1. Approve Rules of development of the program of production environmental control of objects I and II of categories, conducting internal accounting, forming and provision of periodic reports on results of production environmental control according to appendix 1 to this order.

2. Recognize invalid some orders of the Minister of Energy of the Republic of Kazakhstan, according to appendix 2 to this order.

3. To provide to committee of ecological regulation and control of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on the Internet – resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of development of the program of production environmental control of objects I and II of categories, conducting internal accounting, forming and submission of periodic reports on results of production environmental control

Chapter 1. General provisions

1. These rules of development of the program of production environmental control of objects I and II of categories, conducting internal accounting, forming and submission of periodic reports on results of production environmental control (further - Rules) are developed according to Item 3 of article 185 of the Ecological code of the Republic of Kazakhstan (further - the Code) and according to the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" and determines procedure for development of the program of production environmental control of I and II categories, accounting, forming and submission of periodic reports on results of production environmental control.

2. The basic concepts and determinations used in Rules:

1) the operator of object - the physical person or legal entity, in property or other legal use of which is the object making negative impact on the environment;

2) the program of production environmental control – the regulating document for carrying out production environmental control and production monitoring of the environment which represents complex of organizational and technical actions for determination of actual state of the environment as a result of activities of the company.

Other concepts and determinations used in these rules are applied according to the legislation of the Republic of Kazakhstan.

3. Operators of objects I and II of categories exercise production environmental control according to article 182 of the Code.

4. Production environmental control is exercised according to requirements of these rules and programs of production environmental control, developed by operators of objects I and II of categories.

5. The program of production environmental control affirms the director.

6. The program of production environmental control contains the following information:

1) the obligatory list of quantitative and qualitative indexes of emissions of the pollutants and other parameters (production wastes and consumption) traced in the course of production monitoring;

2) frequency and duration of production monitoring, frequency of implementation of measurements;

3) data on the used tool and calculation methods of carrying out production monitoring;

4) necessary quantity of sampling points for the parameters traced in the course of production monitoring (on components of monitoring of the environment) and venues of measurements;

5) methods and frequency of accounting, analysis and data message;

6) the schedule of internal checks and the procedure of elimination of violations of the ecological legislation of the Republic of Kazakhstan, including internal instruments of response to their non-compliance;

7) mechanisms of quality assurance of tool measurements;

8) the protocol of actions in emergency situations;

9) organizational and functional structure of internal responsibility of workers for carrying out production environmental control;

10) other data reflecting questions of the organization and carrying out production environmental control (information on plans of nature protection actions and/or the program of increase in ecological efficiency).

7. Production monitoring is element of production environmental control, and also the program of increase in ecological efficiency. Within implementation of production monitoring operational monitoring, monitoring of issues to the environment and monitoring of impact are carried out.

Chapter 2. Procedure for development of the program of production environmental control of objects I and II of categories

Paragraph 1. Contents of the program of production environmental control of objects I and II of categories

8. The program contains obligatory structural elements according to the performed productive activity in the following procedure:

1) the title page which contains information on the name of object who and when approves the program;

2) general information about the company it is represented in form according to appendix of 1 these rules;

3) information on production wastes and consumption is submitted in form according to appendix of 1 these rules;

4) general information about sources of emissions it is represented in form according to appendix of 1 these rules;

5) data on sources of emissions of pollutants on which monitoring is performed by tool measurements it is represented in form according to appendix of 1 these rules;

6) data on sources of emissions of pollutants on which monitoring is performed by calculation method it is represented in form according to appendix of 1 these rules;

7) in the presence at the company in property of solid waste landfill gas monitoring for each section of polygon for the purpose of receipt of objective data with the established frequency behind quantity and quality of gas issues and their change on solid waste landfill is carried out. Data on gas monitoring it is represented in form according to appendix of 1 these rules;

8) data on dumping of sewage it is represented in form according to appendix of 1 these rules;

9) monitoring of impact is performed for determination of state of environment in impact zones. The schedule of observations of condition of atmospheric air is submitted in form according to appendix of 1 these rules;
