About approval of the Regulations on hostels and the Standard agreement of hiring of premises of the state housing stock in the hostel

Due to the adoption of the Housing code of the Republic of Belarus the Council of Ministers of the Republic of Belarus decides:

1. Approve the enclosed Regulations on hostels and the Standard agreement of hiring of premises of the state housing stock in the hostel.

2. Recognize as BSSR which voided the resolution of Council of Ministers of January 15, 1986 N15 "About Approval of the Regulations on Hostels" (SZ BSSR, 1986, N 4, the Art. 68) and the resolution of Council of Ministers of the Republic of Belarus of March 18, 1997 N215 "About Modification of the Regulations on Hostels" (Collection of decrees, presidential decrees and orders of the Government of the Republic of Belarus, 1997, N 8, the Art. 297).

Regulations on hostels

CHAPTER 1. GENERAL PROVISIONS

1. This Provision determines accounting treatment for the citizens wishing to receive premises (its part) (further - premises) in the hostel, provisions of premises in hostels, their operation, content and repair.

2. Hostels intend for accommodation of citizens for their work (service) in state body, other organization or training in the organizations of general secondary, professional, secondary vocational, higher, vocational education, the organizations realizing educational programs of postgraduate education (further - the organization).

The premises in the hostel are provided also to the employees of the organizations of health care, culture, trade, public catering, consumer services of the population who are directly servicing labor collective of the organizations under which authority this hostel, or to employees of the organizations who took equity in construction of this hostel is.

In the presence in the hostel of empty seats and absence in the organization under which authority it is of persons needing premises in the hostel, such rooms of the state housing stock can be provided to employees of other organization for its petition based on the employment contract of premises of the state housing stock in the hostel concluded according to the legislation.

3. Under hostels the apartment houses (their part) which are specially built or re-equiped for these purposes are provided. Re-equipment of apartment houses under hostels is made with the permission of district, city, district in the city, settlement, rural executive and administrative organ.

Placement of hostels in cellars, semi-basements (first floors), and also use under hostels of rooms in the apartment houses intended for permanent residence of citizens is not allowed.

4. Hostels intend for accommodation:

lonely citizens (premises are in joint use of several faces which are not consisting in the family relations);

families (the premises consisting of one or several rooms are in the isolated use of families).

5. In the hostels intended for accommodation of lonely citizens if necessary with the consent of local executive and administrative organs premises for accommodation of families can be allocated. These rooms shall be located on certain floors or in separate sections.

6. Premises in hostels are provided in the isolated use to the lonely citizens having diseases in case of which according to the conclusion of the state organization of health care cohabitation with them in one premises is impossible, and in exceptional cases - and to other lonely citizens.

7. The internal rules and procedures in hostels are established by the rules approved by administration of the organization in coordination with trade-union committee (in case of its availability).

CHAPTER 2. ACCOUNTING OF THE CITIZENS WISHING TO RECEIVE PREMISES IN THE HOSTEL

8. On accounting of persons interested to receive premises in the hostel citizens since revenues to work (service, study) according to the housing legislation and collective agreements registered in local executive and administrative organs are accepted according to the statement.

The citizens living in the hostels intended for accommodation of lonely citizens in case of creation of family in accordance with the established procedure get registered persons interested to receive premises in the hostel intended for accommodation of families.

9. Acceptance of citizens on accounting of persons interested to receive premises in the hostel is made based on the written applications submitted by them in form according to appendix 1 in the presence of the bases established by the legislation and (or) the collective agreement.

The application for acceptance on accounting of persons interested to receive premises in the hostel moves addressed to the head of the organization.

For the solution of question of acceptance on accounting of persons interested to receive premises in the hostel the organization accepting on such accounting in three-day time from the date of receipt of the petition from the citizen requests according to the procedure, established in article 22 of the Law of the Republic of Belarus of October 28, 2008 "About bases of ministerial procedures" (The national register of legal acts of the Republic of Belarus, 2008, No. 264, 2/1530), the relevant state bodies, other organizations have following documents:
