ORDER OF THE MINISTER OF HEALTH OF THE REPUBLIC OF KAZAKHSTAN

About approval of Health regulations "Sanitary and epidemiologic requirements to radio engineering objects"

(as amended of the Order of the Minister of Health of the Republic of Kazakhstan of 05.04.2023 No. 60)

According to the subitem 113) of Item 15 of the Regulations on the Ministry of Health of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of February 17, 2017 No. 71 I ORDER:

1. Approve the enclosed Health regulations "Sanitary and epidemiologic requirements to radio engineering objects".

2. Declare invalid the order of the Minister of Health of the Republic of Kazakhstan of April 23, 2018 No. 188 "About approval of Health regulations "Sanitary and epidemiologic requirements to radio engineering objects" (it is registered in the Register of state registration of regulatory legal acts at No. 17241).

3. To provide to committee of sanitary and epidemiologic control of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Health of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Health regulations "Sanitary and epidemiologic requirements to radio engineering objects"

Chapter 1. General provisions

1. These Health regulations "Sanitary and epidemiologic requirements to radio engineering objects" (further – Health regulations) are developed according to the subitem 113) of Item 15 of the Regulations on the Ministry of Health of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of February 17, 2017 No. 71 and establish sanitary and epidemiologic requirements to radio engineering objects (further – RTO).

2. Sanitary and epidemiologic requirements of these Health regulations are directed to prevention of adverse effect on health of the person of electromagnetic fields (further - EMP) the radio-frequency range of 30 kilohertzes (further - kHz) - 300 Gigahertzes (further - GHz) created by the stationary transferring RTO:

the radio-transmitting devices, intended for transfer of television broadcasting;

the radio-transmitting devices, intended for transfer of sound (radio) broadcasting;

stations of radio cable television;

the send-receive radio-electronic means (further - RES) intended for ultrashort-wave (further - VHF) and trunking system of radio communication;

stationary (basic) stations of cellular communication;

RES short-wave (further - KV) the range;

radio relay stations with capacity of the transmitter more than 1 Watt (further - W);

basic systems of wireless radio access (WLL) with capacity of the transmitter of 2 W and above;

stationary (terrestrial) stations of satellite communication;

RES of sea, air services (including shore, radar stations, radio beacons);

stationary long-term systems of radio suppression.

3. Sanitary and epidemiologic requirements of these Health regulations extend to RTO specified in Item 2 of these Health regulations, except for the following RTO:

mobile RES of VHF radio communication;

mobile RES of KV range;

radio relay stations with capacity of the transmitter of 1 W and less, on condition of placement out of rooms;

stationary (basic) systems of wireless radio access (WLL) with capacity of the transmitter to 2 W on condition of placement out of rooms;

products of household appliances, household radio-receiving devices, high-frequency devices of household purpose;

subscriber terminals of cellular communication, subscriber terminals of the DECT standard (Дэкт) (1880-1990 Megahertz (further - MHz));

subscriber terminals of systems of wireless radio access (WLL);

equipment of simultaneous interpretation of the speech (inductive and synchronous);

reporting and concert radiomicrophones;

means of inductive telephone communication, remote control and alarm system;

the cable broadcasting and industrial high-frequency television systems including used in mines;

devices of security radio signaling of cars;

devices of remote control of the security alarm system and notification (MHz 433,075-434,79);

radio control equipment models (airplanes, motor boats) (MHz 28,0-28,2; 40, 66-40,70 MHz);

children's radio intercoms and radio-controlled toys (26957-27283 kHz);

RES for processing of bar code labels and the information transfer received from these labels (430 MHz);

slukhorechevy radio exercise machines for people with defects of hearing;

intra house devices with technologies of the wireless Bluetooth connection (Bluetooth), "Wi-Fi" of transfer, (Wi-Fi) with range, to 100 meters (further - m);

RES used in office, storage facilities (readers, measuring instruments, femtosota);

RES used for remote removal of meter readings.

