About modification of the Order of the Government of the Russian Federation of February 26, 2021 No. 270

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to the order of the Government of the Russian Federation of February 26, 2021 No. 270 "About some questions of control of turnover of precious metals, gemstones and products from them at all stages of this turnover and introduction of amendments to some acts of the Government of the Russian Federation" (The Russian Federation Code, 2021, No. 10, Art. 1608; No. 36, Art. 6398).

2. This resolution becomes effective since September 1, 2022, except for subitems "b" and "v" of Item 3, of Item 4, of the subitem "b" of Item 5, of the subitem "an" of Item 6 and paragraphs two, the eighth - the eleventh, twenty first, twenty second subitem "a", subitems "b", "v", "e", paragraphs two - the fifth, ninth, tenth subitem "z", subitems "i", "k", paragraphs of the fourth - the tenth subitem "l", paragraphs of the first - the fifth subitem "m" and the subitem "p" of Item of 8 changes approved by this resolution, which are becoming effective from the date of its official publication.

Changes which are made to the Order of the Government of the Russian Federation of February 26, 2021 No. 270

1. To declare paragraph two of Item 1 invalid.

2. In Item 2:

a) to add the subitem "g" after the words "legal entities" with words "(in addition to this Item specified in the subitem "v")";

b) add with subitems "d" and "e" of the following content:

"e) Central Bank of the Russian Federation;

e) credit institutions.".

3. In Item 10:

a) the paragraph one after the words "Legal entities" to add with words "(except for the Central bank of the Russian Federation and credit institutions)";

b) in the paragraph the second shall be replaced with words the words "and individual entrepreneurs, except for the organizations having the right to perform refining of precious metals, till April 1, 2022." "(except for the organizations having the right to perform refining of precious metals, the Central bank of the Russian Federation and credit institutions) and individual entrepreneurs, till September 1, 2022", to replace the word of "March" with the word of "August";

c) in paragraph three to replace the word of "June" with the word of "September", to replace the word of "May" with the word of "August";

d) after the paragraph of third to add with paragraphs of the following content:

"Since September 1, 2022 credit institutions voluntarily enter data (information) on remaining balance of precious metals in GIIS DMDK.

Credit institutions till March 1, 2023 enter in GIIS DMDK data (information) on remaining balance of precious metals as of February 28, 2023".

4. Add Item 11 with the paragraph of the following content:

"the jewelry from precious metals and gemstones imported on the territory of the Russian Federation from the states which are not entering into the Eurasian Economic Union shall have the unique identification number assigned to each such product which is applied on the label attached to product which is drawn up according to Rules after branding in Federal assay chamber, and also the digital photo of individual jewel (in case of its voluntary representation in GIIS DMDK).".

5. In Item 12:

a) after paragraph two to add with the paragraph of the following content:

"since March 1, 2023 credit institutions provide information on receipt and realization (shipment) of ingots of the affined precious metals to GIIS DMDK;";

b) third to add the paragraph with words ", and also marking of jewelry from the precious metals and gemstones imported on the territory of the Russian Federation from the states which are not entering into the Eurasian Economic Union, according to the procedure, established by Rules is performed.".

6. In Item 13:

a) third to add the paragraph with the words "based on data (information) and the documents submitted by legal entities and individual entrepreneurs to GIIS DMDK, except as specified, if such data (information) contain the state secret or in case of technical failures in work of GIIS DMDK and acceptance with respect thereto Federal assay chamber, federal state institution "Public Institution on Forming of the State Fund of Precious Metals and Gemstones of the Russian Federation, Storage, Leave and Use of Precious Metals and Gemstones (Gokhran of Russia) under the Ministry of Finance of the Russian Federation" of the decision on submission of necessary paper documents";

b) add with paragraphs of the following content:

"Central Bank of the Russian Federation and credit institutions submit and receive necessary documents for passing of the procedure of the state control when importing to the Russian Federation from the states which are not entering into the Eurasian Economic Union and export from the Russian Federation to the states which are not entering into the Eurasian Economic Union, the precious metals, gemstones and primary goods containing precious metals in GIIS DMDK or on paper till February 28, 2023.

Since January 1, 2023 forming and accounting of documents of the state control when importing by the Central bank of the Russian Federation and credit institutions to the Russian Federation from the states which are not entering into the Eurasian Economic Union and export by the Central bank of the Russian Federation and credit institutions from the Russian Federation to the states which are not entering into the Eurasian Economic Union, ingots of the affined precious metals are performed in GIIS DMDK.".

7. Add Item 14 with the paragraph of the following content:

"The requirement specified in paragraph one of this Item does not extend to credit institutions.".

8. In Rules of functioning of the state integrated information system in the field of control of turnover of precious metals, gemstones and products from them at all stages of this turnover approved by the specified resolution:

a) in Item 2:

the fifth after the words "acceptance as a deposit" to add the paragraph with the words "under contracts of pledge with transfer of subject of pledge to the pawnbroker (except as specified if such pawnbroker or the pledger is the Central bank of the Russian Federation, credit institution)", after the words "storage of precious metals and gemstones" to add with words (except as specified storages of values in the Central bank of the Russian Federation, credit institution)", to add with words", and also cases of acceptance of standard and measuring ingots of the affined precious metals for transfer of precious metals on bank accounts (deposits) in precious metals, into earlier opened depersonalized metal accounts of physical persons and legal entities, cases of issue of standard and measuring ingots of the affined precious metals with write-off of precious metals from bank accounts (deposits) in precious metals, from earlier opened depersonalized metal accounts of physical persons and legal entities".

"Jewelry transportation of products between divisions of the Central bank of the Russian Federation, between divisions of credit institution, including with involvement of the third parties is not considered turnover of products;";

to credit institutions in addition to the bases provided by the paragraph the fourth this Item, also based on the request by means of electronic exchange in case of input in turnover of standard and measuring ingots of the affined precious metals acquired at the Central bank of the Russian Federation, and also at physical persons for identification in GIIS DMDK without drawing unique identification numbers and two-dimensional bar codes on quality certificates (passports, certificates);
