About approval of rates of the harbor fees in sea fish ports of the Russian Federation
According to the Regulations on Federal Tariff Service approved by the order of the Government of the Russian Federation of June 30, 2004 N332 (The Russian Federation Code, 2004, N 29, Art. 3049; 2006, N 3, to the Art. 301), based on appeals of Public administrations of sea fish ports and board decision of Federal Tariff Service of May 23, 2006 of Np-26-т/1 I order:
1. Approve rates of the harbor fees levied by Public administrations of sea fish ports in sea fish ports of the Russian Federation for the courts servicing fishery complex and used for trade of water biological resources, priyemotransportny courts, auxiliary vessels and special purpose ships in sizes according to appendix 1 to this order.
2. Establish rates of the harbor fees in the sea fish ports of the Russian Federation having the adjacent water area with sea trade ports for the courts used for the purpose of merchant shipping, in the amount of the rates of charges operating in the sea trade ports which are on the adjacent water area (except for pilot collection in the port of Petropavlovsk-Kamchatsky and in the port of Kholmsk (extra port posting).
3. To administrations of sea trade ports and Public administrations of sea fish ports to exclude double collection of charges from courts in ports with the adjacent water area.
4. Establish rates of the harbor fees in the sea fish ports of the Russian Federation which do not have the adjacent water area with sea trade ports for the courts used for the purpose of merchant shipping, in the amount of the rates of charges operating in nearby sea trade ports (the Hasansky sea commercial port - the port of Posyet, Nevelsky sea fish port - Kholmsk port).
5. Approve Rules of application of the harbor fees in sea fish ports of the Russian Federation according to appendix 2 to this order.
6. Determine that this order becomes effective since July 25, 2006.

Appendix 2
1.1. These rates of the harbor fees from courts in sea fish ports of the Russian Federation are established by Federal Tariff Service on representation of sea fish ports (daleegosadministration) by federal public uchrezhdeniyamigosudarstvenny administrations for the courts servicing fishery complex and used for trade of water biological resources, priyemotransportny courts, auxiliary vessels and special purpose ships.
1.2. Application of the harbor fees is performed according to the current legislation of the Russian Federation.
1.3. The harbor fees in sea fish ports are levied by the State administrations according to the order of the Government of the Russian Federation of May 06, 1994 N487 "About Organization of Public Administrations of Sea Fish Ports" (The Russian Federation Code, 1994, N 3, the Art. 238) from the Russian and foreign vessels specified in the Table of Appendix 2, coming into the sea fish port for servicing, irrespective of their form of business of property, appointment and departmental accessory.
1.4. Collection of the harbor fees is made, as a rule, from conditional amount of the vessel estimated in cubic meters and determined by the work of three sizes specified in ship's papers: the greatest length, the greatest width and the greatest height of board of the vessel. The conditional amount of the vessel less than 1000 cubic meters is accepted to 1000 cubic meters. In relation to the delivery vessels having two and more decks and also transporting load on the main deck, the board height used in calculations shall not be less half-width of the vessel.
1.5. Collection of the harbor fees can be made also from the gross tonnage of the vessel estimated in gross register tons, specified in the certificate of measurement of the vessel. The choice of criteria (amount or capacity) in each port is made by the State administration and affirms Federal Tariff Service at the same time with rates of the harbor fees. Vessel capacity less than 1000 gross register tons is accepted for 1000 gross register tons, except the courts which are not going beyond port waters from which payment is levied for the actual capacity.
1.6. The conditional amount to the barge - towing structures, caravans and other compound floating objects for calculation of all types of the harbor fees, except ecological collection, is determined as the amount of amounts of separate elements.
1.7. For calculation of all types of the harbor fees conditional amount of courts of Ro - Ro, Lo - Ro, Ro - Flou, ABOUT and container carrying ships is multiplied by 0,7 coefficient. For calculation of all types of charges conditional amount of tankers with double bottom, double boards or tanks of the isolated ballast are multiplied by 0,85 coefficient.
