay by employees of carrier to whom control of availability at passengers of travel documents (tickets) if the passenger passes without travel document (ticket) or according to the invalid travel document (ticket) is in accordance with the established procedure assigned fare according to the procedure, determined by rules of transportations of passengers, baggage, cargo baggage.

34. Each passenger has the right free of charge to transport with himself on one travel document (ticket), except small things, hand luggage weighing no more than 36 kilograms (for cars with 2-seater compartments (SV) - 50 kilograms) which size on the amount of 3 measurements does not exceed 180 cm. The specified hand luggage irrespective of sort and type of packaging shall be placed in places specially allotted for this purpose so that it did not disturb other passengers.

The procedure for transportation of things (objects) for hand luggage exceeding the specified weight or dimensions is determined by rules of transportations of passengers, baggage, cargo baggage.

Are not accepted for shipment as hand luggage of thing (objects) which can damage or contaminate the car and things of other passengers, and also the fetid, flammable, poisoning, flammable, explosive and other dangerous substances. Shipment of firearms and ammunition to it as hand luggage is performed taking into account the requirements established according to the Federal Law "About Weapon".

35. Each passenger has the right to transport for a fee in the train of small pets, dogs and birds.

The procedure for transportation of small pets, dogs and birds is determined by rules of transportations of passengers, baggage, cargo baggage.

36. The passenger is granted the right of free use of waiting rooms and toilets.

37. Storage of hand luggage at railway stations and railway stations is performed only in the places intended for storage according to rules of transportations of passengers, baggage, cargo baggage.

Each thing (subject) checked as hand luggage irrespective of, it is fastened to other thing (subject) or not, is considered as one place. The weight of one place of the hand luggage accepted on storage shall not exceed 50 kg. The hand luggage shall have adaptation allowing to transfer it.

The storage duration of hand luggage is established by rules of transportations of passengers, baggage, cargo baggage.

It is forbidden to check as hand luggage of animals and birds, firearms, the explosive, narcotic, psychotropic, Flammable, flammable, poisoning and fetid substances, and also things which can contaminate or damage things of other passengers.

Financial records, money and other values are accepted on storage as hand luggage only in the presence at the railway station, the railway station of specialized left-luggage office.

For natural spoil of the checked perishable products responsibility carries person which handed over them.

The perishable products checked and which were not demanded in the terms provided by rules of transportations of passengers, baggage, cargo baggage are liable to destruction about what the statement is drawn up.

The hand luggage which was not demanded after 30 calendar days from the date of the termination of introduction of payment for its storage is subject to realization according to the procedure, established by Articles 35, 48 and 49 Charters of rail transport concerning loads.

IV. Procedure for rendering services in luggage transports and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity

38. Each passenger has the right in case of presentation of the travel document (ticket) to check in for a fee for transportation luggage, and the carrier shall accept it and send by the closest train of the corresponding appointment in which there is car intended for luggage transport, cargo baggage.

39. The sender has the right to hand over for a fee for transportation cargo baggage, and the carrier shall accept it and send by train of the corresponding appointment in which there is car for luggage transport, cargo baggage. The carrier has the right to refuse acceptance to transportation of cargo baggage if after loading of baggage in the car there is no place left for loading of cargo baggage.

40. The passenger can show for transportation baggage, and the sender - cargo baggage with the announced value. For the announcement of value of baggage, cargo baggage collection which amount is established in tariff management is levied. The amount of the announced value is specified in the luggage, cargo luggage receipt.

If the carrier had doubts in correctness of assessment by the passenger, the sender of their baggage, cargo baggage, he has the right to demand opening by the passenger, sender of baggage, cargo baggage for check. In case of refusal the passenger, the sender to open baggage, cargo baggage for check or disagreement with the amount of assessment offered by carrier, the baggage, cargo baggage with the announced value are not accepted for shipment.

The cost of baggage or cargo baggage is determined proceeding from its price specified in the account of the seller or provided by the agreement, and in the absence of the account of the seller or the price in the agreement - proceeding from the price which under comparable circumstances is usually levied for similar goods, or according to expert evaluation.

V. Procedure for rendering services in transportation of goods for the personal, family, house and other needs which are not connected with implementation of business activity

51. Any physical person (consignor) has the right to transport load in the cars and containers belonging to carrier or other legal entities and physical persons.

52. The load including consisting of several diverse objects is given to transportation under the general name "load for personal needs" with indication of in delivery note of the name of each subject constituting such sending.

53. In case of presentation to transportation of such load the sender together with delivery note represents to carrier the inventory on the cargo hauling with the announced value constituted in 3 copies. In case of presentation to transportation on one delivery note of loads of different value their distinctive signs, the number of places and value are specified in the inventory separately.

54. After arrival of load on railway station of destination and notifications by carrier of the consignee about arrival of load in its address responsibility for the calculations connected with transportation is assigned to the consignee.

On the arrival of load on railway station of destination the carrier shall issue load and delivery note to the consignee according to the procedure, provided by the Charter of rail transport and rules of transportation of goods.

VI. Procedure for presentation and consideration of claims

55. Presentation to carrier of the claims which arose in connection with implementation of transportations of passengers, baggage, cargo baggage is performed according to article 123 of the Charter of rail transport.

56. In the claim concerning loss, shortage injuries (spoil) or delay to delivery of baggage, cargo baggage, are specified the following data:

a) surname, name, middle name (in the presence) applicant;

b) data of the identity document;

c) the address to which it is necessary to direct the answer;

d) basis for presentation of the claim;

e) the list of the enclosed documents.

57. In case of presentation documents, stipulated in Article 120 Charters of rail transport are put to carrier of claims in cases of loss of cargo baggage, shortage, damage (spoil) of cargo baggage, delay of delivery of cargo baggage to the claim.

In case of presentation the following documents are put to carrier of the claims connected with implementation of transportations of passengers, baggage to the claim:

in case of loss of baggage - the luggage receipt;

in case of shortage or damage (spoil) of baggage - the luggage receipt and the commercial act;

in case of delay of delivery of baggage - the act of general form;

in case of delay of departure or delay of the train - travel documents (tickets).

58. For delay of departure of the train or delay of the train on railway station of destination, except for transportations in the suburban message, the carrier pays to the passenger penalty according to article 110 of the Charter of rail transport.

In case of delay of departure or delay of the train less than for one hour the penalty provided by paragraph one of this Item is not paid.
