About approval of Rules of connection (technological accession) of capital construction projects to centralized systems of hot water supply, cold water supply and (or) water disposal, about introduction of amendments to separate acts of the Government of the Russian Federation and recognition voided separate acts of the Government of the Russian Federation and provisions of separate acts of the Government of the Russian Federation

According to article 52.1 of the Town-planning code of the Russian Federation and the Federal Law "About Water Supply and Water Disposal" Government of the Russian Federation decides:

1. Approve enclosed:

Rules of connection (technological accession) of capital construction projects to centralized systems of hot water supply, cold water supply and (or) water disposal;

changes which are made to acts of the Government of the Russian Federation.

2. Recognize invalid acts of the Government of the Russian Federation and provision of separate acts of the Government of the Russian Federation according to the list according to appendix.

3. This resolution becomes effective since March 1, 2022 and 6 years are effective.

4. To the Ministry of Construction and Housing and Communal Services of the Russian Federation within 6 months from the effective date of this resolution to approve methodical instructions for calculation of the connected capacity (loading) of objects of centralized systems of hot water supply, cold water supply and water disposal.

Rules of connection (technological accession) of capital construction projects to centralized systems of hot water supply, cold water supply and (or) water disposal

I. General provisions

1. These rules determine procedure for connection (technological accession) projectible, under construction, reconstructed or constructed, but not connected to centralized systems of hot water supply, cold water supply and (or) water disposal of capital construction projects (further - capital construction project), including procedure for issue of specifications of connection (technological accession) of the capital construction projects to centralized systems of hot water supply, cold water supply and (or) water disposal applied for the purpose of architectural and construction designing, and redistribution condition (concession of the right to use) of the released connected capacity (loading) of objects of centralized systems of hot water supply, cold water supply and water disposal.

Action of these rules also extends to connection (technological accession) to centralized systems of hot water supply, cold water supply and (or) water disposal of water supply and (or) sewer systems for the purpose of creation of technological communication between centralized systems of hot water supply, cold water supply and (or) water disposal or separate objects of centralized system of hot water supply, cold water supply and (or) water disposal.

Connection (technological accession) to centralized systems of hot water supply, cold water supply and (or) water disposal of the objects which are not relating to capital construction projects (except for water supply and (or) sewer systems), and also connection (technological accession) to centralized storm systems of water disposal and centralized all-floatable systems of water disposal of the parcels of land for the purpose of removal (dumping) of surface sewage is performed with the consent of the organization performing hot water supply, cold water supply and (or) water disposal, according to the procedure, provided by these rules for connection (technological accession) of capital construction projects.

Connection (technological accession) to centralized systems of hot water supply, cold water supply and (or) water disposal in case of complex development of the territory is performed taking into account the features established present by Rules.

2. In these rules the concepts determined in the Town-planning code of the Russian Federation, the Federal Law "About Water Supply and Water Disposal" and other regulatory legal acts adopted according to it and also the following concepts are used:

"applicant" - person who addressed to the organization performing hot water supply, or the organization performing cold water supply and (or) water disposal with the statement for the conclusion of the agreement on connection (technological accession) to centralized system of hot water supply, centralized system of cold water supply and (or) water disposal (further respectively - the statement for connection, the agreement on connection);

"contractor" - the organization performing hot water supply, cold water supply and (or) water disposal, owning on the property right or on other legal cause objects of centralized systems of hot water supply, cold water supply and (or) water disposal to which it is direct or through technologically connected (adjacent) objects of centralized systems of hot water supply, cold water supply and (or) water disposal of other persons is performed connection (technological accession) of the connected objects. Only the organization performing hot water supply, cold water supply and (or) water disposal, owning on the property right or on other legal cause objects of centralized systems of hot water supply, cold water supply and (or) water disposal to which connection, or the guaranteeing organization determined concerning centralized system of cold water supply and (or) water disposal is directly performed can be the contractor;

"the connected capacity (loading)" - the capacity size determined by the applicant and specified to them according to balance of consumption of hot water or balance of water consumption and water disposal of the connected object during use of the maximum size of capacity (loading) with indication of the purposes of use of hot or cold water and distribution of amounts of the connected capacity (loading) on use purposes including for periodic needs, filling and emptying of pools, on the purpose ensuring fire extinguishing, acceptance of surface sewage, and also distributions of total amount of sewage on sewer releases;

"the connected object" - capital construction project, including the water supply and (or) sewer system and other objects which are not capital construction projects (except for certain rooms of capital construction project) concerning which connection (technological accession) to centralized systems of hot water supply, cold water supply and (or) water disposal, and also the parcel of land concerning which connection (technological accession) to centralized storm systems of water disposal and centralized all-floatable systems of water disposal for the purpose of removal (dumping) of surface sewage is performed is performed or planned to implementation;

