About carrying out by legal entities – residents of the transactions connected with export, import
Based on Item 16 of the Presidential decree of the Republic of Belarus of March 14, 2022 No. 93 "About additional measures for ensuring stable functioning of economy", No. 226-Z "About currency control and currency exchange control" the Council of Ministers of the Republic of Belarus and National Bank of the Republic of Belarus DECIDE parts two of article 39 of the Bank code of the Republic of Belarus, subitem 2.9 of Item 2 of article 6 of the Law of the Republic of Belarus of July 22, 2003:
1.1. legal entities – residents under the currency agreements signed with legal entities – nonresidents, individual entrepreneurs – the nonresidents having the right to receive in the terms established by the currency agreement, cash foreign currency (US dollars, euro, the Chinese yuans) from legal entities – nonresidents, individual entrepreneurs – nonresidents when carrying out the transactions connected with export, import;
1.1-1. legal entities - residents, being the insurance companies having the right to receive cash foreign currency (US dollars, euro, the Chinese yuans) from legal entities - nonresidents, individual entrepreneurs - nonresidents in case of realization of the right to claim of the insurer (beneficiary) against person responsible for the damages paid as a result of insurance according to insurance contracts (joint insurance) of export risks which passed to these organizations including with support of the state;
1.2. the cash foreign currency received by the legal entity – the resident according to subitem 1.1 of this Item:outside the Republic of Belarus, is subject to transfer into the account of this legal entity – the resident, opened in bank of the Republic of Belarus, before the expiration of the repatriation term determined by it;
