About approval of Changes in Rules of the market

According to the laws of Ukraine "About the market of electrical energy", "About the National commission performing state regulation in spheres of power and utilities" the National commission performing state regulation in spheres of power and utilities DECIDES:

1. Approve Changes in the Rules of the market approved by the resolution of the National commission performing state regulation in spheres of power and utilities of March 14, 2018 No. 307 (further - Changes) which are attached.

2. This resolution becomes effective from the date of, its promulgation following behind day on the official website of the National commission performing state regulation in spheres of power and utilities except:

paragraphs of the fifth - the ninth subitem 5, the subitem 8, paragraphs of the sixth - the eleventh subitem 9 of item 4 and the subitem 3 of Item 5 of the Changes which are becoming effective since March 1, 2021;

the paragraph of the third subitem 2 Items 2, Items 6 and 8 of Changes which become effective since June 1, 2021;

subitem 2 and paragraphs of the tenth - the twelfth subitem 5 of item 4 and the subitem 2 of Item 5 of the Changes which are becoming effective since September 1, 2021.

Changes in Rules of the market

1. In the Section I:

Item 1.1.3 of Chapter 1.3 after figures "308" to add 1) with signs, words and abbreviations "(further - Rules RDN and VGS)";

Item 1.8.4 of Chapter 1.8 to replace 2) with two new Items of the following content:

"1.8.4. The ARE performs observation of the market of electrical energy for the purpose of identification of manipulation, including performs the analysis of source of origin of electrical energy.

For action of the special obligations assigned to participants of the market of electrical energy for providing all-public concerns in the course of functioning of the market of electrical energy, manipulation of the market concerning which the analysis is made are:

availability at the participant of the market, except producers and the guaranteed buyer, negative saldovanny value of the registered amounts of electrical energy for settlement period;

implementation by the participant of the market, except producers and the guaranteed buyer, sale of electrical energy on RDN and purchase of electrical energy on VGS for settlement period.

Saldovanny value of the registered amounts of electrical energy is difference between total purchasing amount of electrical energy the participant of the market on DD, purchases of electrical energy on RDN, VGS and import of electrical energy and total sales amount of electrical energy by the participant of the market on DD of sale of electrical energy on RDN, VGS and export of electrical energy.

In case of identification of signs of possible market manipulation from the participant of the market the ARE the next working day notifies on it the Regulator and the corresponding participant of the market.

1.8.5. The ARE can address participants of the market about provision of confirmation of source of origin of electrical energy.

On condition of identification of signs of manipulation the ARE in one-day time is traded on the market of electrical energy to the SHOUTING and to the Regulator concerning violation by such participants of the market of these Rules.".

2. In the Section II:

Chapter 2.2 to add 1) with new Item of the following content:

"2.2.10. SVB, within the allowed volume of sales on the date of d, at 18:00 d-2 determines the greatest possible sales volume by DD to each of participants of the market who are part of such balancing group.

If during registration of DD the participant of the market submitted the notification on registration of amount of electrical energy which is more than an amount, of SVB determined for it, such registration deviates, and the participant of the market receives the adequate notice with indication of the reason and details of variation.";

2) in Item 2.3.1 of Chapter 2.3:

in paragraph one "and VGS" to exclude the word and abbreviation;

the sixteenth after the word "energies" to add the paragraph with signs and words ", less total amount of the purchased electrical energy".

3. To state Item 3.1.3 of Chapter 3.1 of the Section III in the following edition:

"3.1.3. In the market of GP can take part participants of the market who:

1) on the property right or other legal causes own, perform the order or use of units of provision of GP generating electrical energy, underwent testing, carried out the testing of electroinstallation according to the Code of system of transfer entered in the Register by PDP and which general installed capacity in point of joining of big 20 MW;

2) on the property right or other legal causes own, perform the order or use of units of provision of GP consuming electrical energy, underwent testing, carried out the testing of electroinstallation according to the Code of system of transfer entered in the Register by PDP and which general regulating capacity in accession point more than 1 MW;

3) perform function of the aggregator of objects of the distributed generation which total attached capacity more than 20 MW, and/or objects of consumption which general regulating capacity is at least 1 MW underwent testing, carried out the testing of electroinstallation according to the Code of system of transfer entered in the Register by PDP and signed the contract with owners of GP of SMALLPOX distributed generations/objects of consumption on representation of their interests on deliveries.".

