About introduction of amendments to the order of the acting minister on investments and development of the Republic of Kazakhstan of December 26, 2014 No. 299 "About approval of requirements imposed to the legal entities certified on work in the field of industrial safety"

I ORDER:

1. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of December 26, 2014 No. 299 "About approval of requirements imposed to the legal entities certified on work in the field of industrial safety" (it is registered in the Register of state registration of regulatory legal acts at No. 10188) the following changes:

to state preamble of the order in the following edition:

"According to the subitem 16) of article 12-2 of the Law of the Republic of Kazakhstan "About civil protection" I ORDER:";

the requirements imposed to the legal entities certified on work in the field of industrial safety, approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to committee of industrial safety of the Ministry of Emergency Situations of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Emergency Situations of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Emergency Situations of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Emergency Situations of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

Requirements imposed to the legal entities certified on work in the field of industrial safety

Chapter 1. General provisions

1. These requirements imposed to the legal entities certified on work in the field of industrial safety (further – Requirements) are developed according to the subitem 16) of article 12-2 of the Law of the Republic of Kazakhstan "About civil protection".

2. Certification of legal entities on work in the field of industrial safety is carried out for the purpose of official recognition by authorized body in the field of industrial safety of competences of the legal entity to carry out the following work types in the field of industrial safety:

1) expertize of industrial safety;

2) preparation, retraining of specialists, workers in the field of industrial safety;

3) conducting examination in the field of explosive works;

4) carrying out maintenance of gas-consuming systems;

5) installation, maintenance, technical diagnosing, engineering certification and repair of elevators, escalators, travelators, and also elevators for persons with limited opportunities (disabled people).

Chapter 2. Requirements to the legal entities certified on the right of expertize of industrial safety

3. The legal entity applying for the right of expertize of industrial safety:

the dangerous technical devices specified in Item 2 of article 71 of the Law of the Republic of Kazakhstan "About civil protection";

technologies, technical devices, the materials applied on hazardous production facilities (except for construction materials);

legal entities on compliance to the declared work types, requirements of industrial safety in case of receipt of the certificate on the work right in the field of industrial safety;

the project documents which are subject to examination in the field of industrial safety according to the Code of the Republic of Kazakhstan "About subsoil and subsurface use" has:

1) regulatory legal acts, regulating technical documents, educational and methodical materials necessary for expertize of industrial safety;

2) material equipment (the certified devices, gages and control) on the property right or other legal cause for conducting examination of dangerous technical devices, technologies, technical devices, materials on their compliance to requirements of industrial safety;

3) at least three specialists who are drawn up for permanent job having the higher technical education and practical experience of work on hazardous production facilities more than five years which confirmed qualification compliance to requirements of the professional standards of the Republic of Kazakhstan approved according to Item 2 of Article 117 of the Labor code of the Republic of Kazakhstan (further – Item 2 of article 117 of the Code), and had training and examination in the field of industrial safety;

4) the specialists who underwent certifications on ST of RK ISO 9712-2014 "Control nondestructive. Qualification and certification of personnel on nondestructive control" and laboratory of nondestructive control on the property right or other legal cause.

4. The legal entity applying for the right of expertize of industrial safety of other legal entities to compliance to the declared work types, requirements of industrial safety in case of receipt of the certificate on the work right in the field of industrial safety in addition to requirements, stipulated in Item 3 these Requirements, has:

1) experience of expertize of industrial safety at least five years;

2) at least three specialists who are drawn up for permanent job having the higher technical education and practical experience of work on hazardous production facilities more than ten years which confirmed qualification compliance to requirements of the professional standards of the Republic of Kazakhstan approved according to Item 2 of article 117 of the Code, and which had training and examination in the field of industrial safety.

