About approval of Changes in Regulations on procedure for issue to legal entities of the license for provision to banks of services in collection

According to Articles 7, of 15, 33 and 56 Laws of Ukraine "About the National Bank of Ukraine", for the purpose of enhancement of requirements about procedure for issue to legal entities of the license of the National Bank of Ukraine of provision to banks of services in collection the Board of the National Bank of Ukraine decides:

1. Approve Changes in Regulations on procedure for issue to legal entities of the license for the provision to banks of services in collection approved by the resolution of Board of the National Bank of Ukraine of December 24, 2015 No. 926 (in edition of the resolution of Board of the National Bank of Ukraine of December 22, 2018 No. 150) (with changes) (further - the Provision) which are applied.

2. The National Bank of Ukraine considers the documents of legal entities which arrived in the National Bank of Ukraine according to requirements and/or according to the procedure, provided by this Provision, before entry into force of this resolution, without the changes made by this resolution.

3. To legal entities who obtained the license for provision to banks of services in collection, within six months from the date of the termination or cancellation of warlike situation in the territory of Ukraine to provide:

1) reduction of structure of property in compliance with requirements of the Provision and to file the following urgent documents to the National Bank of Ukraine:

the information about owners of essential participation and final key participants constituted according to the requirements established by the Regulations on requirements to structure of property of suppliers of financial services approved by the resolution of Board of the National Bank of Ukraine of April 14, 2021 No. 30 (further - No. Provision 30), the method provided in the subitem 3 of Item 18 of the Section III of Provisions;

the schematic image of structure of property of the legal entity constituted according to the parameters of preparation/filling of the schematic image of structure of property provided by the Provision No. 30 (further - the scheme), one of the methods provided in subitems 1, 2 Items 18 of the Section III of Provisions;

the notice to produce of data on structure of property of the legal entity constituted according to the requirements provided No. Provision 30, one of the methods provided in subitems 1, 2 Items 18 of the Section III of Provisions;

Placement of data of rather final key participants, the information about owners of essential participation and the scheme on the website of the legal entity (in case of its availability) on the Internet (except passport data of physical persons, complete addresses of their accommodation and identification numbers) in the file of the PDF format and to give 2) to the National Bank of Ukraine of assurance about it of any form with indication of the address of the website of the legal entity on which the corresponding data are posted (in case of its availability). Information which the legal entity posts on own website on the Internet shall correspond to the documents on structure of property filed to the National Bank of Ukraine and to be available on free basis to all interested persons;

3) reduction of goodwill of the legal entity, his heads, owners of essential participation, the chief accountant, the division manager of collection and the division manager on processing and storage of cash in compliance with requirements of the Provision and also to submit the questionnaire constituted in the form given in appendix 3 to the Provision.

4. Requirements of the subitem 14 of Item 64 of the Section IX, subitems 3, 4 Items 79-1 of the Section X of the Provision are not applied during action of warlike situation in the territory of Ukraine and within six months from the date of its termination or cancellation.

5. Department of currency circulation (Victor Zayvenko) after official publication of this resolution to report the legal entities who obtained the license of the National Bank of Ukraine for provision to banks of services in collection, information on its acceptance.

6. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Alexey Shaban.
