About modification of the Procedure for return of illegal government assistance, inadmissible for the competition

The Cabinet of Ministers of Ukraine decides:

Bring in the Procedure for return of illegal government assistance, inadmissible for the competition, No. 468 approved by the resolution of the Cabinet of Ministers of Ukraine of July 4, 2017 (The Official Bulletin of Ukraine, 2017, No. 57, the Art. 1696), changes which are applied.

Changes which are made to the Procedure for return of illegal government assistance, inadmissible for the competition

1. To add Item 8 after paragraph one with the new paragraph of the following content:

"If at the expense of illegal government assistance financing of other subject of managing was performed, such government assistance shall be returned by that receiver of illegal government assistance to whom it was provided.".

With respect thereto paragraphs two and third to consider respectively paragraphs the third and fourth.

2. In Item 12:

Paragraph two to state 1) in the following edition:

"The authorized body can stop according to the statement of suppliers and/or receivers current of the term determined by Items 11 and 12 of this Procedure for availability of the bases of impossibility of performance of the decision of Authorized body, in particular, of lawsuit which subject is the illegal government assistance, or the related lawsuit.";

The paragraph third to exclude 2).