1.8. These rates of the harbor fees are established in rubles, are basic, are indexed in need of established procedure.
1.9. The type of vessel and its specialization are determined by ship's papers.
1.10. Training, industrial practice, educational and training ships are exempted from payment of all types of charges if they do not make cargo and passenger operations of commercial nature in port.
1.11. The state administrations can provide discounts from rates of the harbor fees to the courts servicing fishery complex and the water biological resources used for trade, to priyemotransportny courts, auxiliary vessels and special purpose ships in the amount of no more than 20%.
1.12. Discounts from rates of the harbor fees are applied in relation to base rate (table 1 - 8 Appendices 1). By provision to the vessel of several discounts will be applied only the greatest of them.
1.13. The harbor fees shall be paid by the vessel to exit from port.
According to Article 80 of the Maritime Code of the Russian Federation (Russian Federation Code, 1999, N 18, Art. 2207; 2001, N 22, Art. 2125; 2003, N27 (p. I), Art. 2700; 2004, N 45, Art. 4377; 2005, N52 (1 h), the Art. 5581) the captain of sea fish port has the right to refuse to the vessel issue of permission to exit from port in case of failure to pay the established harbor fees.
2.1. Rates of ship due are specified in Table 1 of Appendix 1.

2.5. In foreign swimming and the ferry boats working at the lines of foreign swimming open in accordance with the established procedure the ship due is levied from vessels of group "G", passenger ships in each port of call in case of the first entrance to port or exit from port once within calendar year. From the ferry boats in the interport message which are not working at the lines opened in accordance with the established procedure collection it is levied in case of each entrance and exit from port.
2.6. The discount of 20% is provided to the cargo ships working at the lines of foreign swimming opened in accordance with the established procedure.
3.1. Rates of lighthouse due are specified in Table 2 of Appendix 1.
3.2. From vessels of groups "A", "B", "B", "E", and "З" the lighthouse due is levied for 1 cubic meter of conditional amount of the vessel in case of each entrance to port or pass by its transit.
3.3. The vessels coming into the sea fish port by force for emergency repair, and vessels of group "G" are exempted from payment of lighthouse due. Vessels of groups "D" and "Zh" are exempted from payment of lighthouse due if they do not make in port of cargo and passenger operations of commercial nature.
4.1. Rates of canal due are specified in Table 3 of Appendix 1.
4.2. From vessels of groups "A", "B", and "З" the canal due is levied for 1 cubic meter of conditional amount of the vessel in case of each passing of the channel one way.
In case of vessel exit to raid for the reasons which are not depending on it with the subsequent return the canal due repeatedly is not levied.
4.3. In foreign swimming and the ferry boats working at the lines of foreign swimming open in accordance with the established procedure collection is levied from vessels of group "G", passenger ships in each port of call in case of the first entrance to port and exit from port once within calendar year. From the ferry boats in the interport foreign message which are not working at the lines opened in accordance with the established procedure collection it is levied in case of each entrance and exit from port.
5.1. Rates of the berth charge are specified in Table 4 of Appendix 1.
5.2. The berth charge is levied from the courts which are lying alongside for one running meter of the mooring line occupied with the vessel in each hour of the parking of the vessel in case of production of cargo operations and vessel sediment the mooring in other cases.
In case of production of calculations the parking of the vessel is equated less than 30 min. to 0,5 of hour, more than 30 min. - is accepted in one hour.
The berth charge for vessel idleness at the mooring after the end of cargo operations is levied since the moment of the end of unloading/loading and fixture of load. Incomplete hour of idle time is considered for complete.
The berth charge can include the unaccounted expenses connected with hydrotechnical works at cordons of moorings of port.
5.3. 50% of the berth charge are levied from the courts standing log to other vessel moored at the mooring, or moored at the mooring by nose or stern.
5.4. Vessels of group "E" (except the courts coming for registration of customs and boundary formalities) are exempted from payment of the berth charge. The vessels of groups "D" and "Zh" and court coming into the port by force are exempted from the berth charge if do not make in port of cargo and passenger operations of commercial nature and are not in sediment.