"connection (technological accession)" (further - connection) - set of the organizational and technical actions giving the chance to the connected object to receive hot water from centralized system of hot water supply and (or) to receive cold water from centralized system of cold water supply and (or) to take away (to dump) sewage in centralized system of water disposal or creating technological communication between centralized systems of hot water supply, cold water supply and (or) water disposal or separate objects of centralized system of hot water supply, cold water supply and (or) water disposal;

"the connected (technologically attached) capacity (loading)" (further - the connected capacity (loading) - the maximum size of capacity (loading) of supply of cold water or removal of sewage in point (points) of connection expressed in volume of cold water or sewage per unit of time, the maximum size of capacity (loading) of supply of hot water in point (points) of connection expressed in volume of hot water and amount of the heat energy spent for its preparation per unit of time;

"connection specifications (technological accession) to centralized system of hot water supply, cold water supply and (or) water disposal" (further - specifications) - the document issued by the contractor for the purpose of architectural and construction designing of the connected object and the conclusion of the agreement on connection, containing information on the available possibility of connection of the connected object within the maximum capacity (loading) specified in such document in accession points within the term specified in such document, and which is the annex to the agreement on connection;

"technologically connected (adjacent) objects of centralized system of hot water supply, cold water supply and (or) water disposal" - the objects of centralized system of hot water supply, cold water supply or water disposal having mutual points of accession and participating in single engineering procedure of hot water supply, cold water supply or water disposal;

"connection point (technological accession)" (further - connection point) - the place of physical connection of the objects of centralized system of hot water supply, cold water supply and (or) water disposal created (reconstructed) by the contractor within the agreement on connection or belonging to the contractor or the other person of the existing objects of such system determined according to these rules and the contract on connection with the connected object or with the objects of such system created by the applicant within the agreement on connection or with the existing objects of such system belonging to the applicant;

"accession point" - the place of physical connection of the objects of centralized system of hot water supply, cold water supply and (or) water disposal created within the agreement on connection determined by the contractor with the existing objects of such system.

3. If the law of the subject of the Russian Federation - of Moscow, St. Petersburg or Sevastopol powers in the field of town-planning activities and (or) in the field of water supply and water disposal are not referred to the list of questions of local value, the corresponding actions, the rights and obligations of local government bodies of settlements, municipal districts, city districts (further - local government bodies) provided by these rules are performed by authorized executive body of the subject of the Russian Federation.

4. Connection to centralized systems of hot water supply, cold water supply and (or) water disposal is performed in the following procedure:

a) the direction persons specified in Items 9 and 11 of these rules, to the contractor of request about issue of specifications (if necessary) and issue to such persons of specifications in cases and according to the procedure who are identified by these rules;

b) direction applicant to the contractor of the statement for connection;

c) conclusion of the agreement on connection;

d) accomplishment of the actions for connection provided by the agreement on connection;

e) signing by the applicant and contractor of the act of connection.

5. The organization, performing hot water supply, the organization performing cold water supply and (or) water disposal in which it is necessary to make inquiry about issue of specifications (if necessary) and the statement for connection (including in need of increase in the connected capacity (loading), it is determined by persons specified in Items 9 and 11 of these rules according to the development plan for a land plot.

In case of lack of the development plan for a land plot if persons specified in Items 9 and 11 of these rules have no data on the organization performing hot water supply of the organization performing cold water supply and (or) water disposal in which it is necessary to make inquiry about issue of specifications (if necessary) and the statement for connection and such persons have the right to make in local government body the written request on submission of data on such organization with indication of the location of the connected object. The specified written request on provision of data can be sent in electronic form by means of the federal state information system "Single Portal of the State and Municipal Services (Functions)" (further - the single portal) according to Item 7 provisions (1) these rules.

The local government body shall provide to persons specified in Items 9 and 11 of these rules, in writing, and in case of the address of specified persons by means of the single portal in electronic form of the data on the organization performing hot water supply, the organization performing cold water supply and (or) water disposal in which it is necessary to make inquiry about issue of specifications (if necessary) and the statement for connection, including the name and the location of the organization, within 5 working days from the date of the address of persons specified in Items 9 and 11 of these rules.

The organization specified in this Item is determined by local government body based on schemes of the existing and planned placement of capital construction projects in the field of water supply and water disposal of federal, regional and local importance, schemes of water supply and water disposal, and also taking into account investing programs of the specified organization.

6. If the contractor performs operation of ownerless objects of centralized systems of hot water supply, cold water supply and (or) water disposal, connection of the connected objects also can be performed to such ownerless objects in the presence of the transfer act of such ownerless objects signed by the contractor with local government body according to article 8 of the Federal law "About Water Supply and Water Disposal".

7. By preparation of the development plan for a land plot the public authority, local government body within 2 working days from the date of receipt of the statement for issue of the development plan for a land plot sends to the contractor inquiry for submission of information on possibility of connection of capital construction projects to centralized systems of hot water supply, cold water supply and (or) water disposal. The specified information is subject to submission to public authority, local government body within 5 working days from the date of, the receipt of such request following behind day.

