According to Item 2 of article 388 of the Ecological code of the Republic of Kazakhstan of January 2, 2021 we ORDER:

1. Approve Rules of production incentive in the Republic of Kazakhstan of environmentally friendly automotive vehicles (corresponding to the ecological class established by the technical regulation of the Eurasian Economic Union; with electric motors) and their components, and also the self-propelled agricultural machinery conforming to the ecological requirements determined by technical regulations.

2. Recognize invalid some joint orders according to the list according to appendix.

3. To provide to department of state policy of waste management of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this joint order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this joint order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

5. This joint order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of production incentive in the Republic of Kazakhstan of environmentally friendly automotive vehicles (corresponding to the ecological class established by the technical regulation of the Eurasian Economic Union; with electric motors) and their components, and also the self-propelled agricultural machinery conforming to the ecological requirements determined by technical regulations (further – Rules) are developed according to Item 2 of article 388 of the Ecological code of the Republic of Kazakhstan of January 2, 2021 and determine procedure for production incentive in the Republic of Kazakhstan of environmentally friendly automotive vehicles (corresponding to the ecological class established by the technical regulation of the Eurasian Economic Union; with electric motors) and their components, and also the self-propelled agricultural machinery conforming to the ecological requirements determined by technical regulations.

2. Production incentive in the Republic of Kazakhstan of environmentally friendly automotive vehicles (corresponding to the ecological class established by the technical regulation of the Eurasian Economic Union; with electric motors) and their components, and also the self-propelled agricultural machinery conforming to the ecological requirements determined by technical regulations it is performed in the way:

1) financings of their producers in the following directions: content of workplaces; use of energy resources; implementation of research and developmental developments; carrying out the testing connected with production; support of warranty obligations;

2) financings of the discount provided by the producer to physical persons and legal entities in case of acquisition by them of the vehicle and (or) the self-propelled agricultural machinery in the territory of the Republic of Kazakhstan made in the Republic of Kazakhstan.

3. In these rules the following concepts are used:

1) components – components of design of automotive vehicles, the details, nodes, components, materials, chemical, paint and varnish products and other component parts necessary for production of automotive vehicles;

2) the automotive vehicle – unit of railway vehicles of the road transport including buses, minibuses, automobile and cargo vehicles, trolleybuses, automobile trailers, semitrailer trucks to truck tractors and also the specialized cars (intended for transportation of certain types of loads) and the special equipment vehicles (intended for accomplishment of different mainly not transport works);

3) self-propelled agricultural machinery – the technical tool intended for performance improvement of work in agricultural industry by mechanization and automation of separate transactions or engineering procedures (whether) independently set in motion by means of the internal combustion engine with working amount over 50 cubic centimeters or the electric motor the maximum (total) capacity more than 4 kW;

4) producers – the physical persons and legal entities performing production in the territory of the Republic of Kazakhstan of products (goods) according to the list of separate types of products (goods) on which (which) expanded obligations of producers (importers) extend, approved by authorized body in the field of environmental protection according to Item 1 of article 386 of the Ecological code of the Republic of Kazakhstan of January 2, 2021 (further – the list) and their components.

4. Production incentive in the Republic of Kazakhstan of environmentally friendly automotive vehicles (corresponding to the ecological class established by the technical regulation of the Eurasian Economic Union; with electric motors) (further – environmentally friendly vehicles) it is provided to the producer in case of accomplishment of the following requirements:

1) the producer is registered in the territory of the Republic of Kazakhstan;

2) the international identification code of the manufacturer (WMI code) is assigned for the producer, and the producer performs transactions on drawing individual identification number (VIN code) on the one-piece constituting bodies (cabins), the chassis or specially made number plates of automotive vehicles;

3) implementation of production of, at least, one of the following environmentally friendly automotive vehicles: corresponding to the ecological class established by the technical regulation of the Eurasian Economic Union with the electric motor;

4) availability of the current agreement on industrial assembly of motor vehicles or agreement on industrial assembly of vehicles.

5. Production incentive in the Republic of Kazakhstan of components to environmentally friendly automotive vehicles, is provided to the producer in case of accomplishment of the following requirements:

1) the producer is registered in the territory of the Republic of Kazakhstan;

2) the producer performs transactions on drawing identification number on component to the environmentally friendly automotive vehicle;

3) implementation of production of components to environmentally friendly automotive vehicles;

4) availability of the current agreement on industrial assembly of components to vehicles and (or) agricultural machinery.

6. Production incentive in the Republic of Kazakhstan of the self-propelled agricultural machinery conforming to the ecological requirements determined by technical regulations (further – environmentally friendly self-propelled agricultural machinery) is provided to the producer in case of accomplishment of the following requirements:

1) the producer is registered in the territory of the Republic of Kazakhstan;

2) the producer performs transactions on drawing identification number on specially made number plates on the main constituting node of self-propelled agricultural machinery (body, cabin, frame, the chassis);

3) implementation of production of the self-propelled agricultural machinery conforming to the ecological requirements determined by technical regulations;

4) availability of the current agreement on industrial assembly of agricultural machinery.