6.1. Rates of anchorage due are specified in Table 5 of Appendix 1.
6.2. The anchorage due is levied for 1 cubic meter of conditional amount of the vessel from vessels of all groups in each hour of the parking on anchor on internal and external raid of port over 12 hours. The payment in the first 12 hours of the parking on anchor is not levied. Incomplete hour of the parking on anchor is considered for complete.
7.1. Rates of ecological collection are specified in Table 6 of Appendix 1.
7.2. Ecological collection is levied for 1 cubic meter of conditional amount of the vessel from vessels of groups "A" (except not self-propelled), "B" (except not self-propelled), "In" (except passenger), "" (except passenger) and "З" for 1 cubic meter of amount of the vessel and self-propelled part of compound object for acceptance without any limit of all types of the shown waste (except for ballast waters) for all the time of the parking of the vessel in port. Rates of charge include payment of all transactions connected with acceptance of ship waste (giving and cleaning of watercrafts, provision of containers and other reservoirs for collection of garbage, shlangovka, otshlangovka, etc.).
7.3. The discount in the amount of 50% is provided to the courts equipped with the nonconsumptive equipment for complete utilization of all types of ship waste and pollution and having certificates on prevention of pollution of the sea oil, sewage and garbage (environmentally friendly) from ecological collection.
7.4. Passenger and dumb boats are exempted from payment of ecological collection. Vessels of groups "D", "E" and "Zh" are exempted from payment of collection if do not make in port of cargo and passenger operations of commercial nature. Acceptance of waste by port from the courts exempted from payment of ecological collection is made according to requests of the ship master on the rates approved by port in accordance with the established procedure.
7.5. In the ports which do not have technical means for acceptance of all types of ship waste, ecological collection is not levied. In these ports acceptance of waste, including ballast waters, is performed on the rates approved by the organization performing operation of moorings in accordance with the established procedure.
8.1. Rates of pilot collection are specified in Table 7 of Appendix 1.
8.2. Pilot collection is levied for 1 cubic meter of conditional amount of the vessel in case of extra port and intra port pilot posting of the vessel.
8.3. In case of intra port posting pilot collection is levied for each transaction. In case of extra port posting pilot collection is levied for each mile of posting on waterway or the channel. The incomplete mile of posting is considered for complete. The vessel with conditional amount less than 5000 cubic meters is considered equal 5000 cubic meters.
8.4. Pilot collection does not include payment for the vehicles used for delivery and removal of the pilot from the vessel.
8.5. Vessels of group "D" (except sports courts and private yachts) are exempted from payment of pilot collection if do not make in port of cargo and passenger operations of commercial nature.
8.6. The discount in the amount of 20% is provided to the cargo ships working at the lines of foreign swimming opened in accordance with the established procedure and passenger ships in cabotage swimming.
8.7. In case of pilot posting of foreign and Russian sports vessels and private yachts in foreign shipping pilot collection is levied for the vessel:
up to 20 meters long - 554 rub;
up to 20 meters long,
the following as a part of group of courts, - 328 rub;
more than 20 meters long - 1058 rub.
8.8. Pilot posting in case of input-output of the vessel from dock, courts with the idle main engine, defective vinto-steering complex, special floating objects (drilling rigs, modules, docks, hotels, etc.) is paid for rates of Table 7 of Appendix 1, increased by 50%.
8.9. Pilot posting during the deviation works is paid for rates of intra port posting irrespective of the area of production of these works.
8.10. In case of simultaneous posting of several courts pilot collection is levied from each of them at the complete rate.
8.11. The basis for collection of pilot collection is the pilot receipt which is written out by the pilot and certified by the ship master or radiotelegraphic confirmation of the vessel.
8.12. In case of refusal of services of the pilot called on the vessel 100% of the pilot fee which is due for posting for which the pilot was called are paid.
9.1. Rates of berthage due are specified in Table 8 of Appendix 1.
9.2. The berthage due is levied for 1 cubic meter of conditional amount of the vessel in the ports equipped with coastal radar-tracking systems of management of movement of courts in case of each entrance to port, exit from port, pass by its transit.
9.3. Vessels office and hydrographic, the vessels coming into the port by force and for emergency repair, and also group "D" are exempted from payment of berthage due if do not make in port of cargo and passenger operations of commercial nature.
