Bring in the Procedure for provision of social services to persons with disability and to elderly people who suffer from mental disturbances No. 576 approved by the resolution of the Cabinet of Ministers of Ukraine of June 26, 2019 (The Official Bulletin of Ukraine, 2019, No. 55, the Art. 1912), and the Procedure for the organization of rendering social services approved by the resolution of the Cabinet of Ministers of Ukraine of June 1, 2020 No. 587 (The Official Bulletin of Ukraine, 2020, No. 57, the Art. 1781), changes which are applied.

Changes which are made to the procedures approved by resolutions of the Cabinet of Ministers of Ukraine of June 26, 2019 No. 576 and of June 1, 2020 No. 587

1. And to elderly people who suffer from mental disturbances, No. approved by the resolution of the Cabinet of Ministers of Ukraine of June 26, 2019 576, to state procedure for provision of social services to persons with disability in the following edition:

1. This Procedure determines procedure for granting of social services, in particular by leaving, persons with disability and to the elderly people suffering from mental disturbances and needing social services (further - person with disability, the elderly person).

2. Persons with disability, elderly people according to individual requirements can receive social services which list is determined by the qualifier of social services which affirms Minsotspolitiki, in particular, social services in home care, stationary leaving, day care, palliative care, the supported accommodation.

3. Social services to persons with disability, to elderly people can appear free of charge, with establishment of the differentiated payment or at the expense of person with disability, the elderly person or the third parties.

Social services in the amounts determined by the state standards of social services approved by Minsotspolitiki's orders (further - state standards), are provided free of charge to persons determined by Item of 1 part two of article 28 of the Law of Ukraine "About social services".

To persons with disability (except persons with disability of the I group), to elderly people whose average monthly comprehensive income exceeds two subsistence minimums, but does not exceed four subsistence minimums for disabled persons, social services are provided with establishment of the differentiated payment according to the legislation.

To persons with disability (except persons with disability of the I group), social services are provided to elderly people whose average monthly comprehensive income exceeds four subsistence minimums at the expense of person with disability, the elderly person or the third parties.

Social services over the amounts determined by state standards are provided on condition of their payment.

Rates for social services are estimated in the supplier of social services according to the Procedure for regulation of rates for social services approved by the resolution of the Cabinet of Ministers of Ukraine of June 1, 2020 No. 428 (The Official Bulletin of Ukraine, 2020, No. 46, the Art. 1470).

4. The Council of Ministers of the Autonomous Republic of Crimea, the local state administrations and local government bodies have the right to make decisions on provision at the expense of budgetary funds of other social services and/or social services to other persons with disability, to elderly people, than 1 parts two of article 28 of the Law of Ukraine specified in Item "On social services". For this purpose the Council of Ministers of the Autonomous Republic of Crimea, local public administration and local government body makes the decision (publishes the instruction) on the list of the services provided at the expense of budgetary funds and/or on release of separate categories of persons from payment for provision of social services.

5. For receipt of social services person with disability, the elderly person, his legal representative submit the application for provision of social services (further - the statement), the authorized person of guardianship and custody body (for incapacitated persons who have no legal representative) - the notification on provision of social services (further - the notification) together with the documents specified in Item 8 of this Procedure in structural division concerning social protection of the population district in Kiev and Sevastopol of the state administration, executive body of village, settlement, city council (further - authorized body) in the place of residence/stay of person with disability, elderly people or in the center of provision of administrative services in case of provision of social services by suppliers of social services of the public and utility sector, and also the non-state sector with attraction of budgetary funds.

In case of availability at incapacitated face of two or more guardians the application is submitted by one of guardians.

The guardian who submitted the application within three days the registered mail reports to another (another) to the guardian (guardians) about its content.

For obtaining at suppliers of social services of the non-state sector of social services (except provided at the expense of budgetary funds) person with disability, the elderly person, his legal representative, the authorized person of guardianship and custody body address directly such supplier of social services.
