About introduction of amendments to the resolution of the Cabinet of Ministers of Ukraine of February 28, 2022 No. 169

Bring in Item 1 of the resolution of the Cabinet of Ministers of Ukraine of February 28, 2022 No. 169 "Some questions of implementation of defense and public purchases of goods, works and services in the conditions of warlike situation" the following changes:

third subitem 2 to replace the paragraph with paragraphs of the following content:

"for other purchases - the decision of governing body of state-owned property of the subject of managing of public sector of economy; decision of governing body of utility property; the decision of relevant organ of management of the subject of the managing performing activities on object of critical infrastructure with use of property of utility sector of economy.

If the Cabinet of Ministers of Ukraine performs powers of the subject of management of state-owned property or general meeting of the subject of managing of public sector of economy, lists and purchasing amounts of goods of works and services in representation of the customer are approved by the central executive body creating state policy in the respective sphere in which the company of public sector of economy performs the activities according to the purpose determined by its constituent documents;";

to add the subitem 3 of Item 1 with the paragraph of the following content:

"Action of this subitem does not extend to the agreements signed for ensuring needs of the sector of safety and defense. Such agreements will be promulgated in electronic purchasing system within 10 working days after the termination or cancellation of warlike situation;".
