About modification of the Order of the Government of the Russian Federation of April 24, 2015 No. 390

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to the order of the Government of the Russian Federation of April 24, 2015 No. 390 "About procedure for transfer of the managing company performing functions on management of the territory of the advancing social and economic development on the property right or leases of the parcels of land which are in the state-owned or municipal property, buildings, structures and constructions located in the territory of the advancing social and economic development and procedure for the order such parcels of land, buildings, structures and constructions, and also infrastructure facilities of the territory of the advancing social and economic development" (The Russian Federation Code, 2015, No. 18, Art. 2710; 2018, No. 20, Art. 2848; 2019, No. 21, Art. 2563; 2021, No. 20, Art. 3380).

2. Determine that if the statement provided by the paragraph third Item 8 of Rules of the order the managing company performing functions on management of the territory of the advancing social and economic development, the parcels of land transferred by it to the possession or the lease, buildings, structures and constructions located in the territory of the advancing social and economic development, and also infrastructure facilities of the territory of the advancing social and economic development approved by the order of the Government of the Russian Federation of April 24, 2015 No. 390 "About procedure for transfer of the managing company performing functions on management of the territory of the advancing social and economic development on the property right or leases of the parcels of land which are in the state-owned or municipal property, buildings, structures and constructions located in the territory of the advancing social and economic development and procedure for the order by such parcels of land, buildings, structures and constructions, and also infrastructure facilities of the territory of the advancing social and economic development" (in the edition operating about day of entry into force of this resolution), it is sent to the federal executive body authorized in the field of creation of the territories of the advancing social and economic development about day of entry into force of this resolution, events for control are held according to the paragraph the ninth Item 8 of the specified Rules (in the edition operating about day of entry into force of this resolution).

3. This resolution becomes effective since September 1, 2022.

Changes which are made to the Order of the Government of the Russian Federation of April 24, 2015 No. 390

1. In Rules of transfer of the managing company performing functions on management of the territory of the advancing social and economic development on the property right or leases of the parcels of land which are in the state-owned or municipal property, buildings, structures and constructions located in the territory of the advancing social and economic development, approved by the specified resolution:

a) to add Item 2 after the words "about creation of the territory of the advancing social and economic development" with the words "or the decision of the Government of the Russian Federation on consolidation of the territories of the advancing social and economic development";

b) the first and second Item 8 after the words "during 15" to add offers with the word of "calendar".

2. In Rules of the order the managing company performing functions on management of the territory of the advancing social and economic development, the parcels of land transferred by it to the possession or the lease, buildings, structures and constructions located in the territory of the advancing social and economic development, and also infrastructure facilities of the territory of the advancing social and economic development approved by the specified resolution:

a) add Item 3 with the words "or the decision of the Government of the Russian Federation on consolidation of the territories of the advancing social and economic development";

b) state Item 8 in the following edition:

"8. The managing company performs provision in property to resident:

a) the parcels of land on which buildings, structures and constructions which owner is the resident and which creation is provided by the agreement on activities implementation are located;

b) the buildings, structures and constructions leased by resident from managing company.";

c) add with Items 8 (1) - 8(3) following contents:

"8(1). The parcels of land, buildings, the structures and constructions specified in Item 8 of these rules are provided by managing company in property to resident after execution by the resident of the obligation on implementation of investments, including capital investments, in amount and in terms which are provided by the agreement on activities implementation, and also obligations on creation of workplaces if such obligation is provided by the agreement on activities implementation.

8(2). The resident directs to managing company the application for provision of the parcels of land, buildings, structures and constructions in property of resident (further - the statement for provision in property) and for the purpose of confirmation of accomplishment of the obligations specified in Item 8 (1) these rules, attaches to it the following documents:

a) copies of permissions to input of objects in operation, except as specified, provided by part 15 of article 55 of the Town-planning code of the Russian Federation;

b) copies of transfer acts or other documents on cession of property, resident, necessary for implementation of the activities, provided in the agreement on activities implementation;

c) copies of payment documents with mark of credit institution about write-off of the means confirming payment of goods, performance of works, rendering the services connected with obligation fulfillment, specified in Item 8 (1) these rules;

d) copies of the agreements or the agreement extract containing the data confirming obligation fulfillment, specified in Item 8 (1) these rules;

e) data on the average number of workers for prior 3 calendar years.

8(3). The managing company within 45 calendar days from the date of receipt of the statement for provision in property and the documents attached to it holds events for control over the implementation by resident of the agreement on implementation of activities regarding execution of the obligation by it on creation of the buildings, structures and constructions specified in the subitem "an" of Item 8 of these rules on the parcel of land (parcels of land) concerning which (which) the application for provision is directed to property, and also the obligations specified in Item 8 (1) these rules, and makes the decision on provision of the parcels of land specified in the statement for provision in property, buildings, structures and constructions in property or on refusal in their provision in case of non-execution by the resident of the specified obligations.";

d) state Item 10 in the following edition:

"10. In case of the conclusion with resident of the purchase and sale agreement of the parcel of land, the building, structure and construction located in the territories of the subjects of the Russian Federation which are part of the Far Eastern Federal District, in the territories of the municipalities which are part of the Arctic zone of the Russian Federation, and the buildings gratuitously transferred to the possession of managing company from the state-owned (municipal) property based on the agreement on creation of the territory of the advancing social and economic development, except for, structures and constructions, the construction or reconstruction of which were performed with attraction of financial resources of budgets of budget system of the Russian Federation, in cases if permission to commissioning of the facility concerning such buildings, structures and constructions was issued after date of creation of the territory of the advancing social and economic development either construction or reconstruction of the specified buildings, structures and constructions were complete after the specified date (if for construction or reconstruction of such buildings, structures and constructions issue of permission to commissioning of the facility is not provided), the price of the parcel of land, the building, structure and construction is determined in the amount of, the constituting 2,5 of percent of cadastral cost of the parcel of land, the building, structure or construction.".