Chapter 3. Requirements to the legal entities certified on the right of preparation, retraining of specialists, workers in the field of industrial safety

5. The legal entity applying for the right of preparation, retraining of specialists, workers in the field of industrial safety has:

1) regulatory legal acts, regulating technical documents, educational and methodical materials, benefits for preparation, retraining of specialists, workers in the field of industrial safety;

2) curricula and training programs according to requirements of industrial safety;

3) system of the organization of quality control of training;

4) educational classes (audiences) equipped with the computer equipment, visual aids, base for work practice of trainees on the property right or other legal cause;

5) the professional teachers entering into staff of the educational organization and (or) the specialists having the higher technical education, who confirmed qualification compliance to requirements of the professional standards of the Republic of Kazakhstan approved according to Item 2 of article 117 of the Code, and which had training and examination in the field of industrial safety.

Chapter 4. Requirements to the legal entities certified on the right of conducting examination in the field of explosive works

6. The legal entity applying for the right of conducting examination in the field of explosive works has:

1) at least three specialists who are drawn up for permanent job having the higher technical education and practical experience of work at explosive works more than five years which confirmed qualification compliance to requirements of the professional standards of the Republic of Kazakhstan approved according to Item 2 of article 117 of the Code, and which had training and examination in the field of industrial safety;

2) the material resources equipped with the certified devices, gages and control on the property right or other legal cause for conducting examination in the field of explosive works;

3) polygon for carrying out testing of explosives on the property right or other legal cause.

Chapter 5. Requirements to the legal entities certified on the right of carrying out maintenance of gas-consuming systems

7. The legal entity applying on is right works on maintenance of gas-consuming systems, has:

1) at least five specialists who are drawn up for permanent job having technical education and practical experience of work on gas supply facilities more than three years confirmed qualification compliance to requirements of the professional standards of the Republic of Kazakhstan approved according to Item 2 of article 117 of the Code, and which had training and examination in the field of industrial safety in case of operation of gas supply systems and the equipment working under pressure;

2) techniques of carrying out inspections of gas supply systems, calculations for determination of remaining useful life of technical devices, materials and expertize of industrial safety of gas supply systems;

3) factory buildings and the equipment (the workshop, workshop), the machine park, mechanisms, tools, instrumentations on the property right or other legal cause;

4) the service providing:

production supervision of quality of the rendered services;

metrological control (specialists in repair and servicing of instrumentations, specialists and devices of nondestructive control methods).

Chapter 6. Requirements to the legal entities certified on the right of installation, maintenance, technical diagnosing, engineering certification and repair of elevators, escalators, travelators, and also elevators for persons with limited opportunities (disabled people)

8. The legal entity applying for the work right on installation of one or several types of dangerous technical devices (elevators, escalators, travelators, and also elevators for persons with limited opportunities (disabled people)) has:

1) at least one specialist with the higher technical education (or and with length of service in this grow one specialist with the higher education at least five years) and two specialists with secondary technical education or two specialists with the higher technical education (or two specialists with the higher education and with years of service at least five years in this industry) who confirmed qualification compliance to requirements of the professional standards of the Republic of Kazakhstan approved according to Item 2 of article 117 of the Code, and which had training and examination in the field of industrial safety;

2) length of service for workers with the higher technical education at least two years; for workers with secondary technical education – at least three years;

Note:

From total number of the declared workers at least than one worker have work experience in position of the head of the structural unit performing works on installation of building constructions of lifting constructions (elevators, escalators, travelators and elevators for persons with limited opportunities (disabled people)) and length of service in this position at least three years.

Workers, from among declared, are drawn up in staff of the applicant (is confirmed by the employment contract, qualification of the worker is confirmed by the copy of the diploma about education).

In case of inclusion in the request of the worker who is drawn up in combination the copy of the employment contract or the copy of the service record certified by the employer from principle place of employment is submitted.

3) the production rooms belonging on the property right or other legal cause, buildings and constructions;

4) construction mechanisms, vehicles, means of technological equipment, safety control, control facility and measurements necessary for production of installation works:

tools, mechanisms and devices for performance of works (the welding machine, the mounting winch, load gripping devices, the metalwork tool, individual protection equipment for works at height);

5) availability at the legal entity of internal documents, for quality assurance of the performed installation works;

6) availability at the legal entity of the contract with the specialized organization for preparation, retraining of specialists and workers.

