About approval of some provisions

For the purpose of ensuring protection of the territory of the Republic of Moldova against infectious diseases for animals according to the Law N1538-XII of June 23, 1993 on veterinary activities the Government DECIDES:

1. Approve:

Regulations on conditions and the procedure of sanitary and veterinary authorization of the companies which are subject sanitary veterinary to control and the state veterinary supervision according to the appendix N1;

Regulations on conditions and the procedure of issue of the sanitary and veterinary import permit, export or transit of goods, subjects to control state sanitary veterinary, according to the appendix N2.

2. To Customs Service to require from economic agents, physical persons or legal entities of presentation of the sanitary and veterinary import permit, export or transit before provision of customs regime to goods, subjects to control state sanitary veterinary, and in cases of discrepancy of the data reflected in the sanitary and veterinary import permit, export or transit to prohibit the data containing in accompanying documents transportation of goods through frontier.

3. To impose control over the implementation of this resolution on the Ministry of Agriculture and the food industry.

Regulations on conditions and the procedure of sanitary and veterinary authorization of the companies which are subject sanitary veterinary to control and the state veterinary supervision

I. General provisions

1. The regulations on conditions and the procedure of sanitary and veterinary authorization of the companies which are subject sanitary veterinary to control and the state veterinary supervision (further - provision) are developed based on the Law N1538-XII of June 23, 1993 on veterinary activities (The monitor, 1993, Art. N8 239).

2. This provision establishes conditions and the procedure of sanitary and veterinary authorization of the companies which are subject sanitary veterinary to control and the state veterinary supervision.

3. The basic concepts used in this provision have the following values:

the central veterinary body - management of veterinary medicine (further - UVM) - the central body of the public veterinary service which is component of the Ministry of Agriculture and food industry and submitting to it, responsible for implementation of policy and strategy in sanitary and veterinary area for determination of competences, obligations and responsibility of the public territorial sanitary and veterinary services, notification and monitoring of diseases at animals;

the public territorial sanitary and veterinary sluzhbyrayonny or municipal public sanitary and veterinary services according to the administrative-territorial device directly responsible for application of zoosanitary measures in the administered territory, subordinated according to field of activity to the central veterinary body;

sanitary and veterinary authorization on the funktsionirovaniyeofitsialny document issued by the public territorial sanitary and veterinary service based on which the companies which are subject sanitary veterinary to control and the state veterinary supervision can function;

the technical act - the statement which is drawn up by the state veterinarian as a result of monitoring procedure at the company which is subject sanitary veterinary to control and the state veterinary supervision for the purpose of ascertaining of sanitary provision of this company and making recommendations of issue or lack of distribution to it authorization;

the companies which are subject sanitary veterinary to control and the state veterinary supervision - the companies which make overwork, store, transport and master, realize raw materials and animal products, pharmaceutical products (biological products and drugs of veterinary appointment) and other means of veterinary appointment, forage, and also the company which provide cultivation and reproduction of animals, the veterinary help, including veterinary laboratories;

products which are subject to control state sanitary veterinary - animals, raw materials and animal products, biological products and drugs of veterinary appointment, products for feeding, prevention, medical diagnostics, treatment, correction, recovery and the amendment of the physiological status, etc. of animals, and also other products and raw materials which can affect the state of health of animals, veterinary health of society and the environment.

II. The procedure of sanitary and veterinary authorization on functioning of the companies which are subject sanitary veterinary to control and the state veterinary supervision

4. The companies which are subject sanitary veterinary to control and the state veterinary supervision can function only in the presence at them authorization of the Public sanitary and veterinary service.

5. Management of the companies which are subject sanitary veterinary to control and the state veterinary supervision shall petition before the public territorial sanitary and veterinary service for issue of sanitary and veterinary authorization to them on functioning, having specified each type of activity which requires permission.

6. In case of each subsequent change of engineering procedure, for upgrade, expansions or for change of profile of activities it is necessary to request issue of new sanitary and veterinary authorization on functioning.

7. For receipt of sanitary and veterinary authorization on functioning of the company, subject sanitary veterinary to control and the state veterinary supervision, give packet of the following documents to territorial public sanitary and veterinary service:

a) the standard statement provided in the appendix N1 to this provision;

b) copy of the certificate on state registration of the company;

c) copy of the document on property or leases of the room;

d) draft copy of arrangement of construction;

e) the copy of the act of transfer for work of the veterinarian on the company which gives sanitary and veterinary help, makes, stores, sells pharmaceutical and other products of veterinary appointment, and to the companies for production of meat and milk provided in the appendix N7 to this provision;

f) if necessary - the technical scheme of the company with indication of engineering procedure.

When giving document package for receipt of sanitary and veterinary authorization on functioning the applicant shall show and originals of documents for reconciliation of copies with originals.

8. The public territorial sanitary and veterinary service checks correctness of documents and sends them to the competent state veterinarian in whose radius of activities there is company.

9. The state veterinarian in whose radius of activities there is company checks the company for its compliance to the authorization conditions established by the operating sanitary and veterinary regulations.
