About approval of Rules of development of the program of prevention of large ecological incidents in case of waste management of the mining industry, and also the internal plan of response to such incidents
According to Item 1 article 362 of the Ecological code of the Republic of Kazakhstan (further - the Code) and Item 1 of Article 12 the Law of the Republic of Kazakhstan "About civil protection" we ORDER:
1. Approve the enclosed Rules of development of the program of prevention of large ecological incidents in case of waste management of the mining industry, and also the internal plan of response to such incidents.
2. To provide to department of state policy of waste management of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan after its official publication;
3) within ten working days after state registration of this order submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.
3. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan and the vice-Minister of Emergency Situations of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of development of the program of prevention of large ecological incidents in case of waste management of the mining industry, and also the internal plan of response to such incidents (further - Rules) are developed according to Item 1 of article 362 of the Ecological code (further - the Code) and Item 1 of article 12 of the Law of the Republic of Kazakhstan "About civil protection" and determines procedure for development of the program of prevention of large ecological incidents in case of waste management of the mining industry, and also the internal plan of response to such incidents.
2. The main the concept and determinations used in Rules:
1) waste of the mining industry - according to Item 1 of article 357 of the Code is the waste formed in the course of investigation, production, processing and storage of solid minerals including the overburden, containing breed, dust, poor ore, deposit of mechanical purification of career and mine waters, tails and slimes of enrichment;
2) identification of dangers of accident - process of identification and recognition of possibility of accident on hazardous production facility, and also establishments of characteristics of dangers of accident;
3) monitoring of natural and technical systems - system of stationary observations of condition of the environment and constructions in the course of their construction, operation, and also after liquidation, and development of recommendations about normalization of ecological situation and engineering protection of constructions;
4) the environmental impact assessment - according to Item 1 of article 64 of the Code is process of identification, studying, the description and assessment on the basis of the corresponding researches of possible essential impacts on the environment in case of realization of the planned activities including stages, stipulated in Article 67 Codes;
5) risk assessment of large ecological incidents - the process used for determination of probability and severity of effects of realization of dangers of accidents to health of the person, property and the surrounding environment;
6) the operator of object - physical person and legal entity, in property and which other legal use there is object making negative impact on the environment according to Item 6 of article 12 of the Code;
7) waste management of the mining industry - according to Item 1 of article 358 of the Code are the transactions performed concerning waste according to the principle of hierarchy of waste management;
8) the best available technicians applied in ore mining industry - the most effective and advanced stage of development of types of activity and methods of their implementation testimonial of their practical suitability to form basis of establishment of the technological standard rates and other ecological conditions directed to prevention and if it is almost impracticable, minimization of negative anthropogenous impact on the environment according to Item 1 of article 113 of the Code;
9) transactions on recovery of waste in ore mining industry - preparation of waste for reuse, conversion and waste recycling;
10) waste disposal of ore mining industry - any, the transaction which is not recovery on burial and destruction of waste, including auxillary operations on preparation of waste for burial and destruction (including on their sorting, processing, neutralization);
11) wasteless technology - the complex use of minerals and environment protection against pollution assuming the maximum extraction from raw materials of all valuable components in case of the minimum allocation and total absence of waste in firm, liquid and gaseous type;
12) low-waste technology - the complex use of minerals and environment protection against pollution assuming the greatest possible extraction at the company from raw materials of all valuable components in case of the minimum allocation of waste in firm, liquid and gaseous type. The low-waste technology only partially solves problem of complex use of raw materials and prevention of irreversible changes in the surrounding environment;
13) large ecological incident - the ecological situation which arose on the site of the territory where as a result of economic and other activity and natural natural processes there are steady negative changes in the environment menacing to health of the population, condition of natural ecological systems, genetic funds of plants and animals.
Other terms and determinations in these rules are applied according to the Code.
3. The program of prevention of large ecological incidents in case of waste management of the mining industry (further - the Program) is developed by the operator of subject to warehousing of waste and for the purpose of implementation and control of program implementation the operator of subject to warehousing of waste appoints the ranking officer according to Item 2 of article 362 of the Code.
4. According to Item 1 of article 362 of the Code before activities for accumulating of waste of the mining industry the operator of subject to warehousing of waste shall develop the program of prevention of large ecological incidents in case of waste management of the mining industry, and also the internal plan of response to such incidents according to Chapter 3 and in the form established according to appendix to these rules.
5. The program provides measures for prevention of large ecological incidents in case of waste management mining the industries.
6. The program is developed taking into account need of use of the best available the technician, providing implementation of wasteless and low-waste technology.
7. The program is reviewed in case of essential changes under operating conditions of subject to warehousing of waste and each ten years, nature of the warehoused waste.
