About introduction of amendments to the order of the Minister of information and social development of the Republic of Kazakhstan of April 2, 2020 No. 101 "About approval of Rules of rendering the state services of information"

1. the rules of rendering the state service "Registration, Inventory, Issue of the Duplicate of the Certificate Foreign TV, the Radio Channel Extended to the Territories of the Republic of Kazakhstan" approved by the specified order to state in edition according to appendix 3 to this order;

the rules of rendering the state service "Registration or Inventory of Periodic Printing Editions, News Agencies and Online Medias" approved by the specified order to state in edition according to appendix 4 to this order.

2. To provide to committee of information of the Ministry of information and social development of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of information and social development of the Republic of Kazakhstan;

3) within ten working days after state registration of this order provision in Legal department of the Ministry of information and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of information and social development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of rendering the state service "Registration, Inventory, Issue of the Duplicate of the Certificate Domestic TV, Radio Channel"

Chapter 1. General provisions

1. These rules are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" and determine procedure for rendering the state service "Registration, Inventory, Issue of the Duplicate of the Certificate Domestic TV, Radio Channel".

2. The state service "Registration, Inventory, Issue of the Duplicate of the Certificate Domestic TV, Radio Channel" (further - the state service) appears Committee of information of the Ministry of information and social development of the Republic of Kazakhstan (further - the service provider).

3. In these rules the following basic concept is used:

the standard of the state service - the list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service.

Chapter 2. Procedure for rendering the state services

For receipt of the state service the physical and (or) legal entities performing activities of provision of services in the field of TV and radio broadcasting in the territory of the Republic of Kazakhstan (further - uslugopoluchatel) send to the service provider through the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further - the Portal), the statement in form according to appendices 1, 2 or 3 to these rules, and also the documents specified in the standard of the state service according to appendix 4 to these rules.

The office of the service provider in day of receipt of documents performs their acceptance, registration and transfers to execution to responsible structural division. In case of provision by uslugopoluchatel of complete document package for receipt of the certificate on registration the employee of structural division of the service provider within 8 (eight) working days considers documents for contents of the statement, checks for availability of the identical name in the register registered domestic TV, radio channels, and also checks the provided receipt for correctness of filling of details, following the results of creates the certificate on registration.

In case of discrepancy of uslugopoluchatel to the above-stated requirements the service provider passes the decision on refusal in rendering the state service.

To Uslugopoluchatel the notification with appendix of the provisional solution on refusal in rendering the state service in time not later than 3 (three) working days before its signing goes.

Uslugopoluchatel provides objection to the provisional solution about refusal in rendering the state service no later than 2 (two) working days from the date of receipt of the notification in time.

By results of consideration of objection, in case of receipt from uslugopoluchatel, the service provider grants the certificate on registration or motivated refusal in rendering the state service.

6. TV, the radio channel is subject to inventory in cases of change of the owner or change of form of business, the name, and also name TV, radio channel.

7. When giving uslugopoluchatel of the statement on certificate inventory the employee of structural division of the service provider considers documents within 8 (eight) working days on contents of the statement, checks for availability of the identical name in the register registered domestic TV, radio channels, and also in case of change of the owner checks provided data of the documents confirming change owner/assignment of rights of property.

In case of discrepancy of uslugopoluchatel to the above-stated requirements the service provider passes the decision on refusal in rendering the state service.