In the cases provided by the Town-planning code of the Russian Federation or the Land code of the Russian Federation, information on possibility of connection of capital construction projects to centralized systems of hot water supply, cold water supply and (or) water disposal can be requested by public authority, local government body according to the procedure, provided by paragraph one of this Item, for the purpose of, not connected with preparation of the development plan for a land plot.

In case of receipt to the contractor of request from public authority, local government body in the cases provided by the Town-planning code of the Russian Federation or the Land code of the Russian Federation as a part of information specified in the paragraph the second this Item it is determined including the term during which the owner of the parcel of land can address the contractor for the purpose of the conclusion of the agreement on connection providing to it the connected capacity (loading) within the maximum capacity (loading) in possible points of accession specified in information on possibility of connection of capital construction projects to centralized systems of hot water supply, cold water supply and (or) water disposal. The specified term cannot constitute less than 3 months from the date of submission by the contractor of information on possibility of connection (technological accession) of capital construction projects to centralized systems of hot water supply, cold water supply and (or) water disposal.

7(1). During receipt of specifications, the conclusion of the agreement on connection and execution of the act of connection the contractor provides possibility of giving by the applicant of request about issue of specifications (if necessary) or statements for connection and exchange between the contractor and the applicant of documents in any manner (by means of the personal address, mail service, the official site of the contractor on the Internet (further - Internet network), the single portal). For the purpose of possibility of receipt of specifications, the conclusion of the agreement on connection and execution of the act of connection with use of the single portal the contractor shall provide information and technological interaction of information systems of the contractor with the single portal.

In case of giving by the applicant of request about issue of specifications (if necessary) or statements for connection by means of the official site of the contractor in Internet network further exchange between the contractor and the applicant of documents is electronically performed by means of the specified website without use of the single portal.

Exchange between the contractor and the applicant of documents electronically in the cases provided by these rules is performed by the same method in which the applicant are served request about issue of specifications (if necessary) or the statement for connection.

The contractor and applicant who are legal entities or individual entrepreneurs for the purpose of implementation of the procedure of connection sign the documents provided by these rules electronically with use of the strengthened qualified digital signature. The applicant - physical person signs the documents provided by these rules electronically by means of the website of the contractor in Internet network the simple digital signature, and by means of the single portal - and is used by the simple digital signature or the strengthened unqualified digital signature which certificate of key of check is created in the infrastructure providing information and technological interaction of the information systems used for provision of the state and municipal services and execution of the state and municipal functions electronically.

By means of the single portal the possibility of giving by the applicant of request about issue of specifications (if necessary) or statements for connection, exchange between the contractor and the applicant of documents electronically and realization of other rights and obligations arising at the contractor and the applicant during the procedure of connection, in real time is provided. For the purposes of these rules the mode of real time is understood as such mode of information processing in case of which actions of users of the single portal are fixed, and information on making or non-execution by the user of the single portal of action goes to other interested users of the single portal according to the order of interaction of the contractor and applicant provided by these rules during the procedure of connection.

If giving of request about issue of specifications (if necessary) or statements for connection and exchange of documents are electronically performed by means of the official site of the contractor in Internet network, information on procedure for issue to the applicant and uses of the identifier and the password by it is posted on the specified website. For receipt of the identifier and the password the applicant undergoes the procedure of registration on the specified website with use of the insurance number of the individual ledger account of the applicant - for physical persons, the primary state registration number of the individual entrepreneur and identification taxpayer number - for individual entrepreneurs, the primary state registration number and identification taxpayer number - for legal entities. The applicant bears responsibility for reliability and completeness attached to the specified request or to the statement for connection of documents electronically in accordance with the legislation of the Russian Federation.

At the same time the contractor provides acceptance on the official site of the contractor in Internet network of request about issue of specifications (if necessary) or statements for connection and exchange of documents electronically, including possibility of free receipt by applicants of the identifier and the password, and also possibility of receipt by applicants of data on the main processing stages of the specified request or the statement for connection in real time without use of the software which installation on technical means of the applicant requires the conclusion of license or other agreement with the owner of the software providing collection from the applicant of payment and without use of special hardware.

When giving request about issue of specifications (if necessary) or statements for connection and documents attached to them according to Items 5, of 13, of 14 and 25 - 27 these rules, and also in case of execution of the act of connection which are performed by means of the single portal the possibility of automatic filling of fields of interactive forms of the specified request, statements for connection and the act of connection with use of documents (data) determined by the Government of the Russian Federation according to the subitem "i" of Item 7 of the Regulations on the federal state information system "Single Portal of the State and Municipal Services (Functions)" approved by the order of the Government of the Russian Federation of October 24, 2011 No. 861 "About the federal state information systems providing electronic submission of the state and municipal services (implementation of functions)" is provided to the applicant.

In case of the specified automatic filling of fields of interactive forms the applicant has the right not to attach the documents confirming information containing in automatically the filled fields to such forms.

The terms of consideration by the contractor of request provided by these rules about issue of specifications (if necessary) or statements for connection are estimated from the date of receipt to the contractor of the specified request, statements for connection and documents attached to them.
