I ORDER:

1. Approve the enclosed Procedure for issue of the reference by authorized body on state supervision on import to the territory of the Kyrgyz Republic of products and release of products by customs authorities in free circulation without certificate of conformity.

2. To legal department (Akhmetov U.) in accordance with the established procedure to direct this order to registration in the Ministry of Justice of the Kyrgyz Republic.

3. To send to Hairy O. A. press secretary the order registered in Ministry of Justice of the Kyrgyz Republic for publication in mass media and on the state Internet portal of the Kyrgyz Republic.

4. To the head of department of technical regulation Urmanbetov D. A.:

- send this order after its registration in the Ministry of Justice of the Kyrgyz Republic to authorized bodies on the state supervision and the State customs inspection under the Government of the Kyrgyz Republic;

- notify the Ministry of Justice of the Kyrgyz Republic on official publication of this order.

5. This order becomes effective after registration in the Ministry of Justice of the Kyrgyz Republic and the subsequent official publication.

6. To impose control of execution of this order on the deputy minister Dzhunushaliyev T. Sh.

Procedure for issue of the reference by authorized body on state supervision on import to the territory of the Kyrgyz Republic of products and release of products by customs authorities in free circulation without certificate of conformity

This Procedure No. 8 "About procedure for import for the address in the territory of the Kyrgyz Republic of products which are subject to obligatory confirmation of conformity in the form of obligatory certification and about recognition of the results of obligatory confirmation of conformity of products received outside the Kyrgyz Republic" is developed for the purpose of implementation of the order of the Government of the Kyrgyz Republic of January 11, 2006.

1. This Procedure extends to products specified in Item 1.4 "Procedure for the import to the territory of the Kyrgyz Republic of products which are subject to obligatory confirmation of conformity in the form of obligatory certification", approved by the above-stated order of the Government of the Kyrgyz Republic:

- imported based on the signed agreements (contracts), stock exchange transactions, futures contracts, barter deals, tradeswomen, and also other documents confirming the property right to it, not intended for alienation or market circulation;

- intended for official use by the international, interstate, intergovernmental organizations, representations of foreign states in case of them, and also their personnel;

- batches of gasoline and gasoil (diesel fuel) on condition of their placement at the companies of oil product supply (the companies performing acceptance, storage and issue of oil products) and carrying out certification of serial production of gasoline and gasoil (diesel fuel) when producer is the company of oil product supply.

2. On medicines and goods of medical appointment the Approval procedure affects the import to the territory of the Kyrgyz Republic of medicines approved by the order of the Ministry of Health of the Kyrgyz Republic of 15.05.06 No. 244.

3. The reference (appendix 1) on import to the territory of the Kyrgyz Republic of products and release of products by customs authorities in free circulation without certificate of conformity is issued to the applicant by authorized body on state supervision according to area of its competence established by the Government of the Kyrgyz Republic.

4. For receipt of the reference the applicant provides to authorized body on state supervision the guaranty letter (the appendix 2) confirming products belonging to the specified type and non-stationing of products in the market of the Kyrgyz Republic with application of a copy of the invoice and the signed agreements (contracts), stock exchange transactions, futures contracts, barter deals, tradeswomen, and also other documents confirming the property right to it which is not intended for alienation or market circulation.

5. The term of issue of the reference to the applicant in the presence of all supporting documents shall not exceed one day for all types of products.

6. The reference is the document which is subject to accounting, on it the individual sequence number is put down. The authorized body on state supervision records the references issued to them.

7. Samples of references of authorized bodies on state supervision with specimen signatures of heads (the officials having right to sign) and seals are provided by authorized bodies in the State customs inspection under the Government of the Kyrgyz Republic.

8. The reference issued by authorized body on state supervision, the applicant represents to customs authorities of the Kyrgyz Republic.

9. The reference of authorized body on state supervision is the basis for release of products by customs authorities in free circulation without certificate of conformity.

10. In case of establishment of the facts of placement of products specified in the reference in the market of the Kyrgyz Republic, authorized body on state supervision are applied to the violator of measure according to the current legislation of the Kyrgyz Republic.