8. In case of approach of large ecological incident the operator of subject to warehousing and long-term storage of waste according to item 4 of article 362 of the Code shall notify without delay by any available method authorized body in the field of environmental protection and provide all information, render assistance for the purpose of minimization of effects of such incident for life and human health and assessment of degree of the actual and potential ecological damage.
9. For the greatest possible decrease in risk, losses and damage in case of large ecological incident the program contains the following:
1) description of characteristics of subject to warehousing of waste of the mining industry;
2) plan development of internal response to large ecological incidents;
3) assessment and research of emergency/emergency situations;
4) aseismic construction and seismostrengthening of buildings and constructions;
5) hydrotechnical and engineering-geological protective measures;
6) protective measures on hazardous production facilities;
7) actions for prevention of the fires (explosions);
8) prevention and reducing amount of formation of waste;
9) amount of formation of waste, waste management methods with implementation of wasteless and low-waste technologies with use of the best available the technician.
10. In case of the description of characteristics of subject to warehousing of waste of the mining industry the following data are specified:
1) production (project) capacity (tons per day, tons / for operation), limit of tons/year for warehousing and limit of tons/year for long-term storage of waste;
2) the main factory, production and warehouse (warehouse) buildings, the capital processing, transport and aspiration equipment, reception and holiday devices which are part of object;
3) equipment of the equipment, buildings and constructions of object means of vzryvopreduprezhdeniye and explosion protection (application of ventilation and aspiration, remote automated management of production processes, availability of magnetic protection, the relay of control of speed, sensors subtime, the sensors of break of chain, control units of sbeganiye of tape, trailer switches, blocking, automatic lock-outs and other technical means performing similar functions and providing blocking, control and antiemergency protection, the easily dumped designs, the platform locks, sensors of control of content in air of dangerous gases and dust);
4) equipment fire extinguishing means, systems of the fire, production and alarm system, antismoke protection, emergency lighting, means of the notification and management of evacuation of people;
5) equipment of object systems of localization of explosion with indication of installation sites of ognepregrazhdayushchy and plameotsekayushchy devices and managing sensors (sensors indicators for detection of initial stage of explosion in case of achievement of certain threshold pressure), vzryvorazryadny devices.
11. For the purpose of ensuring readiness of subject to warehousing of waste of the mining industry for actions for localization and mitigation of consequences of accidents, for confirmation of characteristics of objects in the Program appendices are provided in type:
1) the master plan of the territory of subject to warehousing of waste, plans of buildings, rooms with indication of the capital equipment, entrances and exits of production rooms, the location of fire extinguishing means, fire announcers, phones, tools used in case of accident;
2) schemes of arrangement of the main communications of object with indication of the locations of the knife switches, latches, gates and other devices involved in case of accidents on objects;
3) schematic maps of distribution of stores of waste, with indication of arrangement coordinates, corresponding to the plan of mining operations of object;
4) the list of individual protection equipment for rescuing of people and accident elimination, tools and materials with indication of places of their storage;
5) the list of material, engineering and financial provision of transactions on localization and mitigation of consequences of accidents on objects.
12. Development of the internal plan of reaction of the Program of prevention of large ecological incidents in case of waste management of the mining industry, is carried out in three stages and includes:
1) first stage:
collection and generalization of basic data where it is provided:
identification of the objects constituting essential danger to the environment;
carrying out the analysis on long-term statistical observations of nature and types of the ecological incidents taking place on object, sizes of damage, terms of accomplishment of actions of liquidation of the ecological incidents raised forces and funds for liquidation of their effects;
receipt of the data on the territory and population rendering in zones of ecological incidents.
2) second stage:
taking into account basic data forecasting scenario of development of ecological incident:
possible zones of radioactive pollution, chemical and bacteriological infection, zone of the fires, explosions;
personnel number in the action area of the striking factors;
the possible caused damage (losses, material damage); upcoming events on liquidations of ecological incident and its effects, amount of upcoming events;
means and procedure for accomplishment of actions in case of threat and emergence of ecological incident.
3) third stage:
approval of the plan by the first head of object for waste management of the mining industry.
13. The internal plan of response to ecological incidents includes the following events:
1) short characteristic of subject to warehousing of waste;
2) actions for decrease in negative effects of ecological incident under management with waste of the mining industry;
3) the notification of governing bodies in the field of industrial safety;
4) technical actions of civil defense;
5) antiradiation, chemical and biological protection;
6) medical care, sanitary and anti-epidemic and sanitary and preventive actions;
7) evacuation actions;
8) material logistics;
9) organization and carrying out rescue and urgent works;
10) organization of management and communication;
11) prevention of ecological incident;
12) prevention and decrease in long-term negative effects from waste management.