4. In the Section IV:

Item 4.1.5 of Chapter 4.1 to state 1) in the following edition:

"4.1.5. Products in the balancing market is provision of the balancing energy by results of accomplishment of such types of dispatching teams:

1) direct activation of the offer of PPB;

2) activation of the offer of PPB is planned.

Item 4.8.4 of Chapter 4.8 to add 2) with the new subitem of the following content:

"4) corresponds to technical capabilities of structure of the equipment which was in work the last 60 hours at least one settlement period.";

Items 4.10.2 and 4.10.3 of Chapter 4.10 to state 3) in the following edition:

"4.10.2. All PPB, except PPB and units of provision of services of balancing specified in Item 4.10.4 of this Chapter shall submit proposals on the balancing electrical energy on loading on each unit of provision of services on balancing for each settlement period of trading day on all amount of the balancing electrical energy on loading which is equal to difference between available capacity of unit provision of services on balancing which remained taking into account obligations on provision of RPCh and aRVCh, and its schedule of leave irrespective of whether has obligation PPB on providing reserve of rRVCh and the Russian Railway as PDP. Offers on loading for direct activation of unit of provision of services on balancing cannot be less obligations of PDP on provision of rRVCh on loading, and offers on loading for the planned activation of unit of provision of services on balancing cannot be less obligations on provision of the Russian Railway on loading.

4.10.3. All PPB, except PPB and units of provision of services of balancing specified in Item 4.10.4 of this Chapter shall submit proposals on the balancing electrical energy on unloading on each unit of provision of services of balancing (except issue units of RES) for each settlement period of trading day on all amount of the balancing electrical energy on unloading which is equal to difference between its graphics of leave/selection and technical minimum of production taking into account obligations on provision of RPCh and aRVCh irrespective of whether it has obligation PPB on providing reserve of rRVCh and the Russian Railway as PDP.

Offers on unloading for direct activation of unit of provision of services on balancing cannot be less obligations on provision of rRVCh on unloading, and offers on unloading for the planned activation of unit of provision of services on balancing cannot be less obligations on provision of the Russian Railway on unloading.";

4) in Chapter 4.11:

5) in Chapter 4.14:

in Item to replace 4.14.1 figures and the sign "4.13" with figures and the sign "4.11";

add with five new Items of the following content:

"4.14.3. The ARE performs verification of the proposals submitted to PPB and determines availability of mistakes in them.

4.14.4. For verification of the offers on the balancing electrical energy submitted to PPB or created automatically by management system the market for each unit of rendering services in balancing which is issue unit such data concerning the offered amounts are considered:

1) urgent declarations on unavailability;

2) technical maximum of leave;

3) technical minimum of leave;

4) schedule of production.

4.14.5. Submission of offers on unloading from PPB which is producer is made only provided that such offer will be provided to PPB by its accomplishment on the generating equipment which was in work at least than 1 settlement period, within the last 60 hours.

The offers on the balancing energy submitted to PPB for the planned activation shall lead to the actual change of leave or selection for each checkout time to which they go, 1 MW at least · hour.

4.14.6. For verification of the offers on the balancing electrical energy submitted to PPB or created automatically by management system the market for each unit of rendering services in balancing which is sampling unit such data concerning the offered amounts are considered:

1) maximum operational load;

2) consumption map.

4.14.7. The dispatcher estimates possibility of use of the offer of PPB and in case of impossibility of its activation in the corresponding settlement period determines such offers as "Special".

The offers which received sign "Special" will not be used, and the following activated offers of other PPB do not reckon as the acceptance with the note.

