About submission of data on the activities connected with turnover of precursors of drugs and psychotropic substances, and registration of the transactions connected with their turnover, and recognition voided some decisions of the Government of the Russian Federation

For the purpose of ensuring the state control of turnover of precursors of drugs and psychotropic substances according to the Federal Law "About Drugs and Psychotropic Substances" Government of the Russian Federation decides:

1. Approve enclosed:

Rules of submission of activities reports, connected with turnover of precursors of drugs and psychotropic substances;

Rules of maintaining and storage of special magazines of registration of the transactions connected with turnover of precursors of drugs and psychotropic substances.

2. Determine that the Ministry of Industry and Trade of the Russian Federation based on reports of legal entities on quantity of each imported (exported) precursor entered in the list I and tables I and II of the list IV of the list of the drugs, psychotropic substances and their precursors which are subject to control in the Russian Federation No. 681 approved by the order of the Government of the Russian Federation of June 30, 1998 "About approval of the list of the drugs, psychotropic substances and their precursors which are subject to control in the Russian Federation" constitutes the summary annual statement with indication of data on each legal entity and represents it to the Ministry of Internal Affairs of the Russian Federation no later than February 25 of the year following after accounting year.

3. Recognize invalid decisions of the Government of the Russian Federation according to the list according to appendix.

4. This resolution becomes effective since March 1, 2022 and is effective till March 1, 2028.

Rules of submission of activities reports, connected with turnover of precursors of drugs and psychotropic substances

1. These rules establish procedure for submission of activities reports, connected with turnover of precursors of the drugs and psychotropic substances (further - precursors) entered in lists I and IV of the list of the drugs, psychotropic substances and their precursors which are subject to control in the Russian Federation, No. 681 approved by the order of the Government of the Russian Federation of June 30, 1998 "About approval of the list of the drugs, psychotropic substances and their precursors which are subject to control in the Russian Federation" (further - the list).

2. The legal entities performing in accordance with the established procedure production, realization and use of the precursors entered in the list I of the list, the legal entities and individual entrepreneurs performing in accordance with the established procedure production of the precursors entered in the list IV of the list, and also realization and use of the precursors brought in tables I and II of the list IV of the list represent to territorial authorities of the Ministry of Internal Affairs of the Russian Federation in the location of the legal entity or in the place of implementation of activities of the individual entrepreneur:

a) quarterly statements on quantity of each made precursor entered in the list I or the list IV of the list - no later than April 20, on July 20, on October 20 and on January 20 the year following after accounting year in form according to appendix No. 1;

b) the activities report for the expired calendar year (further - the annual statement) about quantity of each made precursor entered in the list I or the list IV of the list - annually, no later than February 20 of the year following after accounting year in form according to appendix No. 2;

c) the annual statement about quantity of each realized precursor entered in the list I or tables I and II of the list IV of the list - annually, no later than February 20 of the year following after accounting year in form according to appendix No. 3;

d) the annual statement about quantity of each used precursor entered in the list I or tables I and II of the list IV of the list - annually, no later than February 20 of the year following after accounting year in form according to appendix No. 4.

3. The legal entities performing in accordance with the established procedure import to customs area of the Eurasian Economic Union (export from customs area of the Eurasian Economic Union) the precursors entered in the list I or tables I and II of the list IV of the list represent to the Ministry of Industry and Trade of the Russian Federation quarterly statements (no later than April 20, on July 20, on October 20 and on January 20 the year following after accounting year) and the annual statement (no later than February 20 of the year following after accounting year) about quantity of each imported (exported) precursor in forms according to appendices No. 5 and 6 respectively.

4. In case of reorganization or liquidation of the legal entity, and also the termination of activities of the individual entrepreneur reports on the activities for the period, following after day of submission of the last quarterly (annual) statement about day of completion of reorganization, liquidation or about day of the termination of activities, are represented:

by reorganization - the legal entity no later than the day preceding day of completion of reorganization;

in case of liquidation - the legal entity no later than the day preceding day of exception of the legal entity of the Unified State Register of Legal Entities;

in case of the activities termination - physical person no later than the day preceding day of its exception as the individual entrepreneur from the Unified State Register of Private Entrepreneurs.

Rules of maintaining and storage of special magazines of registration of the transactions connected with turnover of precursors of drugs and psychotropic substances

1. These rules establish procedure for maintaining and storage of special magazines of registration of transactions under which the quantity of precursors of the drugs and psychotropic substances entered in lists I and IV of the list of the drugs, psychotropic substances and their precursors which are subject to control in the Russian Federation, No. 681 approved by the order of the Government of the Russian Federation of June 30, 1998 "About approval of the list of the drugs, psychotropic substances and their precursors which are subject to control in the Russian Federation" changes (further respectively - precursors, the list), in form according to appendix.

