About modification of the Regulations on territorial authority of administration of Public service of special communication and information security of Ukraine

According to the Law of Ukraine "About Public service of special communication and information security of Ukraine", assigned to Administration of Public service of special communication and information security of Ukraine of tasks I ORDER to the Standard regulations on territorial authorities of the ministry and other central executive body approved by the resolution of the Cabinet of Ministers of Ukraine of May 25, 2011 No. 563, to Regulations on Administration of Public service of special communication and information security of Ukraine, approved by the resolution of the Cabinet of Ministers of Ukraine of September 3, 2014 No. 411, for the purpose of ensuring accomplishment by territorial authorities:

1. Make changes to the Regulations on territorial authority of administration of Public service of special communication and information security of Ukraine approved by the order of Administration of Public service of special communication and information security of Ukraine of September 1, 2014 No. 432, registered in the Ministry of Justice of Ukraine on September 18, 2014 for No. 1142/25919 (with changes), having been reworded as follows it which is applied.

2. To provide to the director of the department of planning of application of bodies and divisions and special communication of Administration of Public service of special communication and information security of Ukraine submission of this order on state registration in the Ministry of Justice of Ukraine.

3. This order becomes effective from the date of its official publication.

4. I reserve control of execution of this order.

Regulations on territorial authority of administration of Public service of special communication and information security of Ukraine

I. General provisions

1. This Provision determines the organization-legal status, the main objectives, functions, powers and organizational bases of office activities of territorial authorities of Administration of Gosspetssvyaz in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol, and also interregional (which powers extend to several administrative and territorial units) territorial authorities of Administration of Gosspetssvyaz (further - territorial authority).

2. The territorial authority is included into general structure of Public service of special communication and information security of Ukraine (further - Gosspetssvyaz), submits and is under control to Administration of Gosspetssvyaz and provides accomplishment of the tasks assigned on Gosspetssvyaz in the territory of the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol, and formed as interregional territorial authority - in the territory of several administrative and territorial units to which its powers extend (further - the region).

3. The territorial authority is created, liquidated and will be reorganized in coordination with the Vice-Prime Minister of Ukraine - the Minister of digital transformation of Ukraine, the Cabinet of Ministers of Ukraine.

Offers on creation, reorganization and liquidation of territorial authority for consideration to the Vice-Prime Minister of Ukraine - to the Minister of digital transformation of Ukraine are introduced by the Chairman of Gosspetssvyaz.

4. The territorial authority will be formed, will be reorganized according to the legislation within general structure, extreme number of workers, including the military personnel, territorial authorities of Administration of Gosspetssvyaz approved by the Cabinet of Ministers of Ukraine, and allocated funds for ensuring accomplishment of the tasks assigned to Administration of Gosspetssvyaz.

5. The structure of territorial authority is approved by the Chairman of Gosspetssvyaz in coordination with the Vice-Prime Minister of Ukraine - the Minister of digital transformation of Ukraine.

The staff (staff list) and the estimate of territorial authority is approved by the chairman of Gosspetssvyaz.

6. The territorial authority in the activities is guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine, resolutions of the Verkhovna Rada of Ukraine accepted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, orders of the Ministry of digital transformation of Ukraine, orders of the Vice-Prime Minister of Ukraine - the Minister of digital transformation of Ukraine, his first deputy and deputies, other regulatory legal acts and acts of organizational and administrative nature of Administration of Gosspetssvyaz, orders of the Chairman of Gosspetssvyaz, his deputies and the head of the structural unit of Administration of Gosspetssvyaz who performs within competence and the conferred powers of function of governing body on planning of application of territorial authorities of Administration of Gosspetssvyaz and territorial subdivisions of Gosspetssvyaz, and this Provision.

7. The territorial authority is legal entity of the public law, has seal with the image of the State Emblem of Ukraine and the name, other seals and stamps, own forms, accounts in bodies of the Public treasurer service of Ukraine, including in foreign currency.

The territorial authority contains at the expense of means of the government budget.

8. Office activities of territorial authority are performed according to plans of office activities of Gosspetssvyaz, the annual plan of office activities of territorial authority and current plans of office activities of structural divisions of territorial authority. The annual plan of office activities of territorial authority is approved by the chairman of Gosspetssvyaz after its approval of the chairman of local public administration.

9. The territorial authority is completed with military personnel, government employees and workers (further - staff) who on the personal, business and moral qualities, educational degree and professional level, the state of health and age are capable to carry out tasks and obligations determined by their job descriptions.

The general procedure and conditions of passing of military service, the right and obligation of the military personnel of territorial authority are determined by charters of the Armed Forces of Ukraine, the Regulations on passing of military service (training) by the military personnel of Public service of special communication and information security of Ukraine approved by the Presidential decree of Ukraine of July 31, 2015 No. 463. Employment relationships of government employees are governed by the Law of Ukraine "About public service", and workers - the Labor code of Ukraine.

10. The staff of territorial authority performs the office activities according to job descriptions which are approved by the chief of territorial authority.

11. On property of territorial authority operation of the Law of Ukraine "On legal regime of property in the Armed Forces of Ukraine" expatiates.

12. The territorial authority for the purpose of the organization of the activities provides in accordance with the established procedure self-representative office of territorial authority in courts and other bodies through persons, representatives to be effective from his name, including through officials of legal service of territorial authority, or other authorized persons, and also provides representation of interests of territorial authority in courts and other bodies through representatives.

II. Main objectives, functions and powers of territorial authority

1. The main objectives of territorial authority are:

1) ensuring functioning, safety and development of the state system of government communication (further - GSPS), national system of confidential communication (further - NSKS) and national telecommunication network (further - NTS), realization of state policy in spheres of cryptographic and technical information security, protection of the state information resources and information, the requirement for which protection is established by the law, in information and communication systems and on subjects to information activities, counteraction to technical investigations, in spheres of protection in cyberspace of the state information resources and information, the requirement for which protection is established by the law, cyberprotection of critical information infrastructure, implementation of the state control in such spheres;

2) participation in realization of state policy in spheres of electronic document management (regarding information security of state bodies and local government bodies), electronic identification (with use of electronic confidential services), electronic confidential services (regarding control of observance of requirements of the legislation in the field of electronic confidential services);

3) providing in accordance with the established procedure and within competence of activities of the subjects who are directly fighting terrorism.

2. Territorial authority according to the tasks assigned to it:

1) is provided in the region of functioning, by safety and development of GSPS, its availability for service during the special period and in case of emergency situation, and also around conducting anti-terrorist operation;

Provides 2) in the region in the procedure established by the legislation with government communication of the President of Ukraine, the Chairman of the Verkhovna Rada of Ukraine, the Prime Minister of Ukraine, other officials of state bodies, local government bodies, bodies of military management, heads of the companies, organizations and the organizations in peace time, in the conditions of emergency state and during the special period;

3) is provided in the region by functioning, safety and development of NSKS;

4) performs construction and upgrade of NTS, provides its functioning and provision of services in zone of the responsibility;

5) is controlled within the region by accomplishment of specifications and other requirements of the legislation in the field of information security in rooms of subscribers of government communication;

6) is provided in the region in the procedure established by the legislation and within competence by activities of the subjects who are directly fighting terrorism;

Generalizes 7) and analyzes:

the condition of functioning of networks and the GSPS, NSKS and NTS complexes in the region, prepares and makes offers on their enhancement and further development;

results of implementation of the state control in the region of condition of cryptographic and technical information security, counteraction to technical investigations and fulfillment of requirements of regulatory legal acts in these spheres; prepares and provides to the Administration of Gosspetssvyaz and state bodies, local government bodies, military forming formed according to the laws of Ukraine, to the companies, organizations and the organizations of the recommendation (offer) on its improvement in the region;

information on accomplishment of necessary protective measures in the region in working hours of foreign inspection teams in the territory of Ukraine on subjects to information activities of the region, prepares and makes offers on their enhancement;

8) resolves within powers issues of ensuring communication for needs of GSPS and NSKS according to the legislation;

9) participates in work of special commissions of experts of bodies (divisions) of the Security Service of Ukraine on verification of presence of conditions for implementation of the activities connected with the state secret in state bodies, local government bodies, the military forming formed according to the laws of Ukraine at the companies, in organizations and the organizations of the region as a part of which there are bodies of special communication;

10) participates (within the powers) in the works which are carried out by Administration of Gosspetssvyaz on implementation of the state target development programs of special types of communication and information security;

11) participates in accomplishment of tasks on territorial defense, and also in the actions directed to maintenance in the region of legal regime of warlike and emergency state according to the law;

12) realizes in the region state policy in spheres of cryptographic and technical information security, protection of the state information resources and information, the requirement for which protection is established by the law, in information, communication and information and communication systems and on subjects to information activities, counteraction to technical investigations;

13) realizes in the region state policy in spheres of protection in cyberspace of the state information resources and information, the requirement for which protection is established by the law, cyberprotection of critical information infrastructure;

14) is coordinated within the region by activities of subjects of ensuring cyber security for cyberprotection;

15) participates within the powers in realization of state policy in spheres of electronic document management (regarding information security of state bodies and local government bodies), electronic identification (with use of electronic confidential services), electronic confidential services (regarding control of observance of requirements of the legislation in the field of electronic confidential services);

Coordinates 16), will organize and books audit of security of communication and technological systems of objects of critical infrastructure of the region on vulnerability;

17) is coordinated in the region by activities for creation and conducting state examination of complex systems of information security (further - KSZI) in the automated systems, one-machine single-user complexes (further - the EXPERT of the class "1"), according to requirements of regulatory legal acts and regulating documents concerning technical information security (further - TZI), and also perform the following functions:

considers and approves specifications on creation of assorted KSZI of the class "1", analyzes assorted declarations of conformity KSZI of the class "1" to requirements of regulating documents for TZI;

provides registration of these declarations;

18) is coordinated in the region by activities for creation and certification of the TZI complexes which are part of assorted KSZI of the class "1" and for separate orders of Administration of Gosspetssvyaz of organizational and administrative nature - on subjects to information activities where it is sounded language information which is the state secret, according to requirements of regulatory legal acts and regulating documents concerning TZI (is read). Also concerning the specified TZI complexes performs the following functions:

considers and approves technical tasks on creation of the TZI complexes;

considers and approves programs and techniques of certification of the TZI complexes;

considers results of certification of the TZI complexes;

provides registration of acts of certification of the TZI complexes;

19) carries out actions for permission to work for TZI for own needs (in the presence) according to the distribution of obligations determined by the decision of the chairman of Gosspetssvyaz;

Will organize 20) and provides accomplishment of actions for counteraction to technical investigations on the subjects to counteraction which are in the field of its management;

21) exercises in the territory of the region control over the implementation of specifications on designing, construction and reconstruction of especially important objects and on development of samples of the military and special equipment regarding counteraction to technical investigations;

22) is provided in the region by accomplishment of tasks on mobilization preparation and mobilization readiness of the state;

23) exercises the state control in the region for:

condition of cryptographic and technical protection of the state information resources and information, the requirement for which protection is established by the law, in state bodies, local government bodies, the military forming formed according to the laws of Ukraine at the companies, in organizations and the organizations, irrespective of pattern of ownership, on objects of government communication, and also during activities in the territory of Ukraine of foreign inspection teams according to international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine;

condition of counteraction to technical investigations in the state bodies, military forming formed according to the laws of Ukraine at the companies, in organizations and the organizations, irrespective of their subordination and pattern of ownership which have in the ownership, use or the order samples of arms, the military and special equipment, objects of defense industry complex, military facilities and other objects intended for application for the benefit of defense and safety of the state;

protection condition in cyberspace of the state information resources and information, the requirement for which protection is established by the law, cyberprotection of critical information infrastructure;

observance of requirements of the legislation in the field of electronic confidential services;

observance of safety requirements during the using, operation, export and destruction of means of cryptographic information security and the equipment of the special communication having access restriction signature stamp;

24) takes in limits of the powers part in approval of questions of placement in the territory of the region of diplomatic representations and consular establishments of foreign states;

25) exercises control of protection of the state secret in structural divisions of territorial authority, will organize record keeping;