9. The legal entity applying for the work right on repair and (or) maintenance of one or several types of dangerous technical devices (elevators, escalators, travelators, and also elevators for persons with limited opportunities (disabled people)) has:

1) at least one specialist with the higher technical education, or one specialist with the higher education and length of service in this industry at least five years who confirmed qualification compliance to requirements of the professional standards of the Republic of Kazakhstan approved according to Item 2 of article 117 of the Code, and had training and examination in the field of industrial safety;

2) at least one specialist with secondary technical education who confirmed qualification compliance to requirements of the professional standards of the Republic of Kazakhstan approved according to Item 2 of article 117 of the Code, and had training and examination in the field of industrial safety;

3) length of service for workers with the higher technical education at least two years of uninterrupted length of service;

4) length of service for workers with secondary technical professional education - at least three years of uninterrupted length of service;

Note:

From general working life of workers length of service in the specialty in the field of construction, balancing and commissioning in the field of heavy lift gears, elevators, escalators, travelators and elevators for persons with limited opportunities (disabled people) is considered.

From total number of the declared workers one worker has work experience in position of the head of the structural unit on ensuring safe operation of heavy lift gears and length of service in this position at least three years.

Workers, from among declared, are drawn up in staff of the applicant (is confirmed by the employment contract, qualification of the worker is confirmed by the copy of the diploma about education).

In case of inclusion in the request of the worker who is drawn up in combination the copy of the employment contract or the copy of the service record certified by the employer from principle place of employment is submitted.

5) the production rooms belonging on the property right or other legal cause, buildings and constructions;

6) mechanisms, vehicles, means of technological equipment, safety control, control facility and measurements necessary for works on maintenance and repair:

tools, mechanisms and devices for accomplishment of the corresponding work types (the mounting winch, the metalwork tool, set of instrumentations, individual protection equipment for works at height);

7) availability of emergency and dispatching service:

employment contracts and orders on specialists (at least two electricians);

the vehicle on the property right, or according to the lease agreement;

Item of dispatching control on the property right, or according to the lease agreement;

8) availability at the legal entity of technical documentation for works on maintenance and (or) repair;

9) availability at the legal entity of the contract with the specialized organization for preparation, retraining of workers and specialists.

10. The legal entity applying for the work right on technical diagnosing, engineering certification of one or several types of dangerous technical devices (elevators, escalators, travelators, and also elevators for persons with limited opportunities (disabled people)) has:

1) at least one specialist of the sixth level, at least one specialist of the fifth level who confirmed qualification compliance to requirements of the professional standards of the Republic of Kazakhstan approved according to Item 2 of article 117 of the Code, and which had training and examination in the field of industrial safety;

Note:

In case of inclusion in the request of the worker who is drawn up in combination the copy of the employment contract or the copy of the service record certified by the employer from principle place of employment is submitted. Qualification of the worker is confirmed by the copy of the diploma about education.

2) the declared specialists of the sixth level have work experience as heads of the structural divisions in the field of construction performing the works connected with installation and operation of heavy lift gears, escalators, travelators, elevators for persons with limited opportunities (disabled people) and length of service in this position at least three years.

The declared specialists of the fifth level perform the labor activity connected with heavy lift gears, escalators, travelators, elevators for persons with limited opportunities (disabled people) and have length of service in this position at least one year;

3) the production rooms belonging on the property right or other legal cause, buildings and constructions;

4) means of technological equipment, safety control, means necessary for works on carrying out engineering certification of elevators, escalators, travelators and elevators for persons with limited opportunities (disabled people):

control test loads;

device for control of guides;

dynamometer key;

set of instrumentations;

individual protection equipment;

5) availability of technical documentation set of manufacturing plant, depending on type and type of the technical device.
