About modification of the Regulations on structure of Sections of the project documentation and requirements to their content and recognition voided separate provisions of some acts of the Government of the Russian Federation

The government of the Russian Federation decides:

1. 2. Determine that the changes approved by this resolution are not applied by preparation of the project documentation if the task of the builder or technical customer for the designing providing preparation of this project documentation is approved till September 1, 2022.

3. Recognize invalid separate provisions of acts of the Government of the Russian Federation according to the list according to appendix.

4. This resolution becomes effective since September 1, 2022.

Changes which are made to Regulations on structure of Sections of the project documentation and requirements to their content

1. State Item 1 in the following edition:

"1. This Provision establishes structure of Sections of the project documentation which is subject to examination according to article 49 of the Town-planning code of the Russian Federation, and the requirement to contents of Sections of such project documentation for construction, reconstruction, capital repairs of different types of capital construction projects (including linear objects), including structure of Sections of the project documentation and requirement to contents of Sections of such project documentation on separate stages of construction, reconstruction of capital construction projects.".

2. State Item 3 in the following edition:

"3. The project documentation consists of the text and graphical parts containing materials in text and graphical forms and (or) in the form of information model.

Text part contains data concerning capital construction project, the description of the made technical and other solutions, including the parameter values and other project characteristics of buildings, structures and constructions aimed at providing accomplishment of the established requirements, explanations, references to the regulating and (or) technical documents and (or) basic data for designing (including results of engineering researches) used by preparation of the project documentation and the results of calculations proving the made technical and other solutions.

Graphical part displays the made technical and other solutions and is carried out in the form of drawings, schemes, plans and other documents in graphical form.

Preparation of the project documentation shall be performed in accordance with the legislation of the Russian Federation about the state secret.

The technical and other solutions accepted in the project documentation shall be compatible with each other, that is provide technological capability of their joint realization in case of construction, reconstruction, capital repairs, and also possibility of operation of capital construction project taking into account the requirements established by the legislation of the Russian Federation.

The decisions and actions ensuring industrial safety on hazardous production facilities made in the project documentation shall correspond to the legislation of the Russian Federation on industrial safety of hazardous production facilities.".

3. Add with Items 3 (1) - 3(4) following contents:

"3(1). The structure of the project documentation for construction of facilities of capital construction of production and non-productive appointment, and also the project documentation prepared concerning separate stages of construction of facilities of capital construction of production and non-productive appointment without fail joins the following Sections:

a) Section 1 "Explanatory note";

b) Section 2 "Scheme of the Planning Organization of the Parcel of Land";

c) Section 3 "Space-planning and Architectural Concepts";

d) Section 4 "Constructive Decisions";

e) Section 5 "Data on the Engineering Equipment, on Networks and Systems of Engineering Facilities";

e) the Section 6 "Technology solutions" (for capital construction projects of non-productive appointment it is developed in case of availability of the requirement about its development in design assignment);

g) the Section 7 "Project of the Organization of Construction" containing including the project of the organization of works on demolition of capital construction projects, their parts (in need of demolition of capital construction projects, their parts for construction, reconstruction of other capital construction projects);

h) Section 8 "Actions for Environmental Protection";

i) Section 9 "Actions for Ensuring Fire Safety";

j) Section 10 "Requirements to Ensuring Safe Operation of Capital Construction Projects";

k) Section 11 "Actions for Ensuring Access of Disabled People to Capital Construction Project";

l) the Section 12 "The Estimate on Construction, Reconstruction, Capital Repairs, Asset Demolition of Capital Construction" (it is developed in the cases specified in Item 3 (4) this provision);

m) Section 13 "Other Documentation in the Cases Provided by Legislative and Other Regulatory Legal Acts of the Russian Federation".

3(2). The structure of the project documentation for construction of linear objects or on separate stages of construction of linear objects without fail joins the following Sections:

a) Section 1 "Explanatory note";

b) the Section 2 "Project of Strip of Branch" (it is developed according to the site planning of the territory, except as specified, in case of which the construction of linear object does not require preparation of documentation on the layout of the territory);

c) Section 3 "Technology and constructive solutions of linear object. Artificial constructions";

d) Section 4 "Buildings, Structures and Constructions Entering Infrastructure of Linear Object";

e) the Section 5 "Project of the Organization of Construction" containing including the project of the organization of works on demolition of capital construction projects, their parts (in need of such demolition of capital construction projects, their parts for construction, reconstruction of other capital construction projects);

e) Section 6 "Actions for Environmental Protection";

g) Section 7 "Actions for Ensuring Fire Safety";

h) Section 8 "Requirements to Ensuring Safe Operation of Linear Object";

i) the Section 9 "The Estimate on Construction, Reconstruction, Capital Repairs, Asset Demolition of Capital Construction" (it is developed in the cases specified in Item 3 (4) this provision);

j) Section 10 "Other Documentation in the Cases Provided by Legislative and Other Regulatory Legal Acts of the Russian Federation".

