About approval of Changes in some regulatory legal acts concerning state registration of acts of civil status

According to Items 3, 10 Regulations on the Ministry of Justice of Ukraine, the Cabinet of Ministers of Ukraine approved by the resolution of July 2, 2014 No. 228, for the purpose of creating favorable conditions directed to simplification of access for citizens to administrative services in the field of state registration of acts of civil status, order:

1. Approve Changes in some regulatory legal acts concerning state registration of acts of civil status which are attached.

2. Determine that before introduction of information exchange between the Unified state register of judgments and the State register of acts of civil status of citizens according to the procedure, established by Public judicial administration of Ukraine and the Ministry of Justice of Ukraine, state registration of acts of civil status of citizens, modification of assembly records of civil status, their recovery and cancellation according to the address of the applicant are passed based on served the applicant the judgments which by means of the official web portal of judicial authority of Ukraine with use of data of the Unified state register of judgments is checked for availability of such decision in the corresponding register electronically, its compliance according to documentary information and details.

In case of lack of the judgment in the Unified state register of judgments the body of state registration of acts of civil status requests the copy of such judgment certified in accordance with the established procedure from the relevant court.

3. To the administrator of the State register of acts of civil status of citizens to take the adequate measures necessary for implementation of this order.

4. To department of private law (Ferens E.) submit this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

5. This order becomes effective in five days from the date of its official publication.

6. To impose control of execution of this order on the First Deputy minister Gorovts E.

Changes in some regulatory legal acts concerning state registration of acts of civil status

1. In the Standard regulations on departments of state registration of acts of civil status of interregional managements of the Ministry of Justice of Ukraine approved by the order of the Ministry of Justice of Ukraine of April 11, 2016 No. 1079/5, registered in the Ministry of Justice of Ukraine on April 12, 2016 for No. 536/28666 (further - the Standard provision):

1) in the paragraph the second Item 1 of the Section I of the word "District, District in the Cities, City (the Cities of Regional Value), Gorrayonny, Interdistrict Departments" to replace with the word "Departments";

The subitem 10 of Item 6 of the Section III to state 2) in the following edition:

"10) promotes increase in level of professional competence of employees of department;

will organize in accordance with the established procedure advanced training of officials of executive bodies of the village, settlement and city councils registering acts of civil status;";

Shall be replaced with words 3) in the text of the Standard provision of the word of "executive committees" in all cases "executive bodies" in the corresponding cases and" (except the cities of regional value)" to exclude words.

2. In Rules of state registration of the acts of civil status in Ukraine approved by the order of the Ministry of Justice of Ukraine of October 18, 2000 No. 52/5, registered in the Ministry of Justice of Ukraine on October 18, 2000 for No. 719/4940 (in edition of the order of the Ministry of Justice of Ukraine of December 24, 2010 No. 3307/5) (further - Rules):

1) in the Section I:

in the paragraph the second Item 1 of the word "district, district in the cities, city (the cities of regional value), gorrayonny, interdistrict" to exclude and after the words "Ministries of Justice of Ukraine" to add with words "(further - departments of state registration of acts of civil status)";

in paragraph one of Item 3 of the word "District, District in the Cities, City (the Cities of Regional Value), Gorrayonny, Interdistrict Departments of State Registration of Acts of Civil Status of Interregional Managements of the Ministry of Justice of Ukraine" shall be replaced with words "Departments of state registration of acts of civil status";

to exclude the paragraph of the eighth of Item 9.

With respect thereto the ninth - the twelfth to consider paragraphs respectively paragraphs the eighth - the eleventh;

2) in Chapter II:

in Chapter 1:

in the paragraph the second Item 1 of the word "district, district in the city, city (the cities of regional value), district, interdistrict department of state registration of acts of civil status of interregional management of the Ministry of Justice of Ukraine" shall be replaced with words "department of state registration of acts of civil status";

in Item 3:

the paragraph one after the words "the application, documents are filed" to add with the words "or in the case provided by paragraphs the fifth, seventh this Item data on documents are specified in the statement";

after the paragraph of the fourth to add with new paragraphs the fifth - the ninth the following content:

"If the basis for state registration of acts of civil status is the judgment or if certain judgment is necessary for state registration of other acts of civil status, state registration of acts of civil status according to the address of the applicant is carried out only based on the judgment copy electronically received as a result of information exchange between the Unified state register of judgments and the State register of acts of civil status of citizens which is performed by information and communication means electronically according to the procedure, established by Public judicial administration of Ukraine together with the Ministry of Justice of Ukraine.

In case of receipt of the services provided by the Procedure for provision of the complex service "emalyatko" approved by the resolution of the Cabinet of Ministers of Ukraine of July 10, 2019 No. 691 (further - the complex service "emalyatko"), the judgment copy electronically arrives together with the created statement by means of software of the Single state web portal of electronic services.
