About change of presidential decrees of the Republic of Belarus

For the purpose of enhancement of regulation of the relations in the field of certification of scientists of the top skills I decide:

1. Make changes to presidential decrees of the Republic of Belarus (appendix).

2. Determine that consideration of questions of award of academic degrees and assignment of academic statuses to persons who submitted till September 1, 2022 applications for examination of their theses in councils on protection of theses or about assignment of academic statuses by it is performed according to the legislation existing on the date of submission of such statements.

3. To provide to the highest certifying commission together with Council of Ministers of the Republic of Belarus in three-months time reduction of acts of the legislation in compliance with this Decree and to take other measures for its realization.

4. This Decree becomes effective in the following procedure:

Item 3, this Item and Item 3 appendices – after official publication of this Decree;

other provisions of this Decree – since September 1, 2022.

The list of the changes made to presidential decrees of the Republic of Belarus

1. In the Presidential decree of the Republic of Belarus of November 17, 2004 No. 560 "About approval of the Regulations on award of academic degrees and assignment of academic statuses in the Republic of Belarus":

to state the name of the Decree in the following edition:

"About approval of the Regulations on award of academic degrees and assignment of academic statuses";

state Item 1 in the following edition:

"1. Approve Regulations on award of academic degrees and assignment of academic statuses it (is applied).";

To be reworded as follows the regulations on award of academic degrees and assignment of academic statuses in the Republic of Belarus approved by the Decree it (is applied).

2. In the Presidential decree of the Republic of Belarus of December 16, 2013 No. 560 "About some questions of the Highest certifying commission and modification and amendments in separate presidential decrees of the Republic of Belarus":

to state the name of the Decree in the following edition:

"About the Highest certifying commission";

state Item 1 in the following edition:

"1. Approve Regulations on the Highest certifying commission it (is applied).";

To be reworded as follows the regulations on the Highest certifying commission of the Republic of Belarus approved by the Decree it (is applied).

3. In the Presidential decree of the Republic of Belarus of September 11, 2014 No. 447 "About board and structure of Presidium of the Highest certifying commission of the Republic of Belarus":

to exclude from the name of the Decree of the word "Republic of Belarus";

include in structure of board of the Highest certifying commission approved by the Decree, A. V. Konoyko and A. A. Smeyan, having excluded from it K. V. Dobrego, A. S. Senko and A. G. Shumilin;

to be reworded as follows the structure of Presidium of the Highest certifying commission approved by the Decree it (is applied).

Regulations on award of academic degrees and assignment of academic statuses

Chapter 1. General provisions

1. This Provision establishes the legal basis and procedure for award of academic degrees and assignment of academic statuses, recognitions of foreign documents on award of academic degrees and assignment of academic statuses, deprivations (recovery) of academic degrees and academic statuses, and also requirements imposed to qualification scientific works (theses) on competition of academic degrees of the candidate and doctor of science (further – theses) and to job seekers of academic degrees and academic statuses.

2. State regulation in the field of certification scientific and scientific and pedagogical rabotnikov1 the top skills is performed by the President of the Republic of Belarus and the Highest certifying commission (further – VAK).

Intervention of state bodies, other organizations, citizens, including officials, in activities of VAK for the questions connected with award of academic degrees and assignment of academic statuses, recognition of foreign documents on award of academic degrees and assignment of academic statuses, deprivation (recovery) of academic degrees and academic statuses is not allowed.

the scientist is understood as the physical person having necessary qualification and who is professionally engaged in scientific activities according to the employment contract;

the scientific and pedagogical worker is understood as the physical person having necessary qualification and who is professionally engaged in scientific and pedagogical activities according to the employment or civil contract in the scientific organizations, institutions of higher education, organizations of education and the organizations realizing educational programs of the scientific oriented education (further – organization of the scientific oriented education), or in organizations of additional education of adults, except for institute of control of knowledge and the center of preparation, advanced training and retraining of personnel (further – organization of additional education).

3. Academic degrees of the candidate and doctor of science are awarded on branch of science according to the nomenclature of professions of scientists of the Republic of Belarus.

Academic statuses of the associate professor and professor are appropriated in the specialty according to the list of specialties on which academic statuses in the Republic of Belarus are given.

The nomenclature of professions of scientists of the Republic of Belarus is established by VAK. Passports of these specialties and the list of specialties according to which academic statuses in the Republic of Belarus are given affirm VAK.

4. The academic degree of the candidate of science is awarded by council on protection of theses based on defense of a thesis. The decision of this council taking into account the conclusion of the relevant advisory council of VAK (further – advisory council) affirms Presidium of VAK. The decision on award of academic degree of the candidate of science approved by Presidium of VAK becomes effective from the date of its acceptance by council on protection of theses.

5. The academic degree of the doctor of science is awarded by Presidium of VAK based on the petition of council on protection of theses and taking into account the conclusion of the relevant advisory council by results of examination of the thesis. The decision on award of academic degree of the doctor of science becomes effective from the date of acceptance of resolution VAK by Presidium on the matter.

6. The thesis passes the following stages of examination:

preliminary expert examination of the thesis in organization of the scientific oriented education in the place of accomplishment of the thesis or in the VAK direction in other organization of the scientific oriented education;

examination of the thesis in council on protection of theses (primary examination, examination by official opponents and the opposing organization, protection in council on protection of theses);

final examination of the thesis in advisory council and Presidium of VAK.

7. The foreign citizens and persons without citizenship who are constantly living outside the Republic of Belarus, temporarily staying or temporarily living in the Republic of Belarus (further, if is not determined other, – the foreigners who are constantly not living in the Republic of Belarus) having the right to carry out and defend dissertations in foreign language or in one of state languages of the Republic of Belarus. Theses of the foreigners who are constantly not living in the Republic of Belarus are accepted to protection according to the procedure, established by this Provision. At the same time the foreigners who are constantly not living in the Republic of Belarus:

the executed theses abroad having the right to protect them on the basis of the agreements signed by them with the organization of the scientific oriented education determined by VAK under which council on protection of theses is effective;

carry out and defend dissertations on the basis of international treaties of the Republic of Belarus, agreements signed between the called persons – job seekers of academic degree, organization of the scientific oriented education and the organization of foreign state (the international organization, the foreign citizen).

8. Preparation, acceptance for protection and protection of theses, preparation and consideration of other materials (including in case of assignment of academic statuses) containing the data constituting the state secrets or office information of limited distribution and also consideration of such materials by advisory council and Presidium of VAK is performed according to the legislation on the state secrets and office information of limited distribution.

9. Academic statuses of the associate professor and professor are appropriated by Presidium of VAK according to the petition of the academic council (council) of the scientific organization, institution of higher education, organization of the scientific oriented education or organization of additional education.

The decision on assignment of academic status of the associate professor or professor becomes effective from the date of acceptance of resolution VAK by Presidium on the matter.

The Republic of Belarus appropriated before entry into force of the Law of October 21, 1996 "About scientific activities" ranks of the senior research associate is equated No. 708-XIII to the associate professor's rank.

10. Recognition of foreign documents on award of academic degrees and assignment of academic statuses is performed by VAK by means of procedures of recognition by their corresponding (equivalent) – nostrifications or recertifications of their owners if other is not established by the international treaty, and also without holding procedures of nostrification or recertification in the case provided in part two of this Item.

Are recognized without holding procedures of nostrification or recertification and diplomas of the candidate of science, doctor of science, doctor of philosophy are the certificate on the top scientific skills (Doctor of Philosophy (Ph.D) and certificates of the associate professor, professors of the state sample issued by certification bodies of the former USSR, and also the Russian Federation before entry into force of the Agreement between the Government of the Republic of Belarus and the Government of the Russian Federation about mutual recognition and equivalence of education documents, academic degrees and ranks of February 27, 1996.

11. Approval of decisions of councils on protection of theses on award of academic degree of the candidate of science, and also decision making about award of academic degree of the doctor of science, assignment of academic statuses of the associate professor and professor, deprivation (recovery) of academic degrees and ranks, recognition of foreign documents on award of academic degrees and assignment of academic statuses, deprivation (recovery) of their recognition is performed by Presidium of VAK in the form of the resolution by open or secret vote according to the procedure, provided by its regulations. In case of equality of votes determining is considered the opinion of the chairman of Presidium of VAK.

12. In the terms of consideration of theses and certification cases of job seekers of academic degrees, certification cases of job seekers of academic statuses established by this Provision, conducting examinations of materials on the matters, considerations of questions of recognition of foreign documents on award of academic degrees and assignment of academic statuses, and also considerations of appeals do not join 2 months (July and August).

In the presence of reasonable excuses, including stay of the job seeker of academic degree or academic status as a part of Armed Forces of the Republic of Belarus, other troops or military forming on compulsory military service, passings of alternative service, attraction him for accomplishment of other state obligation, stay on long official journey or in condition of serious illness or helpless condition, VAK are stopped by current of the terms provided in this Provision. After 3 years from the moment of suspension of the terms provided in this Provision, the materials provided to VAK are subject to return to their addressees.