3(3). The structure of Sections of the project documentation for reconstruction, capital repairs of capital construction projects (including linear objects) is determined by the customer according to Items 3 (1) and 3(2) this provision depending on the work content who are carried out in case of reconstruction, capital repairs and also taking into account requirements of Item 3 (4) this provision and it is specified in design assignment.

3(4). The structure of Sections of the project documentation for construction, reconstruction, capital repairs, demolition of capital construction projects (including linear objects) shall include the estimate on construction (construction stage), reconstruction, capital repairs, asset demolition of capital construction in cases if construction, reconstruction, demolition are financed with attraction of financial resources of budgets of budget system of the Russian Federation, means of the legal entities specified regarding the 2nd article 8.3 of the Town-planning code of the Russian Federation, and capital repairs are financed with attraction of financial resources of budgets of budget system of the Russian Federation, means of persons specified regarding 1 article 8.3 of the Town-planning code of the Russian Federation.".

4. "Process of construction" to add item 4 after words with words ", reconstruction, capital repairs".

5. State Item 5 in the following edition:

"5. Sections of the project documentation are developed in volume of the materials containing the architectural, functional and technological, constructive, technical concepts and (or) actions aimed at ensuring compliance:

a) requirements of technical regulations, including requirements of mechanical, fire and other safety, requirements of energy efficiency, requirements of equipment of buildings, structures, constructions metering devices of the used energy resources to buildings, structures and constructions (including to the networks and systems of engineering facilities which are their part), requirements to ensuring access of disabled people to capital construction project (in case of preparation of the project documentation in relation to health care facilities, educations, cultures, rest, sport and to other buildings for social, cultural and household purposes, objects of transport, trade, public catering, subjects to business, administrative, financial, religious assignment, objects of housing stock);

b) sanitary and epidemiologic requirements, requirements in the field of environmental protection, requirements to safe use of atomic energy, requirements of industrial safety, requirements to ensuring reliability and safety of electric utility systems and power generation facilities, requirements of anti-terrorist security of objects, requirements of the legislation of the Russian Federation about protection of objects of cultural heritage (in case of preparation of the project documentation for work on preserving objects of cultural heritage in case of which constructive and other characteristics of reliability and safety of such objects are mentioned);

c) requirements to design processes, construction, installation, adjustment, operation of buildings, structures and constructions;

d) requirements of specifications of connection (technological accession) of capital construction projects to networks electro-, gazo-, warm, water supply and water disposal, to communication networks (further - networks of engineering facilities);

e) tasks of the builder or technical customer for designing.".

6. State Item 7 in the following edition:

"7. The project documentation other Sections and materials which availability according to this Provision is not obligatory, including the Sections containing the estimate on construction or reconstruction of the capital construction projects financed without attraction of financial resources of the relevant budgets of budget system of the Russian Federation, means of the legal entities specified regarding the 2nd article 8.3 of the Town-planning code of the Russian Federation and other Sections can be included. Need of preparation of such Sections and materials of the project documentation is determined in design assignment.".

7. Declare Item 9 invalid.

8. State Item 10 in the following edition:

"10. The Section 1 "Explanatory note" contains:

a) details of one of the following documents based on which the decision on preparation of the project documentation is made:

the regulatory legal act, the legal act and decision specified in subitems of l (1) - l (5) Item 13 of the Regulations on the organization and conducting state examination of the project documentation and results of engineering researches approved by the order of the Government of the Russian Federation of March 5, 2007 No. 145 "About procedure for the organization and conducting state examination of the project documentation and results of engineering researches";

decision of the builder;

b) basic data and conditions for preparation of the project documentation on capital construction project. In the explanatory note details of the following documents are specified:

design assignment - in case of preparation of the project documentation based on the agreement;

reporting documentation on results of engineering researches;

acts (decisions) of the owner of the building (structure, construction) containing conditions of reconstruction, capital repairs or asset demolition of capital construction or its part (if necessary);

the development plan for a land plot issued in accordance with the established procedure, the capital construction project intended for placement;

connection specifications (technological accession) of capital construction project to networks of engineering facilities, stipulated in Article 52.1 Town-planning codes of the Russian Federation (further - specifications) if functioning of designed project of capital construction cannot be provided without connection (technological accession) of such object to networks of engineering facilities;

documents on approval of departures from provisions of specifications;

permission to variation from extreme parameters of the permitted construction, reconstruction of capital construction projects;

acts (decisions) of the owner of the building (structure, construction) about removal from operation and liquidation of capital construction project - in case of need demolition;

other initial and allowing documents established by legislative and other regulatory legal acts of the Russian Federation, including technical and town-planning regulations;

the solution of federal executive body, executive body of the subject of the Russian Federation or local government body on recognition of the apartment house emergency and subject to demolition - in need of demolition of the apartment house;

reasons for safety of hazardous production facility in the cases provided by part 4 of article 3 of the Federal law "About Industrial Safety of Hazardous Production Facilities" and the positive experimental testimony of industrial safety of such reasons entered in the register of experimental testimonies of industrial safety;

c) data on the need of capital construction project for fuel, gas, water and electrical energy;

d) data on design capacity of capital construction project, including structure and the characteristic of production, the product range (works, services), - for subjects to production appointment;

e) data on the needs of production for raw material resources and sources of their receipt, the need of production for water, fuel and energy resources - for subjects to production appointment;

e) data on complex use of raw materials, secondary energy resources, production wastes - for subjects to production appointment;

g) data on use of renewable energy resources and secondary energy resources;

h) data on the parcels of land withdrawn for the state or municipal needs on the parcels of land concerning which the servitude is established the public servitude and (or) the lease agreement (subleases) is signed, - in case of withdrawal of the parcel of land for the state or municipal needs, establishment of the servitude, the public servitude, the conclusion of the lease agreement (sublease);

i) data on category of lands on which it is planned to place the capital construction project (is placed);

j) data on the size of the means which are required for indemnification to owners of the parcels of land and (or) for introduction as the rent, payment for the servitude, public servitude and (or) for the redemption of the parcels of land - in the cases established by the legislation of the Russian Federation;

k) data on the inventions worked in the project and on results of the conducted patent researches;

l) technical and economic indicators of designed projects of capital construction, including building area, total area, total structural volume (including underground part), the number of floors (including underground) and extent (for linear objects);

m) data on availability of the developed and approved special specifications - in case of need developments of special specifications;

o) data on the number of workers on capital construction project and their vocational structure, number of workplaces and other data established by design assignment and characterizing capital construction project - for subjects to non-productive appointment (except residential buildings);

o) data on computer programs which were used in case of accomplishment of calculations of structural elements of buildings, structures and constructions;

p) reasons for possibility of implementation of construction, reconstruction of capital construction project on stages of construction, reconstruction with allocation of these stages (if necessary);

c) data on the expected costs connected with demolition of buildings, structures and constructions, resettlement of people, transfer of networks of engineering facilities (if necessary) - for the capital construction projects financed with attraction of financial resources of the relevant budgets of budget system of the Russian Federation, means of the legal entities specified regarding the 2nd article 8.3 of the Town-planning code of the Russian Federation;

r) the identification signs of capital construction project provided by the Federal Law "The Technical Regulation about Safety of Buildings and Constructions";

s) the list of the documents on standardization used fully or partially on voluntary basis for observance of requirements of technical regulations (from among the documents on standardization included in lists of documents in the field of standardization as a result of which application on voluntary basis observance of requirements of technical regulations is provided);

t) assurance of the project organization performing preparation of the project documentation that the project documentation is prepared according to the requirements specified in Item 5 of this provision, the development plan for a land plot (in case of preparation of the project documentation concerning linear object - documentation on the layout of the territory) the design assignment, town-planning regulations, technical regulations establishing including requirements to ensuring safe operation of buildings, structures, constructions and safe use of the territories adjoining to them, and also with observance of specifications;

x) data on the Sections and Items of the project documentation containing decisions and actions for ensuring compliance:

energy efficiency and equipment of buildings, structures, constructions metering devices of the used energy resources;

industrial safety - for hazardous production facilities;