26) participates in work of the commissions of bodies of the Security Service of Ukraine on check of condition of protection of the state mystery of subjects of regime and confidential activities as a part of which bodies of special communication function;

27) provides protection of objects, premises of territorial authority, systems, networks, complexes, means of government and special communication, key documents to means of cryptographic information security;

28) is performed in interaction with the relevant structural divisions of Administration of Gosspetssvyaz by material, personnel, financial and legal support of activities of territorial authority; will organize medical support of the military personnel of territorial authority together with the Medical center of Gosspetssvyaz;

29) provides legal and social protection of the military personnel of territorial authority and members of their families according to the legislation;

30) is provided within the powers by accomplishment of actions for labor protection and fire safety on the objects which are in the field of management of territorial authority;

31) takes within the powers measures for prevention and identification of corruption among staff of territorial authority;

32) is performed by selection of personnel, will organize work on preparation, retraining and advanced training of staff of territorial authority;

33) issues orders of organizational and administrative nature within the powers;

34) according to the decision of Administration of Gosspetssvyaz acts in the region as the customer of construction of housing and other objects of Gosspetssvyaz, takes measures for their operation, reconstruction and repair;

35) records the military personnel needing provision of housing and/or improvement of housing conditions, creates fund of office housing, takes measures for provision of housing for the military personnel of territorial authority;

Will organize 36) and keeps business and tax accounting according to the procedure, established for state-financed organizations; constitutes and represents statistical, financial, budget and tax statements according to the procedure and to the terms established by the legislation;

37) is provided by effective, productive and target use of budgetary funds;

38) will organize planned and financial work, exercises control of use of financial and material resources, provides the organization and enhancement of financial accounting;

39) is conducted by the list of the objects of state-owned property which are in its operational management and submits information concerning these objects to administration of Gosspetssvyaz;

40) provides target use, effective operation and content of the parcels of land, office and economic buildings, stationary technical means and engineering constructions, other objects, including domestic, and other property, being in operational management of territorial authority.

3. The territorial authority has the right:

1) to interact (within competence) with the state bodies, local government bodies, military forming created according to the laws of Ukraine, the companies, organizations and the organizations irrespective of pattern of ownership on the questions relating to its powers to obtain from them in accordance with the established procedure information, documents and materials necessary for accomplishment of the tasks assigned to territorial authority;

2) to involve special and general users of radio-frequency range, the company, organization and organization, irrespective of pattern of ownership in identification and elimination of the radio interferences interfering work of radio-electronic means of GSPS, NSKS and NTS;

3) to participate in meetings, scientific and scientific and practical conferences, seminars on the questions which are within the competence of Gosspetssvyaz;

To lease 4) in accordance with the established procedure within the estimate of the room, property, and also resources of electronic communication networks for ensuring needs of GSPS, NSKS and NTP in the region;

5) to involve specialists of state bodies, local government bodies, the military forming formed according to the laws of Ukraine, the companies, organizations and organizations irrespective of pattern of ownership, in coordination with their heads in consideration of the questions relating to powers of territorial authority and also in conducting joint inspection checks;

6) access in accordance with the established procedure the authorized representatives on objects (the territories, rooms, buildings, constructions and so forth) state bodies, local government bodies, the military forming formed according to the laws of Ukraine, the companies, organizations and organizations irrespective of pattern of ownership on which there are means of communication of special territorial authority on objects (the territories, rooms, buildings, constructions and so forth) concerning which state control is imposed on territorial authority;

To receive 7) free of charge from state bodies and local government bodies, the military forming formed according to the law, the companies, organizations and the organizations irrespective of pattern of ownership and their officials, and also citizens and their associations information, documents and materials necessary for accomplishment of the tasks assigned to territorial authority;

8) to use the corresponding information databases of state bodies, GSPS and other technical means in the region;

To provide 9) to physical persons or legal entities on a contract basis the services which are directly connected with ensuring accomplishment of the tasks assigned to territorial authority in the list determined by the Cabinet of Ministers of Ukraine;