2. When implementing the types of activity connected with turnover of precursors, any transactions in case of which the quantity of precursors changes (further - transactions) are subject to entering in the special magazine of registration of transactions (further - the magazine of registration). The magazine of registration is kept on paper or electronically.

These rules do not extend to maintaining and storage of magazines of registration in cases when use of precursors without license according to articles 35 and 36 of the Federal law "About Drugs and Psychotropic Substances" is allowed or when destruction of the precursors confiscated or withdrawn from illicit trafficking for the purpose of implementation of article 47 of the Federal law "About Drugs and Psychotropic Substances" is performed.

3. Transactions are recorded according to each name of precursor on the single developed sheet of the magazine of registration or in the separate magazine of registration.

4. Magazines of registration shall be on paper stitched, numbered, certified by the signature of the head of the legal entity or the official authorized by him, the individual entrepreneur and are under seal the legal entity or the individual entrepreneur (in the presence of seal).

5. The head of the legal entity, the individual entrepreneur appoint persons responsible for maintaining and storage of magazines of registration.

6. Entries in magazines of registration are made by person responsible for their maintaining and storage, in chronological procedure at least once during the day of making of transactions (according to each name of precursor) based on the documents confirming making of these transactions.

The documents confirming transaction making, or their copies certified in accordance with the established procedure, the copy of the identity document (in case of realization to physical person of the precursors brought in the table II of the list IV of the list), are filed in the separate folder which is stored in metal case (safe) from which keys are at person responsible for maintaining and storage of the magazine of registration.

7. The provision of Item 6 of these rules does not extend to cases of registration of transactions on leave, realization, acquisition or use of diethyl ether (ethyl ether, sulphuric ether) in concentration of 45 percent or more or potassium permanganate in concentration of 45 percent or more than a weight which is not exceeding 10 kilograms, acetone (2-propanon) in concentration of 60 percent or more, methylethylketone (2 butanones) in concentration of 80 percent or more, toluene in concentration of 70 percent or more, sulphuric acid in concentration of 45 percent or more, hydrochloric acid in concentration of 15 percent or more, acetic acid in concentration of 80 percent or more, methyl acrylate in concentration of 15 percent or more or methylmethacrylate in concentration of 15 percent or more than a weight which is not exceeding 100 kilograms and also the mixes containing only the specified substances. At the same time the log entry of registration about total amount of the released, realized, acquired or used specified substances is made monthly, and documentary confirmation of making of each transaction is not required.

8. In magazines of registration both names of precursors according to lists I and IV of the list, and other their names under which they are received by the legal entity or the individual entrepreneur are specified.

9. Numbering of entries in magazines of registration according to each name of precursor is performed within calendar year in ascending order of numbers.

Numbering of records of transactions on receipt and expense is conducted according to the number of the performed corresponding operations.

Numbering of entries in new magazines of registration on paper begins with number following the last room in the completed magazines of registration.

10. Entry in magazines of registration of each performed operation is certified by the signature including strengthened by the qualified digital signature of person responsible for their maintaining and storage with indication of surname and initials.

11. Corrections are certified of magazines of registration by the signature including strengthened by the qualified digital signature of person responsible for their maintaining and storage. Not certified corrections in magazines of registration are not allowed.

12. The magazine of registration is on paper stored in metal case (safe) from which keys are at person responsible for maintaining and storage of the magazine of registration.

Maintaining the magazine of registration is electronically provided in accordance with the legislation of the Russian Federation about information, information technologies and on information security.

13. The completed magazines of registration including created electronically together with the documents confirming implementation of transactions are stored during the terms established by the Federal Law "About Drugs and Psychotropic Substances" then are liable to destruction under the act approved by the head of the legal entity or the official authorized by it, the individual entrepreneur.

14. By reorganization of the legal entity the magazines of registration including created electronically and the documents confirming implementation of transactions are transferred to the legal successor.

15. In case of liquidation of the legal entity the magazines of registration including created electronically and the documents confirming implementation of transactions are transferred to storage to the Public or municipal Records Office in the location of the legal entity according to the legislation on archiving in the Russian Federation before the expiration of their temporary storage, stipulated in Item 13 these rules then are liable to destruction in accordance with the established procedure.

16. In case of the termination of activities of the individual entrepreneur the magazines of registration including created electronically and the documents confirming implementation of transactions are transferred to storage to the Public or municipal Records Office in the place of implementation of activities of the individual entrepreneur according to the legislation on archiving in the Russian Federation before the expiration of their temporary storage, stipulated in Item 13 these rules then are liable to destruction in accordance with the established procedure.
