About modification of the Technical regulation of safety of infrastructure of rail transport and the Technical regulation of safety of railway vehicles of rail transport

The Cabinet of Ministers of Ukraine decides:

1. Bring in the Technical regulation of safety of infrastructure of rail transport approved by the resolution of the Cabinet of Ministers of Ukraine of July 11, 2013 No. 494 (The Official Bulletin of Ukraine, 2013, No. 54, Art. 1969; 2016, No. 6, the Art. 307), and the Technical regulation of safety of railway vehicles of rail transport approved by the resolution of the Cabinet of Ministers of Ukraine of December 30, 2015 No. 1194 (The Official Bulletin of Ukraine, 2016, No. 12, the Art. 501), changes which are applied.

2. This resolution becomes effective in fifty one months from the date of its publication.

Changes which are made to the Technical regulation about safety of infrastructure of rail transport and the Technical regulation of safety of railway vehicles of rail transport

1. In the Technical regulation of safety of infrastructure of rail transport approved by the resolution of the Cabinet of Ministers of Ukraine of July 11, 2013 No. 494:

Items 1 and 2 to state 1) in the following edition:

"1. This Technical regulation determines the main requirements to elements of infrastructure of rail transport during its designing, production, construction, installation, adjustment, operation, and also assessment procedure of compliance to requirements of this Technical regulation.

2. In this Technical regulation terms are used in such value:

1) safety of infrastructure of rail transport - condition in case of which safety of life and human health is ensured during their transportation by railway transport and environment protection;

2) infrastructure facilities of rail transport - separate infrastructure facilities of rail transport and their complexes;

3) the set requirements - the requirements established in this Technical regulation which there shall correspond infrastructure of rail transport for the purpose of ensuring operational compatibility;

4) railway tracks of uncommon use - railway tracks of subjects of managing which are used for provision of services of rail transport and for own needs;

5) infrastructure of rail transport - the technological complex including railway tracks public (including sidings), engineering constructions (bridges, tunnels, viaducts, etc.), power networks, traction substations and other devices of technological electric utility service, contact network, systems of the alarm system, centralization, blocking, communication and telecommunications, information complexes and traffic control systems of trains, ways of access for passengers and loads to elements of infrastructure of rail transport, protective afforestations, locomotive and car repair sheds, Items of maintenance of cars, stations, and also other buildings, constructions, devices and the equipment which provide functioning of such complex and are used for provision of services on transportation of passengers and loads by rail.

Is not part of infrastructure of rail transport:

railway infrastructure which the subject of managing has and uses it only for own needs and at which the railway vehicles of rail transport which have no right of exit to infrastructure of rail transport work;

infrastructure of the subways, trams;

infrastructure which has historical and cultural value and is used only for tourist appointment;

6) operational compatibility (interoperability) - capability of rail transport to provide safe movement of railway rolling stock which corresponds to the required quality level of work and depends on technical, technological, organizational, qualification conditions which need to be observed for compliance to the set requirements;

7) components of elements of infrastructure of rail transport - components, groups of components, the equipment, assembly units or nodes of the equipment which are established or intended for installation in elements of infrastructure of rail transport.

Other terms are used in the value given in the Laws of Ukraine "About transport", "About rail transport", "About standardization", "About technical regulations and assessment of conformity", "About accreditation of conformity assessment bodies", "About consumer protection", "On regulation of town-planning activities".";

Item 8 to add 2) with paragraphs of the following content:

"The list of constituent elements of infrastructure of rail transport which are subject to assessment of conformity to requirements of this Technical regulation with indication of the modules of assessment of conformity or their combinations which are applied to certain elements (products types) depending on complexity, appointment and influence on safety are given in appendix 1.";

Action of this Technical regulation extends to the infrastructure components specified in appendix 1 behind numbers 3 - 7, 13 - 16, 19 - 21, 24, 26, 27, 32, 44, 45, 52, 53, 60 - 63, 65, since January 1, 2025.";
