About Coordination council on partner interaction on development under the Cabinet of Ministers of the Kyrgyz Republic

For the purpose of implementation of general coordination and acceptance of agreed decisions on use and planning of the external help from partners in development, according to articles 13 and 17 of the constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Form Coordination council on partner interaction on development under the Cabinet of Ministers of the Kyrgyz Republic in structure according to appendix 1.

2. Approve Regulations on Coordination council on partner interaction on development under the Cabinet of Ministers of the Kyrgyz Republic according to appendix 2.

3. Recognize invalid:

1) the order of the Government of the Kyrgyz Republic "About Coordination council on partner interaction on development under the Government of the Kyrgyz Republic" of August 30, 2012 No. 592;

2) Item 34 appendices to the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of July 1, 2013 No. 395;

3) Item 3 of the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of May 17, 2016 No. 261;

4) the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic "About Coordination council on partner interaction on development under the Government of the Kyrgyz Republic" of August 30, 2012 No. 592" of May 18, 2017 No. 296.

4. This resolution becomes effective from the date of official publication.

Appendix 1

Structure of Coordination council on partner interaction on development under the Cabinet of Ministers of the Kyrgyz Republic

Chairman of the Cabinet of Ministers of the Kyrgyz Republic, chairman of the board;

the representative of partners in development (under approval), the cochairman of Council;

First Deputy Chairman of the Cabinet of Ministers of the Kyrgyz Republic, vice-chairman of Council.

Members of council:

Minister of Economy and Trade of the Kyrgyz Republic;

Minister of Finance of the Kyrgyz Republic;

Minister of Foreign Affairs of the Kyrgyz Republic;

the chief of the structural division of Administration of the President of the Kyrgyz Republic knowing questions of partner interaction on development and the external help, the secretary of Council;

representatives from partners in development (under approval).

Regulations on Coordination council on partner interaction on development under the Cabinet of Ministers of the Kyrgyz Republic

1. General provisions

1. The coordination council on partner interaction on development under the Cabinet of Ministers of the Kyrgyz Republic (further - Council) is the advisory advisory body providing development and preparation of recommendations and offers on effectiveness of realization of the provided external help.

2. The term "partners in development" is understood as the international organizations, the international financial institutions, the donor countries and foreign banks.

3. The Cabinet of Ministers of the Kyrgyz Republic and partners in development perform the activities on the basis of the following principles:

1) commitment to the accepted international treaties which became effective according to the legislation of the Kyrgyz Republic in the field of increase in efficiency of the external help;

2) interaction on the basis of consultative process and dialogue;

3) transparency and complementarity, exception of duplication and ensuring effective and productive use of means.

4. The main objective of Council is carrying out dialogue and development of steady cooperation between the Cabinet of Ministers of the Kyrgyz Republic and partners in development for ensuring effectiveness of use and increase in efficiency of provision of external development assistance.

5. For the solution of this task Council performs the following functions:

1) discussion and preparation of recommendations about questions of use and attraction of the external help according to development priorities, certain Cabinet of Ministers of the Kyrgyz Republic;

2) development of offers and recommendations for state bodies about enhancement of mechanisms of planning and use of the external help, and also development of offers on acceleration of interstate procedures for entry into force of implementable agreements.

3. Rights of Council

6. For achievement of the main objective Council has the right:

1) to invite heads of state bodies and partners in development in questions of provision of the external help to the meetings;

To attract 2) in accordance with the established procedure specialists of state bodies, other organizations and experts, including foreign, to implementation of expert evaluation of course of execution of actions for improvement of efficiency of attraction and use of the external help from partners in development, enhancement of normative and legal and procedural procedures of provision and use of the external help, determination of strategy and priorities of attraction of the external help;

3) to accept and make recommendations in state bodies and to partners in development in questions of enhancement of procedures and policy in the field of provision and effective use of the external help.

4. Organization of activities of Council

7. The cochairman of Council is elected from partners in development from among partners in development on rotational basis for a period of one year by general open voting.

8. The chairman and the cochairman of Council head Council, approve the agenda, preside over meetings of Council, sign the made decision of Council.

9. The structural division of Administration of the President of the Kyrgyz Republic knowing questions of partner interaction on development and the external help acts as the secretariat of Council.

10. Meetings of Council are held as required, but at least once in six months.

11. Decisions of Council are made by a majority vote from total number of members of council.

12. Decisions of Council for cases in point are drawn up in the form of the protocol with the developed offers or recommendations.

13. Under Council on temporary or permanent basis working bodies of Council can be created. The decision on creation of relevant organs of Council is made by Council.

14. Organizational support of activities of Council performs the secretariat of Council, and also authorized state body in the field of economic development of the Kyrgyz Republic.

15. Monitoring of execution of recommendations and offers of Council is performed by the structural division of Administration of the President of the Kyrgyz Republic knowing questions of partner interaction on development and the external help and also authorized state body on forecasting and budget implementation.

5. Rights of members of council

16. Members of council have the right:

1) to participate in debate at meetings of Council, to make offers, notes and amendments on the substance of the discussed questions, to propose candidacies of experts, to ask questions, to give references, and also to have other rights granted to members of council according to the procedure, established by this Provision;

2) to take part in preparation and implementation of the recommendations accepted by Council;

3) to receive and study all information necessary for accomplishment of obligations of members of council by them;

4) to be present at meetings of working bodies of Council with the right of casting vote at discussion of the questions which are within the competence of Council;

5) it is free to express the opinion on any question of activities of Council;

6) to participate in work of the commissions and the working groups of the Cabinet of Ministers of the Kyrgyz Republic, the ministries, departments and local government bodies concerning improvement of realization of the provided external help and increase in efficiency of its attraction;

7) to address to state bodies and to request from them information, necessary for work of Council.

6. Obligations of members of council

17. Members of council shall:

1) personally to take part in work of Council, in activities of its working bodies and actions within the accepted work plans of Council;

2) to participate in activities of Council, without allowing omissions of its meetings without valid excuse;

To provide 3) to other members of council exhaustive information on content, the course and results of the activities within the accepted work plans of Council;

4) to promote implementation of decisions and recommendations of Council.

7. Functions and powers of the secretariat of Council

18. Secretariat of Council in accordance with the established procedure:

1) has the right to request information, necessary for work of Council;

2) is provided by monitoring of consideration of recommendations and offers of Council together with authorized state body for forecasting and budget implementation;

3) has the right to address to the relevant state bodies and to partners in development with request for creation of expert groups for the solution promptly of problematic issues;

4) prepares reports to members of council, informs the chairman, the cochairman and members of council on consideration of recommendations and offers of Council;

5) participates in preparation of meetings of Council.