The dispatcher has the right to establish sign "Special" on the following bases:

discrepancy of the actual loading of units of generation to schedules of physical leave taking into account dispatcher commands;

Hydroelectric power station, pumped storage power plant for ensuring balancing during the periods of minimum and maximum of consumption;

system and network restrictions;

production change from scratch to technical minimum of production;

change of production from technical minimum of production to zero.";

Items 4.15.4 and 4.15.5 of Chapter 4.15 to state 6) in the following edition:

"4.15.4. The list of the available offers on the balancing electrical energy is created separately for straight lines and the planned aktivation on bottom price of the offer in the direction on loading and top price in the direction on unloading and each hour is updated.

4.15.5. After receipt of offers on the balancing electric power for certain settlement period in 45 minutes prior to the beginning of this period of SMALLPOX on the basis of the short-term forecast of balance determines need of the planned activation for this settlement period.

By results of continuous monitoring of aRVCh this concerning use, sizes of balance of overflows with adjacent SMALLPOX or frequency during the isolated work and in case of emergency shutdowns of the generating equipment the dispatcher applies direct activation to bystreyshy recovery of aRVCh.

After determination of necessary sizes of capacity for loading/unloading of SMALLPOX estimates opportunity/need of provision/receipt of the emergency help to/from adjacent SMALLPOX on the corresponding request. On the basis of this information of SMALLPOX issues through management system the market the dispatching command for activation of relevant proposals PPB. Issue of dispatching command for activation is performed in the format determined by the protocol of activation which is provided by the international standard draft RRP - IEC 62325-451-7, or in case of application of contingency procedure - by phone. After receipt of positive confirmation from PPB the offer is designated as activated.";

"4.17.3. "4.18.3. 5. In the Section V:

Chapter 5.1 to add 1) with new Item of the following content:

"5.1.3. The ARE posts rules of rounding of calculations which are perfromed according to Rules of the market on the website.";

in Item 6.1.14 "and VGS" to exclude the word and abbreviation;

in Item 6.1.18 of the word of "one working day" shall be replaced with words "three working days";

in Item 6.1.19 of the word of "the next working day" shall be replaced with words "three working days";

add Item 6.1.21 with the new paragraph of the following content:

"In case other SVB bears responsibility for balance of the participant of the market as a part of its balancing group, the participant of the market can provide possibility of obligation fulfillment of SVB before SMALLPOX at the expense of obligations of such participant under its agreement on settlement of not balances of electrical energy which can arise in such SVB as a result of its participation in the balancing market in the corresponding trading day of d.";

Item 6.2.3 of Chapter 6.2 to add 2) with the new subitem of the following content:

"The possibility of use of such bank guarantee SMALLPOX in prior consent of the participant of the market when the participant of the market which provides the bank guarantee enters the balancing group of other SVB can consider 3) and, thus, transfers responsibility for the not balances of this SVB.".

7. The paragraph one of Chapter 10.11 of the Section X to state in the following edition:

"10:11. Till March 31, 2021 inclusive drawing of accounts for not balances of electrical energy it is performed ezhedekadno, and payments for discrepancy - monthly.".

8. To add Chapter 1 of appendix 1 with new Item of the following content:

"1.7. For the period of suspension of action of this agreement SMALLPOX has the right to use the means of the participant of the market deposited to account financial guarantees of SMALLPOX for providing the financial responsibility for not balances of other SVB with which the participant of the market signed the contribution agreement in the balancing group, in prior consent of this participant of the market. The procedure and conditions of calculations between the participant of the market and this SVB are determined by the contribution agreement signed between them in the balancing group.".

9. In appendix 7:

Item 2.1 of Chapter 2 to state 1) in the following edition:

"2.1. The total cost of this Agreement consists of the amount of all payments made SMALLPOX for benefit of PPB or PPB for benefit of SMALLPOX during action of this Agreement for the acquired and sold amounts of electrical energy in the balancing market in accordance with the terms hereof.

Indicative sizes are on monthly results determined: weighted average prices of the balancing electrical energy on loading and unloading for settlement month (UAH/MW · h to within nine signs after comma) which are calculated by division of cost of the balancing electrical energy into loading and unloading into the total amount of the balancing electrical energy into loading and unloading respectively.";
