About introduction of amendments to some resolutions of the Cabinet of Ministers of Ukraine

1. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

2. This resolution becomes effective in six months from the date of its publication.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine

1. In the resolution of the Cabinet of Ministers of Ukraine of August 7, 2013 No. 702 "About approval of technical regulations of rather energy marking" (The Official Bulletin of Ukraine, 2013, No. 76, Art. 2822; 2015, No. 44, Art. 1385):

  And figures of "article 14 of the Law of Ukraine "About standards, technical regulations and assessment procedures of compliance" shall be replaced with words 1) in the prolog of the resolution of the word also in figure of "article 5 of the Law of Ukraine "About technical regulations and assessment of conformity";

2) in the Technical regulation of energy marking of household electric refrigerators approved by the specified resolution:

 state Item 5 in the following edition:

"5. The supplier provides provision to the distributor for each model of the refrigerating device of national and foreign production of the printing and electronic energy label and the microfiche on whom information is specified according to the legislation on languages.

Requirements to the energy label are determined in appendix 2, and requirements to the microfiche - in appendix 3.

The electronic energy label and the microfiche are provided to distributors for each model of the refrigerating device introduced into circulation since January 1, 2022 with new code of model. The electronic energy label and the microfiche can be also provided to the distributor for other models of refrigerating devices.";

 state Item 8 in the following edition:

"8. If the refrigerating device is offered for sale, in hire or leasing by post orders, the catalog or otherwise when the consumer has no opportunity to see the refrigerating device, the distributor with guarantee provides the consumer with information according to appendix 5 before the consumer acquires, takes the refrigerating device in hire or leasing. If the refrigerating device is implemented remote by method (via the Internet) with provision of the electronic energy label and the microfiche, requirements of appendix 10 are applied.";

Requirements to conducting check of compliance of the actual technical characteristics of refrigerating devices to requirements of the Technical regulation of energy marking of household electric refrigerators

1. The admissible errors specified in this appendix are applied by bodies of the state market supervision and shall not be used by the supplier for establishment of values in technical documentation. Value and classes on the label or on the microfiche shall not be more favorable for the supplier, than the values given in technical documentation.

2. Check of compliance of refrigerating devices to requirements of the Technical regulation of energy marking of household electric refrigerators (further - the Technical regulation) is carried out by bodies of the state market supervision taking into account the following requirements:

1) one refrigerating device for each model is subject to check;

2) the model of the refrigerating device is considered conforming to requirements of the Technical regulation if:

the indicators given in technical documentation and the values used for their calculation are not more favorable for the supplier, than results of the corresponding measurements;

the indicators published on the label and the microfiche are not more favorable for the supplier, than the declared values, and the specified class of energy efficiency is not more favorable, than the class determined by the declared values;

during the state market supervision of check of the refrigerating device by bodies indicators of the corresponding parameters and value correspond to the admissible errors given in the table;

3) if the results specified in the paragraph second or third the subitem 2 presents of Item are not reached, the model, and also other models which are specified in technical documentation as equivalent are considered not conforming to requirements of the Technical regulation;

4) if result, the specified subitem in paragraph four 2 presents of Item, are not reached, bodies of the state market supervision choose three additional refrigerating devices of the same model for check. As alternative three additional refrigerating devices can be one model or other models which are specified in technical documentation as equivalent;

5) the model is considered conforming to requirements of the Technical regulation if for these three refrigerating devices arithmetic average value corresponds to the admissible errors given in the table;