10) to carry out in the region scheduled and unscheduled inspections in the procedure established by the legislation:

conditions of cryptographic and technical protection of the state information resources and information, the requirement for which protection is established by the law, in state bodies, local government bodies, the military forming formed according to the laws of Ukraine at the companies, in organizations and the organizations irrespective of pattern of ownership, during activities in the territory of Ukraine of foreign inspection teams according to international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine, without receipt of access to contents of information. In places of permanent and temporary stay of persons concerning which the state protection is performed the specified inspections are carried out in coordination with Management of the state protection of Ukraine;

observance of licensed conditions of implementation of economic activity on provision of services in the field of cryptographic and technical information security at the companies, in organizations and the organizations, and also work conditions on technical information security for own needs in state bodies, local government bodies, governing bodies of the Armed Forces of Ukraine and other military forming formed according to the laws of Ukraine, law enforcement agencies;

skilled suppliers of electronic confidential services, their isolated Items of registration of certification center on observance of requirements of the legislation in the field of electronic confidential services;

conditions of counteraction to technical investigations in the state bodies, military forming formed according to the laws of Ukraine at the companies, in organizations and the organizations irrespective of their subordination and pattern of ownership which have in the ownership, use or the order samples of arms, the military and special equipment, objects of defense industry complex, military facilities and other objects intended for application for the benefit of defense and safety of the state;

protection conditions in cyberspace of the state information resources and information, the requirement for which protection is established by the law, cyberprotection of critical information infrastructure.

Authorized representatives of territorial authority in accordance with the established procedure have the right: get acquainted with all documents and materials necessary for carrying out in the region of checks (actions of the state control), requirements to which holding are assigned to territorial authority; access to information and communication systems and receipt of information necessary for clarification of condition of security of information and communication systems;

11) to constitute protocols on administrative offenses;

12) to start in accordance with the established procedure question relatively:

conducting office investigations on clarification of the reasons and conditions of emergence of the violations revealed by results of the state control which implementation is assigned to territorial authority;

suspensions of action or cancellation: certificates on the admission to operation of means of cryptographic information security, cryptographic algorithms, means, complexes and systems of special communication which are intended for protection of the state information resources and information, the requirement for which protection is established by the law, and cryptographic algorithms; certificates of compliance of complex systems of information security in information and communication systems; declarations of conformity KSZI in information and communication systems to requirements of regulating documents for TZI and acts of certification of the TZI complexes on subjects to information activities in case of failure to provide the admission (access) or creation of obstacles for such admission (access) to authorized officers of territorial authority to holding actions of the state control of condition of TZI or in the presence of violations in the field of the information security processed in information and communication systems if it creates real threat or premises to violation of confidentiality and (or) integrity and availability of information;

the terminations of information processing on subjects to information activities or carrying out information activities with use of information communication systems in the state bodies, local government bodies, military forming formed according to the laws of Ukraine at the companies, in organizations and the organizations irrespective of the pattern of ownership which is carried out with violation of requirements of the legislation in the field of information security, the requirement for which information security is established by the law, cryptographic and/or technical information security;

suspensions of action or cancellation of special permissions to carrying out the activities connected with the state secret in case of identification of violations in the field of cryptographic and technical information security;

To perform 13) according to the procedure, stipulated by the legislation, economic activity which is directly connected with ensuring accomplishment of the tasks assigned to territorial authority, by types which list is determined by the Cabinet of Ministers of Ukraine;

14) to take a legal action in case of disputes over questions of the organization of special communication and information security, cryptographic and technical protection of the state information resources and information, the requirement for which protection is established by the law, disputes in the field of electronic confidential services, and also in case of other disputes according to the procedure, established by the law;

15) to receive and use in the procedure established by the legislation with the consent of Administration of Gosspetssvyaz the parcels of land for the purpose of placement of the office and economic buildings, stationary technical means and engineering constructions, objects of housing construction, other objects necessary for functioning of territorial authority;

To send 16) to organizations of education, institution and other organizations staff for training, retrainings and increases in professional level in the direction of office activities;

17) to play as the customer of purchase for territorial authority of goods, works and services for public funds;

18) to convene meetings, to create the commissions and working groups, to hold scientific conferences, seminars on the questions which are within the competence of territorial authority.

