I ORDER:

1. Bring in the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of March 5, 2022 No. 86 "About approval of Rules of reference of types of economic activity to classes of professional risk" (it is registered in the Register of state registration of regulatory legal acts for No. 27085) the following change:

The rules of reference of types of economic activity to classes of professional risk approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to department of work and social partnership of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on official Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan to provide to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the first vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan Sarbasov A. A.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of reference of types of economic activity to classes of professional risk

Chapter 1. General provisions

1. These rules of reference of types of economic activity to classes of professional risk (further – Rules) are developed according to Item 3 of Article 17 the Law of the Republic of Kazakhstan "About compulsory insurance of the worker from accidents in case of execution of labor (office) obligations by it" and determine procedure for reference of types of economic activity to classes of professional risk.

Chapter 2. Reference of types of economic activity to classes of professional risk

2. Classification of types of economic activity allocates 22 classes of professional risk.

3. As basic data for reference of types of economic activity to classes of professional risk the following statistics for the last five years are used:

annual average payroll number of workers by the form economic activity, people;

the number of the workers occupied in harmful and other adverse conditions of work by separate types of economic activity, people.;

the number of the victims in case of accidents connected with labor activity, the person;

the number of the dead in case of accidents connected with labor activity, the person;

the annual added benefits amount the victim in case of accidents, connected with labor activity, including the average size of accrued benefits on one victim of accident;

the annual amount of accrued benefits in case of the death of workers connected with labor activity including the average size of accrued benefits;

the annual amount of the awards paid to the insurer for adoption by the last of the obligation to make insurance payment to the beneficiary in the amount of, defined by the agreement of compulsory insurance of the worker from accidents;

annual salary fund by the form economic activity;

losses of working hours – number of calendar man-days of disability which ended in reporting year at victims, including the dead.

4. Types of economic activity are carried to classes of professional risk on the basis of values of stated below indicators:

specific weight of the workers occupied in harmful and other adverse conditions of work by types of economic activity, %;

coefficient of frequency of accidents of injury rate on production on 1000 workers;

coefficient of frequency of accidents with lethal outcome on 1000 workers;

ratio of coefficient of frequency of accidents with lethal outcome on 1000 workers to coefficient of frequency of all accidents of injury rate on production on 1000 workers;

distribution of number of victims by types of economic activity, %;

distribution of number of busy workers in harmful and other adverse conditions of work by types of economic activity, %;

ratio of the annual added benefits amount the victim in case of accidents, connected with labor activity and the annual amount of accrued benefits in case of the death of workers connected with labor activity to the annual salary fund by the form of economic activity, %;

ratio of the annual added benefits amount the victim in case of accidents, connected with labor activity and the annual amount of accrued benefits in case of the death of workers connected with labor activity to the annual amount of the awards paid to the insurer by the form of economic activity, %.

5. Reference of types of economic activity to classes of professional risk was made according to stated below six stages:

1) at the first stage, on the five-digit level of classification of types of economic activity on the basis of arithmetic average of value of statistics for the last five years calculation of the indicators specified in item 4 of these rules was made.

As the main indicator the coefficient of frequency of all accidents of injury rate on production on 1000 workers is accepted;

2) at the second stage, determination of general set of types of the economic activity which is subject to reference to classes of professional risk on the basis of allocation of all subspecies of economic activity on the five-digit level of classification dominating on specific weight of victims in the corresponding type of economic activity whose coefficient of frequency of accidents of injury rate on production on 1000 workers exceeds republican indicator;

3) at the third stage, by each type of economic activity of general set ranks in ascending order of values were appropriated to indicators: the smallest value (zero) has rank 1, the greatest value – the rank equal to number of values of the corresponding indicator, different in size, by all types of economic activity (to equal values the identical rank was appropriated);

4) at the fourth stage, by each type of economic activity of general set the weighted average values of ranks and their total size were calculated;

5) at the fifth stage, intervals on the basis of quantitative (orderings of data from minimum to maximum taking into account average value by all set) and professional risk high-quality (equal to total quantity of classes) signs of group were determined;

6) at the sixth stage, all types of economic activity were carried on classes of professional risk according to accessory of their total size of the weighted average values of ranks, to the corresponding interval.

6. Types of economic activity belong to the classes of professional risk according to appendix, to these rules.
