1. Bring in the order of the Minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of October 13, 2020 No. 384/Tax Code "About Approval of Rules of Informing on Activities for Implementation of Digital Mining" (it is registered in the Register of state registration of regulatory legal acts for No. 21445,) the following change:

Rules of informing on activities for implementation of digital mining, approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to committee on information security of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan;

3. To impose control of execution of this order on supervising vice-– the minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of informing on activities for implementation of digital mining

Chapter 1. General provisions

1. These rules of informing on activities for implementation of digital mining (further – Rules) are developed according to subitem 20-2) of article 7-1 of the Law of the Republic of Kazakhstan "About informatization" (further – the Law) and determine procedure for informing on activities for implementation of digital mining.

2. In these rules the following basic concepts are used:

1) information system – the organizational arranged set of the information and communication technologies, service personnel and technical documentation realizing certain technological actions by means of information exchange and intended for the solution of specific functional objectives;

2) authorized body in the field of ensuring information security (further – authorized body) – the central executive body performing management and cross-industry coordination in the field of ensuring information security;

3) the server room (data-processing center) – the room intended for placement of the server, active and passive network (telecommunication) hardware and the equipment of the structured cable systems;

4) persons - the individual entrepreneurs and (or) legal entities who are planning/performing/stopping activities for digital mining and also the individual entrepreneurs and (or) legal entities who are planning/performing/stopping rendering services to persons performing activities for digital mining for providing with complex computing infrastructure for accomplishment of computing transactions and data processing;

5) digital mining – the process of carrying out computing transactions with use of computer, energy capacities according to the set algorithms of enciphering and data processing providing confirmation of integrity of blocks of data in objects of informatization by means of blokcheyn.

Chapter 2. Procedure for informing on activities for implementation of digital mining

3. The persons planning to perform activities for digital mining, and also planning rendering services to persons performing activities for digital mining for providing with complex computing infrastructure for accomplishment of computing transactions and data processing in 30 (thirty) calendar days prior to implementation of activities inform authorized body by means of information system with contents of the following information:

1) name of legal person / SP;

2) BIN / IIN;

3) legal address of legal person / SP;

4) contact information (phone numbers, e-mail address);

5) bank details of legal person / SP;

6) necessary capacity in megawatts (MW/) on implementation of activities in the field of digital mayninga/of rendering services in providing complex computing infrastructure for accomplishment of computing transactions and data processing by persons performing digital mining;

7) quantity of the planned workplaces;

8) the planned investments (tenge);

9) the IP address (the allocated pool of IP addresses);

10) the copy of the cargo customs declaration and/or the document confirming equipment availability in the field of digital mining on the property right or other legal cause;

11) information on location of data-processing center for implementation of digital mining;

12) the document confirming residence of the Republic of Kazakhstan, person performing activities in the field of digital mining;

13) the copy of specifications on accession to power networks on implementation of activities in the field of digital mining.

The authorized body provides the answer about inclusion in the list of the organizations informing on the beginning of activities in the field of digital mining.

4. The persons performing digital mining, and also rendering services in providing with complex computing infrastructure for accomplishment of computing transactions and data processing to persons performing activities for digital mining quarterly to 10 (tenth) following month under report inform authorized body by means of information system with contents of the following information:

1) name of legal person / SP;

2) BIN / IIN;

3) legal address of legal person / SP;

4) contact information (phone numbers, e-mail address);

5) consumption for the accounting period, kW/hour (information on the consumed electric power on implementation of activities in the field of digital mining / (or) to rendering services in provision of infrastructure for digital mining);

6) the name of the used equipment for digital mining;

7) the number of the used equipment for digital mining;

8) quantity of workplaces;

9) the planned investments until the end of the current year (tenge);

10) the planned investments for the next 12 months (tenge);

11) the IP address (the allocated pool of IP addresses);

12) the copy of the cargo customs declaration and/or the document confirming equipment availability in the field of digital mining on the property right or other legal cause;

13) information on location of data-processing center for implementation of digital mining;

14) the document confirming residence of the Republic of Kazakhstan, person performing activities in the field of digital mining;

15) the copy of specifications on accession to power networks on implementation of activities in the field of digital mining.

5. The persons stopping activities for digital mining, and also rendering services in providing with complex computing infrastructure for accomplishment of computing transactions and data processing to persons performing activities for digital mining within 10 (ten) calendar days from the date of the end of activities for implementation of digital mining or to rendering services in providing with complex computing infrastructure for accomplishment of computing transactions and data processing to persons performing activities for digital mining inform on it authorized body by means of information system.

6. The authorized body after receipt of information from the individual entrepreneurs and (or) legal entities performing activities for digital mining, and also rendering services in providing with complex computing infrastructure for accomplishment of computing transactions and data processing to persons performing activities for digital mining within 10 (ten) calendar days in electronic form informs the state body performing management in the field of power industry with contents of the following information:

1) the copy of the cargo customs declaration and/or the document confirming equipment availability in the field of digital mining on the property right or other legal cause;

2) information on location of data-processing center for implementation of digital mining;

3) the document confirming residence of the Republic of Kazakhstan, person performing activities in the field of digital mining;

4) the copy of specifications on accession to power networks on implementation of activities in the field of digital mining.

6-1. The authorized body after receipt of information from persons of the computing transactions performing digital mining, and also rendering services in providing complex computing infrastructure for accomplishment and data processing to persons performing digital mining to 15 (fifteen) numbers of the second month following reporting quarter informs the state body performing management and cross-industry coordination in the financial sphere, according to form of information about payers of the payment for digital mining, of subjects to taxation, their location and of amounts of electric power approved by the order of the Deputy prime minister - the Minister of Finance of the Republic of Kazakhstan of April 13, 2022 No. 402 (it is registered in the Register of state registration of regulatory legal acts for No. 27557).
