About modification and amendments in some orders of the Minister of Energy of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders of the Minister of Energy of the Republic of Kazakhstan to which changes and additions are made.

2. In spheres of hydrocarbons and subsurface use of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan to provide to department of the state control:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

The list of some orders of the Minister of Energy of the Republic of Kazakhstan to which changes and additions are made

1. In the order of the Minister of Energy of the Republic of Kazakhstan of November 27, 2014 No. 153 "About some questions of accreditation of the gas-network organizations" (it is registered in the Register of state registration of regulatory legal acts for No. 10135) to make the following changes and additions:

"According to the subitem 20) of article 6 of the Law of the Republic of Kazakhstan "About gas and gas supply", subitem 2-1) of Item 1 of article 12 of the Law of the Republic of Kazakhstan "About permissions and notifications" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" I ORDER:";

in Rules of accreditation of the gas-network organizations approved by the specified order:

state Item 1 in the following edition:

"1. These rules of accreditation of the gas-network organizations (further – Rules) are developed according to the subitem 20) of article 6 of the Law of the Republic of Kazakhstan "About gas and gas supply" (further – the Law), subitem 2-1) of Item 1 of article 12 of the Law of the Republic of Kazakhstan "About permissions and notifications" (further – the Law on permissions), the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on state services), determine procedure for carrying out accreditation of the gas-network organizations.";

"9. The employee of territorial subdivision and (or) the employee of structural division within 9 (nine) working days establish compliance or discrepancy of the applicant to allowing requirements by results of which prepare the conclusion signed by the employee of territorial subdivision and (or) the employee of structural division and the applicant (further - the conclusion).

The conclusion in electronic form, the head of territorial subdivision certified by the EDS, goes by means of the portal to authorized body.

10. The authorized body within 3 (three) working days considers the conclusion of the employee of territorial subdivision and (or) the employee of structural division.

In case of refusal in rendering the state service in the bases specified in Item 11 of these rules, authorized body not later than 3 (three) working days before completion of term of rendering the state service according to Article 73 of the Administrative procedural Procedure Code of the Republic of Kazakhstan (further – APPK RK) the notification on the provisional solution on refusal in rendering the state service, and also time and the venue of hearing for opportunity to express to the applicant line item according to the provisional solution in form, according to appendix 2-3 to these rules sends to the applicant.

The procedure of hearing is carried out according to article 73 APPK RK.

By results of hearing the authorized body makes the decision to refuse issue of the certificate by provision of motivated refusal in issue of the certificate on accreditation of the gas-network organizations for form, according to appendix 2-2 to these rules, or to grant the certificate in form, according to appendix 2-4 to these rules.

The certificate and motivated refusal in issue of the certificate signed by the EDS of the head of responsible structural division of authorized body go by means of the portal to "personal account" of the applicant in electronic form.";
