About approval of regulations of ministerial procedure

Based on part one of Item 5 of Article 3 and the paragraph of third of article 9-1 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures", subitem 6.16 of Item 6 of the Regulations on the Ministry of Foreign Affairs of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 978, of subitem 10.7 of Item 10 of the Regulations on the State Customs Committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of April 21, 2008 No. 228, the Ministry of Foreign Affairs of the Republic of Belarus and the State Customs Committee of the Republic of Belarus is DECIDED:

1. Approve Regulations of the ministerial procedure performed concerning subjects of managing according to the subitem * 1.3.1 "Receipt of confirmation of purpose of imported goods (for the purpose of implementation of the note 5 to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union)" it (is applied).

* For the purposes of this resolution the subitem is understood as the subitem of Item of the single list of the ministerial procedures performed concerning subjects of the managing approved by the resolution of Council of Ministers of the Republic of Belarus of September 24, 2021 No. 548.

2. This resolution becomes effective after its official publication.

Regulations of the ministerial procedure performed concerning subjects of managing according to subitem 1.3.1 "Receipt of confirmation of purpose of imported goods (for the purpose of implementation of the note 5 to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union)"

1. Features of implementation of ministerial procedure:

1.1. name of authorized body (jurisdiction of ministerial procedure):

The industry ministry, Department on aircraft of the Ministry of Transport and Communications (further – Department on aircraft) issue confirmations of purpose of imported goods concerning goods which names contain the reference to the note 5 to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union (further – the CN FEA EEU), the CN FEA EEU classified by the codes established in appendix to the resolution of Council of Ministers of the Republic of Belarus of October 19, 2017 No. 792 "About confirmation of purpose of imported goods";

The Minsk city executive committee, regional executive committees in place of registration of the applicant issue confirmations of purpose of imported goods in other spheres of the industry concerning goods which names contain the reference to the note 5 to the CN FEA EEU, the CN FEA EEU classified by codes, excellent from specified in appendix to the resolution of Council of Ministers of the Republic of Belarus of October 19, 2017 No. 792;

1.2. the regulatory legal acts, the international agreements of the Republic of Belarus, the international legal acts containing the obligations of the Republic of Belarus regulating procedure of ministerial procedure:

The law of the Republic of Belarus "About bases of ministerial procedures";

the resolution of Council of Ministers of the Republic of Belarus of October 19, 2017 No. 792;

the resolution of Council of Ministers of the Republic of Belarus of September 24, 2021 No. 548 "About the ministerial procedures performed concerning subjects of managing";

1.3. other available features of implementation of ministerial procedure:

1.3.1. the additional bases for refusal in adoption of the statement of the interested person in comparison with the Law of the Republic of Belarus "About bases of ministerial procedures" are determined in Item 6 of the Regulations on procedure for issue of confirmation of purpose of the imported goods approved by the resolution of Council of Ministers of the Republic of Belarus of October 19, 2017 No. 792 (further – the Provision);

1.3.2. the bases and criteria of refusal in issue of confirmation of purpose of imported goods are determined in Provision Item 11;

1.3.3. appeal of the executive decision is performed judicially, except for the executive decision made by Department on aircraft;

1.3.4. ministerial procedure is performed concerning the legal entities and individual entrepreneurs specified in the Provision Item 2 part one.

2. The documents and (or) data necessary for implementation of ministerial procedure represented by the interested person:

In case of filing of application the authorized body has the right to demand from the interested person the documents provided in paragraphs the second or seventh part one of Item 2 of article 15 of the Law of the Republic of Belarus "About bases of ministerial procedures".

3. Data on the reference or other document issued (accepted, approved, approved) authorized body by results of implementation of ministerial procedure:
