About introduction of amendments to the order of the Minister of Justice of the Republic of Kazakhstan of August 29, 2018 No. 1345 "About approval of Rules of registration in the State register of trademarks of transfer of exclusive right, provision of the right to use the trademark"
According to the subitem 2) of Item 2 of article 3 of the Law of the Republic of Kazakhstan of July 26, 1999 "About trademarks, service marks and names of places of goods origin" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:
1. Of August 29, 2018 No. 1345 "About approval of Rules of registration in the State register of trademarks of transfer of exclusive right, provision of the right to use the trademark" (it is registered in the Register of state registration of regulatory legal acts No. 17331, it is published on September 8, 2018 in Reference control bank of regulatory legal acts) to make the following change to the order of the Minister of Justice of the Republic of Kazakhstan:
Rules of registration in the State register of trademarks of transfer of exclusive right to be reworded as follows the provisions of the right to use the trademark approved by the specified order according to appendix to this order.
2. To provide to department on intellectual property rights of the Ministry of Justice of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:
1) state registration of this order;
2) placement of this order on official Internet resource of the Ministry of Justice of the Republic of Kazakhstan.
3. To impose control of execution of this order on the supervising vice-Minister of Justice of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of registration in the State register of transfer of exclusive right, provision of the right to use the trademark (further - Rules) are developed according to the Laws of the Republic of Kazakhstan of July 26, 1999 "About trademarks, service marks and names of places of goods origin", of April 15, 2013 "About the state services" (further - the Law on state services) which establish order of registration in the State register of trademarks of exclusive right, provision of the right to use the trademark, and also determine procedure for rendering the state services.
2. In these rules the following concepts are used:
1) exclusive right - property right of the owner on use of the trademark or name of the place of goods origin in any manner at discretion;
2) the bulletin - the official periodical concerning protection of trademarks;
3) patent agents are citizens of the Republic of Kazakhstan who according to the legislation of the Republic of Kazakhstan are granted the right to representative office of physical persons and legal entities before authorized body and the expert organization;
4) Singapore agreement - The Singapore agreement on the laws according to trademarks of March 27, 2006;
5) the owner of the trademark - the physical person or legal entity having exclusive right on the trademark;
6) the trademark, service mark (further - the trademark) - the designation registered according to the Law or protected without registration owing to international treaties in which the Republic of Kazakhstan participates, serving for difference of goods (services) of one legal entities or physical person from homogeneous goods (services) of other legal entities or physical persons.
7) the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further - the portal) - the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;
8) payment gateway of "the electronic government" (further - PShEP) - the information system automating processes of information transfer about carrying out payments within rendering the paid services rendered electronically;
9) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.
3. The state service "Registration of Transfer of Exclusive Right for the Trademark, Selection Achievement and Object of Industrial Property" (further - the state service) appears the Republican state company on the right of economic maintaining "National institute of intellectual property" of the Ministry of Justice of the Republic of Kazakhstan (further - the service provider).
4. For receipt of the state service the physical and (or) legal entity (further - uslugopoluchatel) directs through the portal applications with the application of documents specified in Item 8 of the standard of the state service "Registration of Transfer of Exclusive Right for the Trademark, Selection Achievement and Object of Industrial Property" according to appendix 1 (further - the standard), in electronic form, signed by the EDS, according to appendices 2 and 3 to these rules.
5. The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service is provided in the standard.
Payment is performed by non-cash method through payment gateway of bank of the second level integrated by c information system of the service provider of newcab.kazpatent.kz on the bank details specified in appendix 4 (further - appendix 4) to these rules.
In case of the direction uslugopoluchately statements through the portal in "personal account" the status about acceptance of request for rendering the state service is automatically displayed.
6. The statement for registration and documents attached to it are submitted in the Kazakh or Russian languages. Foreign names and names of legal entities are specified in the Kazakh or Russian transliteration.
The physical persons who are constantly living in the Republic of Kazakhstan, but temporarily being beyond its limits can perform the rights of the applicant, and also the right of the interested person without patent agent when specifying the address for correspondence within the Republic of Kazakhstan.
Examination and registration of agreements on assignment of rights, one of the parties of which is physical person or legal entity of the foreign State Party of the Singapore agreement, are performed according to provisions of the Singapore agreement.
7. To the statement on rendering the state service registration number at the time of receipt is automatically assigned to the service provider.
In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of applications and issue of results of rendering the state service are performed the next working afternoon.
The service provider within 5 (five) working days from the moment of document registration checks their completeness.
Data on the document confirming payment, the service provider receives from the corresponding state information system through lock of "the electronic government".
By results of verification of the relevant documents and payment, and also in the absence of the bases for refusal, the service provider within 5 (five) working days prepares the notification on rendering the state service and sends to "personal account" of uslugopoluchatel electronically according to appendix 5 to these rules.
In case of provision by uslugopoluchatel of incomplete document package, or on the bases specified in Item 9 of the standard, the executive in charge in the specified terms prepares motivated refusal in further review of the statement in form according to appendix 6 to these rules signed by (EDS) of the head of the service provider and sends to uslugopoluchatel.
In case of violation of requirements to document creation or availability of the bases interfering registration of the agreement, but which can be eliminated, the service provider the notification to uslugopoluchatel with the offer within three-months term from the date of its sending goes to submit the absent or corrected documents or to make necessary changes and additions. In this case, the term of conducting verification of documents is estimated from the date of submission of the absent or corrected documents.
8. In case of registration the service provider publishes in the bulletin of the data on registration of transfer of exclusive right for the trademark.
9. The service provider provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services according to the procedure, established by authorized body in the field of informatization, according to the subitem 11) of article 5 of the Law on state services.
10. The state service "Registration of Provision of the Right to Use Trademark, Selection Achievement and Object of Industrial Property" (further - the state service) appears the service provider.
11. For receipt of the state service the physical and (or) legal entity (further - uslugopoluchatel) directs through the portal applications with the application of documents specified in Item 8 of the standard of the state service "Registration of Provision of the Right to Use Trademark, Selection Achievement and Object of Industrial Property" according to appendix 7 (further - the standard), in electronic form, signed by the EDS, agrees appendices 8, 9 and 10 to these rules.
12. The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service is provided in the standard.

In this case, the term of conducting verification of documents is estimated from the date of submission of the absent or corrected documents.
15. In case of registration the service provider publishes in the bulletin of the data on registration of provision of the right to use the trademark.
16. The service provider provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services according to the procedure, established by authorized body in the field of informatization, according to the subitem 11) of article 5 of the Law on state services.
17. The claim to the decision, actions (failure to act) of staff of structural divisions of the service provider can be submitted addressed to the head of the service provider and (or) to authorized body by assessment and control of quality of rendering the state services according to the legislation of the Republic of Kazakhstan.
The claim of uslugopoluchatel which arrived to the service provider according to Item 2 of article 25 of the Law on state services is subject to consideration within five working days from the date of its registration.
The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within fifteen working days from the date of its registration.
18. In disagreement cases with results of the rendered state service, the uslugopoluchatel takes a legal action in the procedure established by the legislation of the Republic of Kazakhstan.
