About modification of the order of the Government of the Kyrgyz Republic "About the organization of work within the Eurasian Economic Union" of March 9, 2020 No. 138

For the purpose of implementation of the Presidential decree of the Kyrgyz Republic "About structure and structure of the Cabinet of Ministers of the Kyrgyz Republic and structure of Administration of the President of the Kyrgyz Republic" of October 12, 2021 425, according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides No.:

1. Bring in the order of the Government of the Kyrgyz Republic "About the organization of work within the Eurasian Economic Union" of March 9, 2020 No. 138 the following changes:

1) in Item 2:

- to add subitem 1 after the word "economies" with the words "and commerce";

- in subitem 2 of the word of Government office shall be replaced with words Presidential Administration;

- add subitem 3 with the paragraph the fifth the following content:

"-weekly participate in meetings of Board of ECE in the video conference mode by consideration of the questions carried to their competence.";

Appendix 1 to the above-stated resolution to state 2) in edition according to appendix 1 to this resolution;

3) according to the procedure of consideration of documents (materials), preparation of line items for meetings of the Supreme Eurasian economic council, Eurasian intergovernmental council, Council and Board of the Eurasian economic commission, approved by the above-stated resolution:

- state Items 2-7 in the following edition:

"2. The Administration of the President of the Kyrgyz Republic (further - Presidential Administration) after receipt of documents (materials) on the questions included in the agenda of meetings of the Supreme Eurasian economic council, Eurasian intergovernmental council, Council and Board of the Eurasian economic commission (further - bodies of EEU), according to Items 21 and 68 of the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, within two working days (on additional questions no later than day of receipt) constitutes matrix of responsible state bodies and directs materials:

- in the Ministry of Economy and Trade of the Kyrgyz Republic - for forming of the project of line items of the Kyrgyz Republic concerning bodies of EEU, and also theses of performances to meetings of the Supreme Eurasian economic council and Eurasian intergovernmental council;

- in the Ministry of Foreign Affairs of the Kyrgyz Republic - for consideration within the competence of drafts of decisions of bodies of EEU on compliance to international treaties of the Kyrgyz Republic and to other international legal acts containing the international obligations of the Kyrgyz Republic with the subsequent provision of line item in the Ministry of Economy and Trade of the Kyrgyz Republic;

- in the Ministry of Justice of the Kyrgyz Republic - for consideration within the competence regarding compliance of drafts of decisions of bodies of EEU to provisions of regulatory legal acts of the Kyrgyz Republic with the subsequent provision of line item in the Ministry of Economy and Trade of the Kyrgyz Republic;

- in authorized state bodies on the fields of activity within the Eurasian Economic Union assigned to authorized state bodies according to appendix 1 to the Procedure for consideration of documents (materials), preparation of line items for meetings of the Supreme Eurasian economic council, Eurasian intergovernmental council, Council and Board of the Eurasian economic commission, - for preparation and entering into the Ministry of Economy and Trade of the Kyrgyz Republic of line items according to drafts of decisions (orders, recommendations) of bodies of EEU, including on their compliance to the international legal acts containing the international obligations of the Kyrgyz Republic, and also the list of the acts of the legislation of the Kyrgyz Republic containing other rules, than offered to establishment in the draft decision of bodies of EEU;

- in the interested state bodies and other organizations - for consideration of drafts of decisions (orders, recommendations) of bodies of EEU with the subsequent provision of results of consideration in the relevant authorized state bodies, including on their compliance to the international legal acts containing the international obligations of the Kyrgyz Republic, and also the list of the acts of the legislation of the Kyrgyz Republic containing other rules, than offered to establishment in the draft decision of bodies of EEU.

3. If the draft decision (orders, recommendations) bodies of EEU exerts impact on activities of subjects of entrepreneurship, authorized state bodies discuss such draft decision with representatives of business community in the respective sphere.

Discussion with business community and public discussion are carried out at stage of completion of the draft decision with authorized state bodies.

Results of the carried-out work go to the Ministry of Economy and Trade of the Kyrgyz Republic and are specified in line item in form according to appendix to this Procedure.

Heads of responsible authorized state bodies bear responsibility for not carrying out discussion on drafts of decisions (orders, recommendations) of bodies of EEU with representatives of business community.

4. Authorized state bodies in case of need approve drafts of decisions (orders, recommendations) of bodies of EEU with other interested state bodies and the organizations.
