About modification of the Technical regulation of the Customs union "About safety of agricultural and forestry and landscape tractors and trail cars to them" (TR CU 031/2012)

According to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 29 of appendix № 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, Council of the Eurasian economic commission decided:

1. Bring in the technical regulation of the Customs union "About safety of agricultural and forestry and landscape tractors and trail cars to them" (TR CU 031/2012) accepted by the Decision of Council of the Eurasian economic commission of July 20, 2012 No. 60, of change according to appendix.

2. This Decision becomes effective after 180 calendar days from the date of its official publication.

The changes made to the Technical regulation of the Customs union "About safety of agricultural and forestry and landscape tractors and trail cars to them" (TR CU 031/2012)

1. 3. To state Item 2 of Article 1 in the following edition:

"2. This technical regulation does not extend on:

tractors small-size and trail cars to them;

trail cars of special purpose;

chassis of trail cars;

the tractors, trail cars and components released on customs area of the Union before entry into force of this technical regulation and which were in the use on customs area of the Union.".

4. State Article 2 in the following edition:

"Article 2. Determinations

For the purposes of application of this technical regulation concepts which mean the following are used:

"ballast loads" - the loads intended for installation on the tractor for additional charge of front and (or) back axis;

"the towing device" - the tractor design element which is in front of the tractor, providing connection of devices (bar, towing rope, etc.) for its towing;

"commissioning" - documentary drawn up event fixing readiness of the tractor or trail car for application to destination;

"tractor height" - the distance measured down between the bearing area and point of the tractor which is at the greatest distance from the bearing area excepting the antenna. In case of determination of height the tractor shall be equipped with the new tires having the largest static radius established by the manufacturer;

"the two-fuel engine" - the engine which is intended for concurrent work on diesel and gaseous fuel and the consumed quantity of one type of fuel in relation to another can vary depending on operating mode and type of the engine;

"tractor length" - the distance measured across between the vertical planes, perpendicular longitudinal axis of the tractor and passing through its extreme points, excepting all mirrors, starting handles, lobbies or side marker lights;

"the admissible towed weight" - the weight which the tractor can tow. The admissible towed weight can include the mass of one or several towed trail cars, the mass of farm or forestry and landscape vehicles;

"manufacturer" - the legal entity or physical person registered as the individual entrepreneur, the production and the realization of the tractor, trail car or component enabling on its own behalf and responsible for its compliance to requirements of this technical regulation;

"category of the tractor (trail car)" - the characteristic of the tractor (trail car) applied for the purpose of establishment of requirements to it in this technical regulation;

"component" - the component of the tractor or trail car delivered on assembly production and (or) as replaceable (reserve) parts for the tractor or trail car which is in operation;

"the forestry and landscape tractor" - the tractor for accomplishment of technological works on reforestation and care of the wood;

"the maximum rated speed of the tractor" - the speed calculated by indicators of nominal frequency of rotation of bent shaft of the engine, the smallest transfer relation of transmission and lack of slipping;

"the small-size tractor" the agricultural or forestry and landscape tractor intended for performance of works on melkokonturny sites, allotments, terraces, farms in gardens, park and utility farms, with a rated power of engine up to 19 kW;
