About introduction of amendments to the Order of the Minister of ecology, geology and natural resources of the Republic of Kazakhstan of June 2, 2020 No. 130 "About approval of Rules of rendering the state services of environmental protection"

1. be reworded as follows appendices 4 and 5 according to appendices 1 and 2 to this order;

exclude appendices 6 and 7.

2. To provide to committee of ecological regulation and control of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of rendering the state service "Issue of the Conclusion by results of Environmental Impact Assessment"

Chapter 1. General provisions

1. These rules of rendering the state service "Issue of the Conclusion by results of Environmental Impact Assessment" (further - Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further - the Law) and determine procedure for rendering the state service "Issue of the Conclusion by results of Environmental Impact Assessment" (further - the state service).

2. The state service appears Committee of ecological regulation and control of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan (further - Committee) and its territorial subdivisions (further - the service provider).

3. The state service appears to physical and (or) legal entities (further - uslugopoluchatel).

4. The state service is rendered:

by means of the web portal of "the electronic government" www.egov.kz (further - the portal);

through office of the service provider.

Chapter 2. Procedure for rendering the state service

5. For receipt of the state service the uslugopoluchatel sends to the service provider by means of the portal or through office of the service provider the statement in form, according to appendices 1 and 2 to these rules, with application of documents, specified in Item 8 of the Standard of the state service.

The list of the main requirements to rendering the state service including the characteristic of process, form, content and result of rendering, and also other data taking into account features of rendering the state service are stated in the standard of the state service "Issue of the Conclusion by results of Environmental Impact Assessment" according to appendix 3 to these rules.

6. The service provider in day of receipt of documents performs their acceptance and registration. Representation cases uslugopoluchatel of incomplete document package according to the list and (or) documents with the expired effective period the service provider refuses reception of an application.

In case of the direction of the statement through the portal the contractor checks for completeness of the submitted documents within 2 (two) working days from the moment of registration of a statement;

in case of establishment of incompleteness of the submitted documents and (or) documents with the expired effective period, the contractor of the service provider prepares motivated refusal in further review of the statement;

after signing by the service provider, the uslugopoluchatel receives the motivated refusal in further review of the statement signed by the EDS of the head of the service provider on the portal in personal account in electronic form.

In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays reception of applications and issue of results of rendering the state service is performed the next working afternoon.

The contractor of the service provider receives data on identity documents, state registration (re-registration) of the legal entity, the individual entrepreneur from the corresponding state information systems through lock of "the electronic government".