III. Chief of territorial authority

1. The territorial authority is headed by the chief whom it appoints to position in coordination with the Vice-Prime Minister of Ukraine - the Minister of digital transformation of Ukraine and the head of local public administration in the territory of which the specified territorial authority performs the powers, and dismisses in coordination with the Vice-Prime Minister of Ukraine - the Minister of digital transformation of Ukraine and the head of local public administration the Chairman of Gosspetssvyaz.

The territorial authority formed as interregional (which power extend to several administrative and territorial units), is headed by the chief whom it appoints to position in coordination with the Vice-Prime Minister of Ukraine - the Minister of digital transformation of Ukraine and chairmen of local public administrations in the territory of which the specified territorial authority performs the powers, and dismisses in coordination with the Vice-Prime Minister of Ukraine - the Minister of digital transformation of Ukraine and the corresponding heads of local public administrations the Chairman of Gosspetssvyaz.

2. The chief of territorial authority is subordinated to the Chairman of Gosspetssvyaz and his deputies.

3. The chief of territorial authority is the head of Public service in territorial authority.

4. The serviceman having the higher education with educational degree of the master, the corresponding qualification and service length in the specialty on executive positions in public service at least 5 years is appointed to position of the chief of territorial authority.

5. The chief of territorial authority has deputies whose regular category of positions is referred to positions of the military personnel or government employees.

The number of deputy chief of territorial authority is determined by the chairman of Gosspetssvyaz.

In case of need positions of deputy chief of territorial authority of the military personnel can be replaced by government employees according to the Procedure for substitution in Public service of special communication and information security of Ukraine of separate positions of the military personnel by government employees and other workers approved by the order of Administration of Gosspetssvyaz of May 05, 2021 No. 271, registered in the Ministry of Justice of Ukraine on May 21, 2021 for No. 672/36294.

6. Appoints deputy chief of territorial authority to positions and the Chairman of Gosspetssvyaz in coordination with the Deputy Prime Minister - the minister of Ukraine - the Minister of digital transformation of Ukraine dismisses.

7. The chief of territorial authority can be heard on board of Administration of Gosspetssvyaz.

8. The chief of territorial authority bears the personal liability for accomplishment of the tasks assigned to territorial authority.

9. The chief of territorial authority answers for:

the organization of accomplishment of actions for questions of functioning of networks and the GSPS, NSKS and NTP complexes, ensuring information security and cyberprotection, accomplishment by staff of administrative documents of Administration of Gosspetssvyaz on cryptographic and technical information security, observance of rules of the address with means of KZI, key and technical documentation to them;

ensuring protection of the state secret in territorial authority; creation in territorial authority of the conditions providing the correct use and safety of application of codes;

mobilization readiness of territorial authority, and also readiness for accomplishment of tasks on territorial defense, civil protection and participation in conducting anti-terrorist operation;

the organization of confidential and unclassified clerical work and clerical work for the organization and safety of special types of communication in territorial authority;

condition of counteraction to technical investigations in territorial authority; holding organizational and technical actions for prevention, identification and response to cyberincidents and cyber attacks and to elimination of their effects;

organization of office activities of territorial authority, observance at the same time legality and law and order, gender equality;

comprehensive providing territorial authority and effective use of the available forces and means;

the organization and accomplishment of the tasks assigned to territorial authority; implementation of measures for prevention of manifestations of corruption among staff of territorial authority;

condition, accounting, stores organization of arms, ammunition, special equipment and other means, and also effective use of forces and means to destination;

the organization of financial accounting and ensuring fixation of the facts of carrying out all economic activities in source documents, preserving the processed documents, registers and the reporting;

condition military (office, labor) disciplines, moral and psychological condition of staff of territorial authority, and also for the organization and carrying out educational work in territorial authority;

condition of fire safety in territorial authority.

10. The chief of territorial authority shall:

To perform 1):

management of office activities of territorial authority;

distribution of obligations between the deputies, determination of degree of their responsibility and degree of responsibility of chiefs of structural divisions of territorial authority, the organization of development and approval of regulations on structural divisions and job descriptions of staff of territorial authority;
