About modification of the Order of the Government of the Russian Federation of August 16, 2021 No. 1342

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to the order of the Government of the Russian Federation of August 16, 2021 No. 1342 "About the Single state information system of social security" (The Russian Federation Code, 2021, No. 35, Art. 6282; 2022, No. 23, Art. 3780).

2. Determine that till January 1, 2023 the information about physical persons and family and (or) family relations of physical persons necessary for ensuring process of identification of the citizens needing receipt of measures of social protection (support), the Pension Fund of the Russian Federation creates based on data on state registration of the acts of civil status containing in the Unified state register of civil registrations.

3. To the fund of pension and social insurance of the Russian Federation, federal executive bodies participating in interdepartmental interaction when ensuring process of identification of the citizens needing receipt of measures of social protection (support) to perform the organizational and technological actions ensuring setup and smooth operation of information systems till January 1, 2024.

4. This resolution becomes effective since December 1, 2022, except for:

the paragraph of the third subitem "g" of the Item of 1 changes approved by this resolution, which is becoming effective since January 1, 2023;

paragraphs of the twenty second and twenty third subitem "g" of Item of 1 changes approved by this resolution, which are becoming effective since January 1, 2024.

Changes which are made to the Order of the Government of the Russian Federation of August 16, 2021 No. 1342

1. In the Regulations on the Single state information system of social security approved by the specified resolution:

a) add Item 6 with the subitem "d" of the following content:

"e) ensuring process of identification of the citizens needing receipt of measures of social protection (support) and also accounting of information about such citizens.";

b) the subitem "an" of Item 9 after the words "being under authority of public authorities" to add with the words "including the multipurpose centers of provision of the state and municipal services in the presence of the relevant decision of the subject of the Russian Federation";

c) add with Item 38 (1) the following content:

"38(1). Federal executive bodies and the organizations subordinated to them provide the information provided by the Section 16 of structure of information, for the purpose of ensuring process of identification of the citizens needing receipt of measures of social protection (support), and also accounting of information about such citizens in the Unified information system, according to the procedure, determined by the Section IV (1) this provision.";

d) add with the Section IV (1):

"IV (1). Procedure for ensuring process of identification of the citizens needing receipt of measures of social protection (support), and also accounting of information about such citizens in the Unified information system

52(2). The Federal Tax Service provides in the Pension Fund of the Russian Federation the information about physical persons and family and (or) family relations of physical persons according to the procedure, No. 1723 provided by the order of the Government of the Russian Federation of October 9, 2021 "About approval of Rules of provision of the data containing in the single federal information register containing data on the population of the Russian Federation, including the list of the specified data and terms of their provision, and the list of the depersonalized personal data containing in the single federal information register containing data on the population of the Russian Federation".

52(3). The Pension Fund of the Russian Federation no later than 3 working days following behind day of obtaining specified in Item 52 (2) this provision of data (in case of lack of changes of data - quarterly), on the basis of the received data creates structures of families (including families of persons who do not have family relations) and supplements them with data from the Unified information system:

a) about legal representatives of the minor child or incapacitated person;

b) about deprivation (restriction) of the parent rights;

c) about reference of physical person to category of the receiver of measure of social protection (support);

d) about pensions, benefits and other similar payments, including payments for compulsory social insurance and the payments of compensation nature received in accordance with the legislation of the Russian Federation and (or) the legislation of the subject of the Russian Federation, acts (decisions) of local government bodies;

e) about remuneration for accomplishment of labor or other obligations, including payments of the stimulating nature, remuneration for the performed work, the rendered service, making of action within the civil agreement.

52(4). The Pension Fund of the Russian Federation no later than 3 working days following behind day of forming specified in Item 52 (3) this provision of data, perfroms calculation of the average per capita income of families (including families of persons who do not have family relations) and creates selection of families, the average per capita income in which does not exceed the triple size of the subsistence minimum per capita in general across the Russian Federation established for the next financial year for the purpose of the subsequent identification of the citizens needing receipt of measures of social protection (support).

For realization of paragraph one of this Item the average per capita income of family is calculated proceeding from the amount of the income of all family members for the last 12 calendar months, to prior 4 calendar months before month of forming specified in Item 52 (2) this provision of data, by division of the one twelfth amount of the income of all family members for settlement period on number of family members.

In case of other terms of calculation and payment of the income the amount of the gained income is divided into the number of months for which it is added, and is considered in the income of family for those months which fall on settlement period.

52(5). The Pension Fund of the Russian Federation no later than 3 working days after accomplishment of actions according to Item 52 (4) this provision sends to the Federal Tax Service by means of single system of interdepartmental electronic interaction interdepartmental requests electronically for receipt of data concerning the families specified Item 52 in paragraph one (4) this provision, by each type of the taxable incomes of physical persons according to the Section 16 of structure of information (except for the data specified in Item 16.2 of structure of information).

52(6). The Federal Tax Service no later than 5 working days following behind day of receipt of the interdepartmental request specified in Item 52 (5) this provision, transfers to the Pension Fund of the Russian Federation as to the operator of the Unified information system by means of single system of interdepartmental electronic interaction of the data electronically on the taxable incomes of physical persons concerning which the interdepartmental request arrived.

52(7). The Pension Fund of the Russian Federation no later than 1 working day following behind day of obtaining according to Item 52 (6) this provision of data, perfroms with their accounting repeated calculation of the average per capita income in the relation of the families specified Item 52 in paragraph one (4) this provision.

When calculating the average per capita income according to paragraph one of this Item the income included in Items 16.6 - 16.10 structures of information, are considered as one twelfth income amounts, received during tax period, increased on the number of the months which entered settlement period.

52(8). The Pension Fund of the Russian Federation no later than 3 working days following behind day of receipt of data according to Item 52 (6) this provision, enters into the Unified information system concerning citizens whose income in the considered period was absent, data on implementation of care of the citizen of the disabled person, on establishment to the citizen of disability.

52(9). The Federal Service for Labour and Employment daily performs transfer to the Pension Fund of the Russian Federation by means of single system of interdepartmental electronic interaction of data electronically on statement on registration accounting in public institutions of employment service (removal from the specified accounting) of citizens for the purpose of job search, jobless citizens.

52(10). The Pension Fund of the Russian Federation no later than 3 working days after accomplishment of actions according to Item 52 (7) this provision (in case of lack of changes - monthly, no later than 3 working days following after last month) sends to the Ministry of Internal Affairs of the Russian Federation, the public company "Roskadastr", the Ministry of the Russian Federation for civil defense, to emergency situations and natural disaster response, the Ministry of Agriculture of the Russian Federation by means of single system of interdepartmental electronic interaction interdepartmental requests electronically for receipt of data on property concerning the families specified Item 52 in paragraph one (4) this provision.

52(11). The public company "Roskadastr" no later than 3 working days following behind day of receipt of interdepartmental request according to Item 52 (10) this provision, transfers by means of single system of interdepartmental electronic interaction to the Unified information system from the Single state real estate register of the data electronically on the real estate belonging to physical persons concerning which the interdepartmental request arrived.

52(12). The Ministry of Internal Affairs of the Russian Federation, the Ministry of the Russian Federation for civil defense, to emergency situations and natural disaster response, the Ministry of Agriculture of the Russian Federation no later than 5 working days following behind day of receipt of interdepartmental request according to Item 52 (10) this provision, transfers by means of single system of interdepartmental electronic interaction to data Unified information system electronically about personal estate, about the vehicles staying on the state registry belonging to physical persons concerning which the interdepartmental request arrived.

52(13). The state bodies and the organizations giving the government public assistance and providing measures of social protection (supports) send by means of single system of interdepartmental electronic interaction to the Unified information system interdepartmental requests electronically about receipt of data according to the Section 16 of structure of information, including the electronic documents received within interdepartmental electronic interaction according to this Section concerning citizens for decision making about rendering the government public assistance to them and (or) purposes of measures of social protection (support).

52(14). The depersonifitsirovanny data specified in the Section 16 of structure of information are applied to the analysis of dynamics of change of the income and influence of the applied measures of social protection (support) on the level of security of the population which is carried out by the Ministry of Labour and Social Protection of the Russian Federation, the Pension Fund of the Russian Federation, public authorities of subjects of the Russian Federation.".

2. As a part of information placed in the Single state information system of social security, and the sources of such information approved by the specified resolution:

a) Items 14.3 - 14.6 to exclude;

b) add with the Section 16 of the following content:
