About introduction of amendments to some resolutions of the Cabinet of Ministers of Ukraine concerning use of natural resources

1. Bring in resolutions of the Cabinet of Ministers of Ukraine concerning change use of natural resources which are attached.

2. This resolution becomes effective from the date of its publication, except subitem paragraph two 2 Items of 3 changes approved by this resolution which becomes effective in six months from the date of publication of this resolution.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine concerning use of natural resources

1. In the Technique of determination of starting price of the sale at auction of special permission to mineral right approved by the resolution of the Cabinet of Ministers of Ukraine of October 15, 2004 No. 1374 (The Official Bulletin of Ukraine, 2004, No. 42, Art. 2772; 2020, No. 81, Art. 2612):

Item 1 to add 1) with paragraphs of the following content:

"For calculation of starting price of permission of the field or the subsoil plot where inventories (resources) of minerals are approved (are approved) in accordance with the established procedure or considered by the state balance of minerals, the formula specified in Item 5 of this Technique is applied.

Calculation of starting price of permission of the field or subsoil plot where there are no approved (approved) in accordance with the established procedure inventories (resources) of minerals or not considered by the state balance of minerals is performed according to Item 9 of this Technique according to the established values of payment for year of use of the land area of subsoil of minerals of certain categories.";

"In case of expansion of borders of the subsoil plot on which special permission is provided subject to calculation of starting price of permission is only the land area of subsoil on which such expansion, or amount of products of the mountain company - mineral (mineral raw materials) of the field or the subsoil plot, available on the subsoil plot on which such expansion is performed is performed.

"3. For scoping of products of the mountain company - mineral (mineral raw materials) of the field or the subsoil plot where inventories (resources) of minerals are approved (are approved) in accordance with the established procedure or considered by the state balance of minerals, data which are established for settlement date, on priority in such procedure are used:

1) in protocols of the State Commission on Mineral Reserves (further - GKZ) by results of conducting state examination and assessment of inventories (resources) of minerals (except underground waters);

2) the state balance of minerals (except underground waters);

3) in acts and protocols of expert evaluation of resources of the prepared and revealed objects Gosgeonedr, protocols of scientific council on forecasting, scientific and technical councils of the companies belonging to the management sphere Gosgeonedr (except underground waters).

The products amount for objects of underground waters is determined according to Item 7 of this Technique taking into account selection amounts (forecast selection) of waters from water intaking constructions which will be specified in special conditions of permission to use of natural resources.

In case of accounting by the state stock balance (resources) of minerals in the classification operating before entry into force of the resolution of the Cabinet of Ministers of Ukraine of May 5, 1997 with No. 432 "About approval of Classification of inventories and resources of minerals of the state fund of subsoil" (The Official Bulletin of Ukraine, 1997, No. 19, of the Art. 104), the amount of products of the mountain company - mineral (mineral raw materials) of the field or the subsoil plot is determined by the following formulas:

for solid minerals:

Otp = A + B + C1 + C2 + ((P1 + P 2) x 0,25) + (P3 x 0, 125),

for sites of oil-and-gas subsoil:

Otp = A + B + C1 + C2 + (C3 x 0, 25) + ((D1 + D 2) x 0,125),

where Otp - amount of products of the mountain company - project production of mineral (mineral raw materials) of the field or the subsoil plot;

A, B, C1 - amount of balance sheet inventories;

C2 - amount of previously estimated inventories;

P 1, P2 - amount of perspective resources for solid minerals;

C3 - amount of perspective resources for hydrocarbons;

P3 - amount of forecast resources for solid minerals;

D 1, D2 - amount of forecast resources for hydrocarbons;
