About approval of Changes in some regulatory legal acts of the Ministry of Health of Ukraine

According to Item 8 of the Regulations on the Ministry of Health of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of March 25, 2015 No. 267 (in edition of the resolution of the Cabinet of Ministers of Ukraine of January 24, 2020 to No. 90), I ORDER:

1. Bring in the order of the Ministry of Health of Ukraine of June 1, 2021 No. 1066 "Some questions of forming of medical certificates of temporary disability and conducting their check", registered in the Ministry of Justice of Ukraine on June 2, 2021 for No. 728/36350, the following changes:

Item 5 in paragraph three the word of "September" to replace 1) with the word of "October";

The word of "September" to replace 2) in Item 6 with the word of "October";

The word of "September" to replace 3) in Item 8 with the word of "October";

Item 11 in paragraph one the word of "September" to replace 4) with the word of "October";

In paragraphs one and the second Item 13 the word of "September" to replace 5) with the word of "October";

The word of "September" to replace 6) in Item 14 with the word of "October".

2. Approve Changes in some regulatory legal acts of the Ministry of Health of Ukraine which are attached.

3. (Karchevich M. V.) to provide to management of development of digital transformations in health care submission of this order in the procedure established by the legislation on state registration in the Ministry of Justice of Ukraine.

4. I reserve control of execution of this order.

5. This order becomes effective from the date of its official publication.

Changes in some regulatory legal acts of the Ministry of Health of Ukraine

1. Item 1 of the Order of registration live-birth and mortinatus, the Ministry of Health of Ukraine approved by the order on March 29, 2006 179, registered in the Ministry of Justice of Ukraine on April 12, 2006 for No. 428/12302, after the paragraph of the thirteenth to add No. with the new paragraph the fourteenth the following content:

"Health certificate on the birth (ф. No. 103/about) and the medical certificate about the birth of the child are created and issued within a day since the child's birth after carrying out primary survey of the newborn.".

Registered in the Ministry of Justice of Ukraine on March 05, 2020 for No. 236/34519, to state the offer first of Item 18 of the Procedure for maintaining the Register of medical records, records about the direction and recipes in electronic health care system approved by the order of the Ministry of Health of Ukraine of February 28, 2020 No. 587, in the following edition::

"18. In case of unavailability of electronic medical information system, or impossibility of data exchange between electronic medical information system and the central database of system because of their technical defect, or in case of lack of the corresponding technical capability in system, health workers shall make medical records, records about the direction and recipes in the Register after elimination of technical defect or after emergence of the corresponding technical capability in system in time, determined by the technical requirements to electronic medical information system for its connection to the central database of electronic health care system approved by NSZU.".

To add the procedure for maintaining the Register of medical certificates in electronic health care system approved by the order of the Ministry of Health of Ukraine of September 18, 2020 No. 2136 "Some questions of maintaining the Register of medical certificates in electronic health care system", registered in the Ministry of Justice of Ukraine on September 30, 2020 for No. 952/35235, with Item 13 of the following content:

"13. The information from the Register can be provided on demand through system of electronic interaction of the state electronic information resources, including with use of the Single state web portal of electronic services "Portal Deystviye".

The request is sent for the purpose of verification of information on the created medical certificate and presentation of information on the corresponding medical certificate, with use of the Action Portal in the place of the requirement.

The request for receipt of data on the medical certificate from the Register shall contain the data sufficient for search in the Register of the corresponding medical certificate and unambiguous identification by system of the patient, the reference to entry in the Register of patients which are specified in such medical certificate.

For unambiguous identification by system of the patient the request shall contain part or set of the following data:

registration number of accounting card of the taxpayer according to the State register of physical persons - taxpayers (in the presence);

unique number of entry in the Unified state demographic register (in the presence);

details (series (in the presence) and number) one of the following identity documents (in the presence):

passport of the citizen of Ukraine;

temporary certificate of the citizen of Ukraine;

the certificate of birth (for persons which did not reach 14-year age) or the document confirming the birth fact issued by competent authorities of foreign state, legalized in accordance with the established procedure;

the residence permit in Ukraine;

certificate of the refugee;

the certificate of person which needs additional protection.

In case of unambiguous identification the system of the patient, the reference to entry in the Register of patients which are specified in such medical certificate, requesting provides the following information on the medical certificate from the Register:

1) number of entry in the Register;

2) date of forming and registration of the medical certificate in the Register;

3) type of the medical certificate;

4) effective period of the medical certificate;

5) the data provided by the corresponding procedures for forming and issue of medical certificates of the corresponding type approved by the Ministry of Health.

Data sets and order of interaction it is determined according to the current legislation about electronic interaction of the state electronic information resources.".

4. In the paragraph the second Item 7 of the Procedure for maintaining the Register of patients in electronic health care system approved by the order of the Ministry of Health of Ukraine of November 30, 2020 No. 2755, registered in the Ministry of Justice of Ukraine on January 13, 2021 for No. 44/35666, of figure "11" to replace with figures "10".

5. According to the procedure of forming of medical certificates about temporary disability in the Register of medical certificates in electronic health care system approved by the order of the Ministry of Health of Ukraine of June 1, 2021 No. 1066 "Some questions of forming of medical certificates of temporary disability and conducting their check" registered in the Ministry of Justice of Ukraine on June 02, 2021 for No. 728/36350:

1) paragraph one of Item 5 of the Section I after words "attending physician" to add with words "the subject of managing (further - the attending physician)";

2) in the Section II:

to state the subitem 11 of Item 1 in the following edition:

"11) effective period of the medical certificate (start date, end date);";

state Item 3 in the following edition:

"3. The medical certificate of category "Disease or Injury of General Nature" is created based on medical records about the state of health (functions of organism) of the patient aged from 14 years and the conclusion of the attending physician.

The attending physician of rehabilitation organization, department, division creates the medical certificate of category "Disease or Injury of General Nature" based on medical records of the patient who will receive treatment and/or the rehabilitation help and the conclusions of the attending physician about its temporary disability.

The direction for continuation of treatment and/or the rehabilitation help in rehabilitation organization, department, division is performed by the attending physician taking into account medical indications for holding actions for rehabilitation in the field of health care based on objective condition of the patient, results of prior treatment, these laboratory, tool, radiological, functional inspections.";

to add item 4 after words of "attending physician" with the words "about temporary disability of person";

in Item 12 of figure "11" to replace with figures "10";

in Item of the 13th figure and the word "6 - 7 and 13 - 14" to replace with figures and the word "6, 12 and 13";

3) in the Section III:

in the name to replace the word "period" with the word "term";

in Item 1 to replace the word "period" with the word "term";

in Item 3 to replace the word of "period" with the word of "term";

state Item 6 in the following edition:

"6. The medical certificates specified in the paragraph the second Item 3 of the Section II of this Procedure are created for the entire period of receipt of treatment and/or rehabilitation help with indication of effective period according to item 4 of the Section III of this procedure.";

exclude Item 7.

With respect thereto Items 8 - 14 to consider respectively Items 7 - 13;

in Item 7 to replace the word "period" with the word "term";

in Item 9 to replace the word "period" with the word "term";

to add Item 13 after the word "period" with words of "receipt of medical care in stationary conditions".

4) in the Section IV:

in paragraph one of item 4 of the word "Need of Care of the Sick Child" shall be replaced with words "Care of the sick child";

exclude Item 5.

With respect thereto Items 6 - 10 to consider respectively Items 5 - 9;

to add Item 9 after the word "Notifications" with the word "about";

5) in the Section V:

the paragraph one of item 4 to exclude.

With respect thereto paragraphs two - to consider the fortieth paragraphs the first - the thirty ninth;

state Item 6 in the following edition:

"6. Transfer of data in the Electronic register of leaves of disability is performed automatically directly from the moment of forming of the medical certificate in the Register, after installation of mark about cancellation of the medical certificate, and in case of unavailability to the central database of electronic health care system, system of electronic interaction of the state electronic information resources, the Electronic register of leaves of disability - directly from the moment of elimination of the corresponding defects or with initiation of the doctor of the medical certificate which is rather earlier created and entered in the Register.

The medical certificates created according to Item 3 of the Section IV of this procedure automatically do not go to the Electronic register of leaves of disability until identification of such patient.";

state Item 7 in the following edition:

"7. Information on the medical certificate of person which is provided on demand through the Action Portal contains the following data:

1) number of entry in the Register;

2) type of the medical certificate;

3) category of the medical certificate;

4) date and time of forming of the medical certificate;

5) data on the name of the subject of managing from the Register of subjects of managing in the field of health care in electronic health care system, the reference to record about which is specified in the medical certificate.

6) effective period of the medical certificate (start date, date of completion).".

6. In Item 3 of the Section II of the Procedure for issue (forming) of leaves of disability in the Electronic register of leaves of disability approved by the Order of the Ministry of Health of Ukraine on June 17, 2021 No. 1234, registered in the Ministry of Justice of Ukraine on July 7, 2021 for No. 890/36512:

in the offer the first paragraph one of the word "action period" in all cases shall be replaced with words "effective period";

after paragraph one to add with the new paragraph the second the following content:

"Till October 1, 2021 the leaf of disability is considered issued in 5 days after closing date of leaf of disability.".
