About modification and amendments in some orders of the Minister of health and social development of the Republic of Kazakhstan and the acting minister of health care and social development of the Republic of Kazakhstan

According to subitems 6), 11), 13) of article 7 of the Law of the Republic of Kazakhstan of April 6, 2016 "About employment of the population", subitem 4-5) of article 11 of the Law of the Republic of Kazakhstan of July 22, 2011 "About population shift" and Item 5.3.1 of the State program of development of productive employment and mass entrepreneurship for 2017 - 2021 of Enbek approved by the order of the Government of the Republic of Kazakhstan of November 13, 2018 No. 746, I ORDER:

1. Approve the list of some orders of the Minister of health and social development of the Republic of Kazakhstan and the acting minister of health care and social development of the Republic of Kazakhstan to which changes and additions, according to appendix to this order are made.

2. To provide to department of employment of the population of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

The list of some orders of the Minister of health and social development of the Republic of Kazakhstan and the acting minister of health care and social development of the Republic of Kazakhstan to which changes and additions are made

1. Bring in the order of the acting minister of health care and social development of the Republic of Kazakhstan of January 15, 2016 No. 20 "About approval of Rules of inclusion in regional quota of acceptance of oralmans and immigrants" (it is registered in the Register of state registration of regulatory legal acts for No. 13334, it is published on March 10, 2016 in information system of law of Ad_let) the following changes:

in Rules of inclusion in regional quota of acceptance of the immigrants approved by the specified order:

state item 4 in the following edition:

"4. The statement for inclusion in regional quota of acceptance of immigrants (further – the application) is submitted to local executive bodies of the region of disposal by the immigrant or one of full age family members (further – immigrants) in form according to appendix 1 to these rules.

The following documents are enclosed to the application:

1) copies of identity documents of citizens of the Republic of Kazakhstan and the family members moving with it;

2) copies of the marriage certficate or annulment of marriage (in the presence);

Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of June 14, 2016 No. 515 "About approval of Rules of voluntary resettlement of persons for increase in labor force mobility" (it is registered in the Register of state registration of regulatory legal acts for No. 13921, it is published on August 17, 2016 in information system of law of Ad_let) the following change:

Rules of voluntary resettlement of the faces for increase in labor force mobility approved by the specified order to be reworded as follows according to appendix 1 to this List.

3. Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of June 14, 2016 No. 516 "About some questions of assistance of employment of the population" (it is registered in the Register of state registration of regulatory legal acts for No. 13938, it is published on July 28, 2016 in information system of law of Ad_let) the following changes and amendments:

4) Rules of the organization and financing of professional training according to appendix 4 to this order;

5) Rules of carrying out social professional orientation according to appendix 5 to this order;

state Item 3 in the following edition:

"3. Social workplaces will be organized by employers irrespective of their pattern of ownership, and also at home, at the same time employers who regularly make tax and other social assignments which have no overdue debt on the salary and the operating more than one year are allowed to participation.

The social workplace is created by the employer for employment of the unemployed with subsidizing of their salary.

For able-bodied members of large and (or) needy families, mothers of the bringing-up children with disability, also the organization of social workplaces is provided at home.";

"5. Work on social workplaces is temporary.";

state Item 9 in the following edition:

"9. The jobcenter of the population according to the approved list signs with the employer the contract for the organization and financing of social workplaces for employment of the unemployed (further - the agreement) in form, according to appendix 2 to these rules.";

"17. In case of violation by employers of the procedure for the organization and financing of social workplaces established by these rules, the relevant contract with them is subject to termination within fifteen calendar days from the date of violation identification.";

"26-1. The employer monthly in any form represents data to jobcenter of the population on payment of part of the salary with indication of subsidized part of the salary of the participant of the Enbek program.";

"27. The jobcenter of the population monthly based on the data provided by the employer transfers into the current account of the participant of the Enbek program subsidized part of the salary, proceeding from the size of the salary established by the employment contract.

28. Compensation by the unemployed employed on social workplaces is made by the employer monthly after transfer of the individual income tax and social payments according to the legislation of the Republic of Kazakhstan, except for subsidized part of the salary established by the employment contract.";

"29. In case of the termination of the employment contract the employer makes compensation payments according to the Labor code of the Republic of Kazakhstan.

30. Compensation of the participant of the Enbek program employed on social workplace in 2019 is performed according to the signed contract for the organization and financing of social workplaces in 2019.";

in appendix 2 to Rules of the organization and financing of social workplaces:

3, of 4, 5 and 6 to state Items in the following edition:

"3. The customer has the right:

1) to advise the Contractor concerning creation and financing of social workplaces;

2) as required to accept within year additional requests for the organization of social workplaces from the Contractor;

3) to demand from the Contractor of timely and proper execution of the contract for the organization and financing of social workplaces for employment of the unemployed.

4. The contractor has the right:

1) to accept or refuse employment of persons directed by jobcenter of the population to social workplaces;

2) to submit the Customer within year additional applications for the organization of social workplaces;

3) to demand from the Customer of timely and proper execution of the contract for the organization and financing of social workplaces for employment of the unemployed.

5. The customer shall:

1) to direct the unemployed from their consent to the Contractor in quantity ____________ the person; (in cursive script)

2) based on the data provided by the Contractor timely and in full to list subsidized part of the salary to persons employed on social workplaces;

3) to reflect in the individual card of employment of the data on employment of the unemployed on social workplace and for permanent job after completion (before the termination of term) participations in social workplaces;

4) is conducted by monitoring of availability of obligatory pension assignments at participants of the Enbek program.

6. The contractor shall:

1) to provide the following social workplaces for employment of the unemployed:

2) to sign with the unemployed employment contracts according to the Labor code;

4) timely and in full to make compensation of the participant of the Enbek program;

5) to make, in case of need, payment of additional allowances to participants of social workplaces at the expense of own means;

6) at the request of jobcenter of the population to provide copies of the documents confirming transfer of obligatory pension assignments to participants of social workplaces;

To carry out 7) with each participant of social workplaces personnel safety notification;

8) to provide, if necessary, participants of social workplaces with overalls, tools, stock;

9) to provide the corresponding working conditions according to the Labor code;

10) to indemnify loss, in case of damnification to health during execution of labor obligations by participants of social workplaces according to the Labor code;

11) to bear responsibility for accuracy of the information, provided to the Customer about participants of social workplaces;

To represent 12) to the Customer in five working days prior to the termination of month under report of the information about participants of social workplaces, in form according to the Appendix to this Agreement.";

in the Rules of the organization and financing of youth practice approved by the specified order:

3) of item 4 to state the subitem in the following edition:

"3) work is temporary and for its organization permanent workplaces and vacancies are not used. Duration of youth practice constitutes no more than six months.";

in the Rules of carrying out social professional orientation approved by the specified order:

"19) professional informing – provision of information on situation in the labor market, data of the National database, employment opportunity on the available specialty to undergo retraining, advanced training according to professional qualification of the participant or receipt of assistance in entrepreneurial initiative;";