Chapter 2. Sanitary and epidemiologic requirements to the choice of the parcel of land, designing, placement, reconstruction and commissioning of radio engineering objects

4. On the project documentation on establishment of borders of impact of EMP and placement of RTO (RES) specified in Item 2 of these Health regulations including after the changes influencing electromagnetic situation of the adjacent territory (change of location of antennas, the modes of radiation, quantity and height of placement of antennas) the sanitary and epidemiologic conclusion in the form approved by the order of the Minister of Health of the Republic of Kazakhstan of August 20, 2021 No. KR DSM-84 "About approval of forms of accounting and reporting documentation in the field of sanitary and epidemiologic wellbeing of the population" (it is registered in the Register of state registration of regulatory legal acts at No. 24082) (further - the sanitary and epidemiologic conclusion), for exceptions of RTO specified in Item 3 of these Health regulations and in case of dismantle and final conclusion from operation of transmitters and antennas is drawn up.

Placement of RTO (RES) corresponds to the sanitary and epidemiologic conclusion issued by territorial subdivision of state body in the field of sanitary and epidemiologic wellbeing of the population (further - territorial subdivision) and to the declared characteristics in the project documentation.

EMP is the field arising near source of electromagnetic oscillations and on the way of its distribution.

The objects of radio engineering profile which are technologically radiating to the environment electromagnetic oscillations in the range of radio frequencies 30 kHz-300 of GHz belong to RTO.

The technical means intended for transfer and (or) acceptance of radio waves and consisting of one or several transferring and (or) intakes, or their combinations, including the service equipment belong to RES.

5. The project documentation for execution of the sanitary and epidemiologic conclusion in territorial subdivision is submitted physical and (or) legal entities in whose maintaining is RTO (RES) and (or) the project organizations.

Accomplishment of actions, including completeness, reliability and quality of the developed project is provided by the customer and the developer of the project documentation.

6. The project documentation affirms the head of developer of the project documentation, the organization or the individual entrepreneur and is approved with the customer (the owner of RTO, RES).

7. Physical and (or) legal entities, in whose maintaining there are RES located on RTO provide to the owner of object necessary data for carrying out calculations of electromagnetic radiations (further - EMI), and also provide mutual data exchange, necessary for carrying out such calculations.

EMI is the electromagnetic oscillations created by natural or artificial source.

8. In the project documentation total calculations of EMI from all transferring antennas of circular and sector radiation taking into account antennas of the third-party operators located on object (in the presence) are represented.

Total EMI is energy set of radiations of electromagnetic waves from all transferring RTO antennas located in one territory.

The transferring means intended for radiation extensively on horizontal axis belong to antennas of circular radiation (the antenna of communication of the organizations, repeaters, television, broadcasting and similar antennas of circular radiation).

The transferring means intended for the radiation of radio waves in certain sector (antennas of cellular radio communication, wireless radio access and similar antennas of sector radiation) belong to antennas of sector radiation.

9. The list of the data and materials necessary for execution of the sanitary and epidemiologic conclusion which contain in the project documentation is provided in appendix 1 to these Health regulations.

10. Owners of RTO send information on the transmitters and antennas dismantled and finally removed from work to territorial subdivision.

11. In case of placement on object (roof, antenna and mast construction, the parcel of land) of the transferring antennas of 1 (one) or several RTO (RES) belonging 1 (one) or to different legal entities and physical persons, the sanitary and epidemiologic conclusion on the project documentation with total calculation of EMI from all transferring antennas (taking into account antennas of the third-party operators located on object, in the presence) is drawn up separately on RES of each owner.

12. In case of placement on object of radio engineering profile (roof, antenna and mast construction, the parcel of land) RTO (RES) 2 (two) and more RES of 1 (one) or different owners which is specially intended on purpose for placement, the owner of object of radio engineering profile draws up the single sanitary and epidemiologic conclusion taking into account all RES, irrespective of type and capacity of the antennas which are on this object.

13. On the parcels of land which are not intended on purpose for the RTO installation RTO determined by Item 3 of Article 25 of the Land code of the Republic of Kazakhstan, the RTO (RES) installations having infrastructure which except for are again placed are placed.

The total capacity of the transferring means brought to the antenna taking into account losses in antenna-feeder path belongs to emitted capacity of the antenna (further - AFT).

To AFT intermediate devices (cables, wave guides, connections) for transfer of radio signal from the transmitter (receiver) belong to the radiating (reception) part of the antenna.

14. In case of placement of the transferring RTO (RES) antennas with total capacity of all transmitters, 1000 W and above circular and sector radiation in the horizontal plane (in case of the direction of the main petal) are led to the relevant party on radio masts at distances to the territory of the housing estate, nurseries, educational and the organizations of health care determined by results of calculations of the sizes of sanitary protection zones (further - the SPZ) and building restriction zones (further - ZOZ), but:

1) with height of installation of antennas of 100 m and above from the earth - 100 m and above;

2) with height of installation of antennas from 50 to 100 m - 200 m and above;

3) with height of installation of antennas to 50 m - 300 m and above.

The layout and building in zone of the operating and projectible RTO, RES, including radio television stations of 1000 W and is performed taking into account borders of the SPZ and ZOZ above. The new construction of the housing estate, nurseries, educational and the organizations of health care is not carried out to the SPZ and ZOZ. In the presence in the SPZ and ZOZ of historically developed residential and public buildings and constructions, the project documentation is coordinated if actions for protection against adverse influence of EMP, and also confirmation of safety for health of the population based on risk assessment for health of the population, compliance of maximum permissible levels (further - PDU) settlement indicators and lack of excesses of PDU by results of tool researches are provided.

15. Placement of the transferring range RTO (RES) antennas 30 MHz and above with emitted capacity of 100 W and is forbidden on roofs of residential, public and office buildings above.

16. In case of placement of antennas of radio amateur radio stations of the range of 1,8-30 of MHz, radio stations of the civil range of frequencies 26, the MHz with effective emitted capacity of 100 W and is provided impossibility of access for people to zone of installation of the antenna to distance of 5 m and above from any its point above. The transferring range antennas 3-30 MHz with capacity of transmitters of 1 kilowatts (further - kW) and above on roofs of residential, public and office buildings are not placed.

17. RES antennas of sector radiation with negative corner of the place of maximum of radiation in the vertical plane (with inclination down) 10 degrees and above and emitted capacity of 25 W and above, placed in the depth of roofs of residential, public and office buildings, are mounted at the height of 5 m and above from roof level.

18. RES antennas of sector radiation with capacity of the radiation of 25 W and less are placed on capital (executed from brick, steel concrete) walls of buildings in indirect visibility from windows, balconies, loggias of the specified buildings.

19. Take place on capital (executed from brick, steel concrete) walls of the buildings or not main walls which are not adjoining on rooms for stay of people, the antenna of directed radiation with capacity of the radiation of 10 W and less for exceptions of placement of RES antennas of circular radiation on walls with windows, balconies, loggias of residential, public and office buildings, regardless of results of calculations of the SPZ, ZOZ and the biological danger area (further – BOZ). The distance from the antenna to windows, balconies, loggias makes 3 m and above.

The territory where at the height over 2 m from the Earth's surface, the EMP levels exceed PDU belongs to ZOZ. The external border of ZOZ is determined by the maximum height of residential buildings of perspective building at the level of which upper floor, the EMP levels correspond to PDU.

The territory adjoining RTO on which external border at the height of 2 m from the Earth's surface the EMP levels are equal to PDU belongs to the SPZ.

The zone which is formed around the radio-transmitting antennas on which border the EMP level is equal to PDU belongs to BOZ.

The transferring means intended for radiation in the narrow sector (the antenna of satellite, radio relay communication) belong to antennas of directed radiation.

20. Placement of RES antennas of circular and sector radiation, and also antennas of stations of satellite communication on roof of the buildings intended for stay of people (factory, residential, public and office buildings) is allowed, in case of observance of one of the following conditions:

1) availability of steel concrete overlapping of upper floor;

2) availability of metal roof;

3) availability of the technical floor.

21. In buildings and constructions installation of the internal (indoor) which are specially intended for this purpose is allowed (Indore) of antennas.

22. Telecommunication cases (racks) with the network equipment are placed in technical rooms, except for placements of containers with the equipment of RTO (RES) in residential, public and working places.

23. On the parcels of land of the general education organizations placement of projectible RTO (RES) is performed in economic zone.

