About modification and amendments in some Orders of the Minister of Agriculture of the Republic of Kazakhstan

I ORDER:

1. Bring the following changes and amendments in some orders of the Minister of Agriculture of the Republic of Kazakhstan:

1) in the order of the Minister of Agriculture of the Republic of Kazakhstan of July 8, 2015 No. 4-2/616 "About approval of Rules of conducting examination of high-quality and sowing qualities of seeds, including the seeds intended for crops by domestic agricultural producers" (it is registered in the Register of state registration of regulatory legal acts No. 12065, it is published on October 28, 2015 in information system of law of Ad_let):

The rules of conducting examination of high-quality and sowing qualities of seeds, including seeds intended for crops by domestic agricultural producers approved by the specified order to be reworded as follows, according to appendix 1 to this order;

2) in the order of the Minister of Agriculture of the Republic of Kazakhstan of July 9, 2015 No. 4-2/626 "About approval of Rules of implementation of high-quality and seed control, soil assessment, laboratory high-quality researches, examinations of quality of seeds" (it is registered in the Register of state registration of regulatory legal acts No. 12102, it is published on October 29, 2015 in information system of law of Ad_let):

in the Rules of implementation of high-quality and seed control, soil assessment approved by the specified order:

exclude Items 7 and 8;

state Items 20 and 21 in the following edition:

"20. Seed control is carried out by selection of control tests of seeds and subsequent their research in accredited laboratories on examination of quality of seeds.

21. By results of laboratory researches of control tests by accredited laboratories on examination of quality of seeds the analysis result of seeds in form, according to appendix 4 to these rules is issued to the applicant.";

state Items 25 and 26 in the following edition:

"25. Control of conducting examination of high-quality and sowing qualities of seeds by accredited laboratories on examination of quality of seeds and observance by them of regulatory legal acts and national standards is performed by gosseminspektor.

By results of control the inspection statement of conducting examination of high-quality and sowing qualities of seeds in form, according to appendix 6 to these rules is drawn up.

26. Gosseminspektora review the complaints of producers of seeds in case of their disagreement with the results of researches of seeds on high-quality and sowing qualities issued by accredited laboratories on examination of quality of seeds.

In case of confirmation of discrepancy of the indicators received in case of research of control test with the indicators specified in earlier issued documents confirming quality of seeds, this laboratory on examination of quality of seeds issues new documents.";

3. Establishment of compliance of sowing qualities of seeds to requirements of national standards is carried out by accredited laboratories on examination of quality of seeds based on research of the average test which is selected from batch of seeds according to national standards. High-quality qualities of seeds are confirmed by the act of approbation of high-quality crops.

Selection of average tests from batches of the seeds intended only for crops is made by the seed expert in the request of the producer of seeds and (or) the producer of seeds (their representatives) who had the corresponding training in accredited laboratory on examination of quality of seeds and having the corresponding conclusion.

Selection of average tests from batches of the seeds which are subject to realization is made according to the request of the producer of seeds by the state inspector on seed farming of the relevant local executive body with the assistance of the manufacturer representative of seeds.

Selection of average tests is drawn up by the act in form, according to appendix 1 to these rules. Average tests are registered in the magazine of registration of average tests in form, according to appendix 1-1 to these rules.

The act of selection of average tests is drawn up in duplicate - one copy is transferred to producer of seeds at which test is selected, another goes about breakdown to laboratory on examination of quality of seeds.

4. The laboratory on examination of quality of seeds depending on analysis results of tests issues to the applicant quality certificates of seeds - the certificate of quality of seeds or analysis result of seeds, and on seed potatoes - the act of the tuberous analysis. Data of quality certificates of seeds are registered qualities of seeds in form, according to appendix 1-2 to these rules.

Issue of quality certificates of seeds is registered in the magazine of registration of the issued quality certificates of seeds in form, according to appendix 1-3 to these rules.";

2. To provide to department of agriculture of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Agriculture of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of conducting examination of high-quality and sowing qualities of seeds, including the seeds intended for crops by domestic agricultural producers (further - Rules), are developed according to subitem 8-6) of Item 1 of article 6 of the Law of the Republic of Kazakhstan of February 8, 2003 "About seed farming" and determine procedure for conducting examination of high-quality and sowing qualities of seeds, including the seeds intended for crops domestic agricultural producers (further - agricultural producer).
