About introduction of amendments to some acts of the Government of the Russian Federation concerning technological connection of power receiving devices of consumers of electrical energy to power networks and recognition voided separate provisions of some acts of the Government of the Russian Federation

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning technological connection of power receiving devices of consumers of electrical energy to power networks.

2. To executive bodies of subjects of the Russian Federation in the field of state regulation of rates till July 1, 2022 to bring the decisions on establishment of payment for technological accession to power networks of the territorial network organizations and the standardized tariff charges determining its size into compliance with this resolution.

3. Determine that the changes approved by this resolution extend to the legal relationship on technological connection of power receiving devices and (or) objects of microgeneration which arose based on requests for technological connection of power receiving devices and (or) objects of microgeneration of the consumers of electrical energy to power networks given after entry into force of this resolution.

4. Recognize invalid separate provisions of acts of the Government of the Russian Federation according to the list according to appendix.

5. This resolution becomes effective since July 1, 2022.

Changes which are made to acts of the Government of the Russian Federation concerning technological connection of power receiving devices of consumers of electrical energy to power networks

1. a) in Rules of non-discriminatory access to services in transfer of electrical energy and rendering these services approved by the specified resolution:

to add Item 2 after the paragraph of the fifteenth with the paragraph of the following content:

"the notification on providing with the network organization possibility of accession to power networks" - the document constituted upon termination of the procedure of technological accession to power networks of power receiving devices of the applicants specified in Items 12 (1), 13(2) - 13(5) and 14 Rules of technological connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also objects of electric grid economy belonging to the network organizations and other persons to power networks which technological connection of power receiving devices is performed at the level of tension of 0,4 of kV and below, and confirming technological accession to power networks in accordance with the established procedure in which technical characteristics of technological accession, including the size of the maximum capacity are determined, borders of balance sheet accessory of power generation facilities (power receiving devices) of the parties and limit of responsibility of the parties for operation of the relevant power generation facilities (power receiving devices) and (or) objects of electric grid economy;";

in the subitem "e" of Item 13 of the word", approved by the order of the Government of the Russian Federation of December 27, 2004 No. 861 "About approval of Rules of non-discriminatory access to services in transfer of electrical energy and rendering these services, Rules of non-discriminatory access to services in supervisory control in power industry and rendering these services, Rules of non-discriminatory access to services of Trading System Administrator of the wholesale market and rendering these services and Rules of technological connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also the objects of electric grid economy belonging to the network organizations and other persons to power networks" to exclude;

b) in Rules of technological connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also the objects of electric grid economy belonging to the network organizations and other persons, to power networks, approved by the specified resolution:

in paragraph one of Item 3 of the word "and availability of technical capability of technological accession" to exclude;

in Item 7:

the subitem "g" after the words "specified in Items 12 (1), 13, 13(2) - 13(5) and 14 these rules" to add with words "power receiving devices which maximum capacity makes up to 150 kW inclusive (taking into account the power receiving devices which are earlier attached in this point of accession) to power networks tension class up to 20 kV inclusive who are used by physical persons for the domestic and other needs which are not connected with implementation of business activity";

to add the subitem "e" after the words "according to appendix No. 1" with words "(for the applicants specified in Items 12 (1), 13(2) - 13(5) and 14 these rules which technological connection of power receiving devices is performed at the level of tension of 0,4 of kV and below, - notifications on providing with the network organization possibility of accession to power networks in form according to appendix No. 1(1)";

in Item 8:

to add paragraph two after the words "tension class specified in the request" with words "(in case of specifying in the request of class of tension to 1000 V - to the closest object of power network of class of voltage no more than 20 kV)";

third to state the paragraph in the following edition:

"The network organization for implementation of the procedure of technological accession, the guaranteeing supplier for the conclusion of the agreement providing sale of electrical energy (capacity) in the retail market (if in the request data according to the subitem "l" of Item 9 of these rules are specified), the purchase and sale agreement of the electrical energy made on objects of microgeneration along with use of paper documents which execution is provided by these rules between the network organization and the applicant during the procedure of technological accession and also between the guaranteeing supplier and the applicant during the conclusion of the agreement providing sale of electrical energy (capacity) in the retail market, and the purchase and sale agreement of the electrical energy made on objects of microgeneration provides possibility of use of such documents in the form of electronic documents.";

"the agreement providing sale of electrical energy (capacity) in the retail market" to add the offer first of the paragraph of the fourth after words with words ", the purchase and sale agreement of the electrical energy made on objects of microgeneration";

to state the paragraph of the sixth in the following edition:

"The network organization and the guaranteeing supplier in case of receipt of request of the applicant about need of provision of the documents signed in the form of electronic documents between the network organization and (or) the applicant during the procedure of technological accession, and (or) the documents signed in the form of electronic documents between the guaranteeing supplier and (or) the applicant during the conclusion of the agreement providing sale of electrical energy (capacity) in the retail market (if in the request data according to the subitem "l" of Item 9 of these rules are specified), the purchase and sale agreement of the electrical energy made on objects of microgeneration on paper shall within 10 days from the date of receipt of such request provide the direction to the applicant of such paper documents signed from the network organization (the guaranteeing supplier).";

add with Item 8 (9) the following content:

"8(9). The network organization performing technological connection of power receiving devices and (or) objects of microgeneration of the applicant the subject of the retail market specified in the request according to the subitem "l" of Item 9 of these rules with which the applicant intends to sign the agreement providing sale of electrical energy (capacity) in the retail market the guaranteeing supplier in whose zone of activities there are objects of microgeneration of the applicant with whom the applicant will sign the purchase and sale agreement of the electrical energy made on objects of microgeneration for the purpose of realization of the procedure for the conclusion provided by these rules by the applicant of the specified agreements before completion of actions for technological connection of power receiving devices and (or) objects of microgeneration of the applicant has the right to sign the agreement on procedure for exchange of information and the documents necessary for the conclusion by the applicant of the agreement, providing sale of electrical energy (capacity) in the retail market, service provision agreements on transfer of electrical energy or the purchase and sale agreement of the electrical energy made on objects of microgeneration (further - the agreement on information exchange).

Within the agreement on information exchange the network organization performing technological connection of power receiving devices and (or) objects of microgeneration of the applicant provides to the subject of the retail market specified in the request of the applicant according to the subitem "l" of Item 9 of these rules with which the applicant intends to sign the agreement providing sale of electrical energy (capacity) in the retail market, to the guaranteeing supplier in whose zone of activities there are objects of microgeneration of the applicant with whom the applicant will sign the purchase and sale agreement of the electrical energy made on objects of microgeneration, documents and information provided by these rules, including the copy of the request and the documents of the applicant attached to it, information on date of the conclusion by the applicant of the agreement, about agreement cancelation, the act of the admission of the metering device in operation act of implementation of technological accession (notification on providing with the network organization possibility of accession to power networks).