The zone having separate entrance (entrance) and placed from production rooms of the dining room and near educational-experimental zone belongs to economic zone of the general education organizations.

24. Borders of the SPZ are determined at the height of 2 m from the Earth's surface. The size of the SPZ is calculated from the antenna basis taking into account perspective development of RTO.

25. Borders of the SPZ and ZOZ are specified by legal entities and physical persons, being owners of RTO (RES) after carrying out tool measurements of the EMP levels. In case of reasonable need of such refining for projectible RTO (RES) in the column "Offers" of the sanitary and epidemiologic conclusion, register relevant proposals.

26. On external borders, ZOZ at height of the existing building, corresponds to the EMP level. The external border of ZOZ is determined by the maximum height of buildings of the developed and perspective building, in the absence of data on perspective building at height of installation of RES antennas from earth level.

27. For the transferring radio stations equipped with antennas of circular radiation, television stations and also for radar stations of the circular overview of the SPZ and ZOZ are established around RTO (RES).

28. For the transmitting stations equipped with antennas of directed action and also for radar stations which antennas scan in certain sector or are fixed in one direction, SPZ and ZOZ are established in the direction of the radiation of electromagnetic energy, taking into account side and back petals, vertical and horizontal directional patterns of radiation of antennas.

29. For transmitting stations which antennas radiate electromagnetic energy under certain corner to the horizon and the EMP level changes depending on height, ZOZ is established on the lower inclination of beam differentially down within height of buildings of the adjacent housing estate.

Chapter 3. Sanitary and epidemiologic requirements to working conditions with sources of the physical factors making impact per capita and assessment of levels of electromagnetic fields

30. For the purpose of safety of the person from harmful effects of physical factors, PDU EMP in the selitebny territory, in vacation spots, in residential, public and production places are provided according to appendix 2 to these Health regulations.

31. The equipment of RTO (RES) corresponds to PDU EMP of the range of the frequencies of 30 kHz-300 of GHz on workplaces in case of professional impact, and also hygienic assessment of impact of EMP is performed on energy loading of electric field, magnetic field, density of flow of electromagnetic energy according to appendix 3 to these Health regulations.

Sanitary and epidemiologic requirements to working conditions of EMP of the different frequency ranges working, exposed in the course of labor activity to professional impact in case of any nature of impact of EMP, conform to requirements of these Health regulations.

Energy loading (dose, exposure) is total energy exposure of electromagnetic energy during its impact for change.

32. In case of simultaneous radiation from several sources for which the same PDU are established total strength of electric field (E) or total density of flow of energy (further - PPE) correspond PDU values:

In case of simultaneous radiation from several sources for which different PDU are established total electric field strength (further - E) and total PPE constitute 1,0 and more:

where: Е 1, 2, …, n - in formula (1) - the electric field strength created by each source of EMP separately, volt on meter (further - In oil);

in formula (3) - the total electric field strength in each normalized range of frequencies determined by formula (1), In oil;

Epdu 1, 2, …, n - maximum permissible strength of electric field of the normalized range, In oil;

PPE 1, 2, …, n - in formula (2) - the energy flow density created by each source of EMP separately, microwatt on square centimeter (further - ¼¬éÔ/cm 2);

in formula (3) - the total density of flow of energy in each normalized range of frequencies determined by formula (2), ¼¬éÔ/cm2;

PPEPDU - the maximum permissible level of density of flow of energy of the normalized range, ¼¬éÔ/cm2.

33. For assessment of the EMP levels created by RES calculation and laboratory and tool methods are used.

34. Calculation methods of determination of the EMP levels created by RTO taking into account types of the transferring means of working frequencies, the modes and capacities, parameters and space arrangement of antennas, land relief, availability of the rereflecting surfaces are used only at stage of examination of the project documentation.

Borders of BOZ are calculated from the transferring antennas, from all transferring antennas placed on 1 (one) object (in the presence) borders of total BOZ of radiation with indication of extent in the horizontal and vertical planes and concerning locations of antennas are calculated. The EMP levels at SPZ heights (2 m from the earth) and ZOZ (at the level of windows of adjacent buildings) in the circular direction (for antennas of circular radiation) or the azimuthal direction are calculated (for sector and directed antennas).

35. Laboratory and tool methods are used for assessment of the EMP levels created by RES. When using laboratory and tool evaluation methods the permanency of the modes and the maximum capacity of the radiating means is provided.

36. In case of laboratory and tool evaluation method of the EMP levels the gages which underwent the state checking and having the appropriate certificate according to the Law of the Republic of Kazakhstan "About ensuring unity of measurements" are used. Limits of relative error of gage constitute ±30% and less. Hygienic assessment of results of measurements is performed taking into account gage error.

37. Measurements of levels of intensity of the electric (magnetic) field and density of flow of energy of EMP it is carried out in case of turning on of the equipment on the maximum capacity of radiation according to the methodical instructions approved according to article 94 of the Code of the Republic of Kazakhstan "About health of the people and health care system". Laboratory and tool researches of the EMP RTO (RES) levels are conducted by physical persons and legal entities in whose maintaining there is RTO (RES) in case of:

1) commissioning of RTO (RES);

2) need of refining of borders of the SPZ, ZOZ of RTO (RES) put into operation and operating;

3) in case of change of conditions and operating mode of RTO (RES) influencing the EMP levels (change of orientation of antennas, increase in capacity of transmitters);

4) in case of change of the situational plan for the territories, adjacent to RTO, RES;

5) placement of antennas of radio amateur radio stations, radio stations of the civil range;

6) after holding actions for decrease in the EMP levels.

38. Laboratory and tool researches of the EMP RTO (RES) levels are conducted when conducting checks of operators of RTO (RES) or the selitebny territory by territorial subdivisions.

39. In case of exceeding of PDU of intensity of the electric (magnetic) field and density of flow of energy of EMP, the legal and (or) physical persons who are owners of RTO (RES) take measures for reducing number of RES and bringing indicators to PDU EMP in the selitebny territory, in vacation spots, in residential, public and production places according to appendix of 2 these Health regulations and energy loading of electric field, magnetic field, density of flow of electromagnetic energy, according to appendix of 3 these Health regulations.

Chapter 4. Sanitary and epidemiologic requirements to holding actions for prevention of adverse effect of electromagnetic fields per capita

40. Ensuring protection of workers against adverse influence of EMP is performed by legal entities and physical persons in whose maintaining there is RTO (RES) by holding organizational, technical and preventive actions.

41. Organizational actions provide:

1) choice of rational operating modes;

2) restriction of duration of stay of personnel in the conditions of impact of EMP;

3) the organization of workplaces at distances from sources of EMP providing observance of normative requirements.

42. Technical actions provide:

1) rational placement of sources of EMP;

2) application of collective and individual remedies, including shielding of sources of EMP or workplaces.

43. Preventive actions include passing preliminary (in case of revenues to work) and periodic medical examinations of faces which are professionally tied with impact of sources of EMP RTO (RES) according to the order of the acting minister of health care of the Republic of Kazakhstan of October 15, 2020 No. KR DSM-131/2020 "About approval of target groups of persons which are subject to obligatory medical examinations and also rules and frequency of their carrying out, amount of laboratory and functional researches, medical contraindications, the list of harmful and (or) dangerous production factors, professions and works in case of which accomplishment preliminary obligatory medical examinations in case of revenues to work and periodic obligatory medical examinations and rules of rendering the state service "Passing of Preliminary Obligatory Medical Examinations" are performed (it is registered in the Register of state registration of regulatory legal acts at No. 21443).

44. Prohibit the people who are directly not connected with servicing of the antenna equipment of RES access to installation site of the transferring antennas.

45. The territory (sites of roofs) on which the EMP level exceeds PDU and on which there is access for persons who are not connected directly with servicing of RTO is protected and designated by precautionary signs. In case of work on these sites RTO transmitters are switched-off.

46. The screens reflecting EMP of radio frequencies are carried out from metal sheets, grid, the carrying-out films, fabric with microwire, the metallized fabrics on the basis of the synthetic fibers having high conductivity and are grounded.

47. In all cases of placement of RTO (RES) his owner considers the possibility of application of different methods of protection (passive and active) public and factory buildings from EMP on blueprint stages, constructions, reconstruction and operation.
