About approval of Changes in some regulatory legal acts concerning road transportation of dangerous goods

According to Articles 16, 19 Laws of Ukraine "About transportation of dangerous goods", the Law of Ukraine "About accession of Ukraine to the European agreement on the international road delivery of dangerous goods (DOPOG)", article 52-1 of the Law of Ukraine "About traffic", Item 9 of the Regulations on the Ministry of Internal Affairs of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of October 28, 2015 No. 878, the resolution of the Cabinet of Ministers of Ukraine of October 31, 2007 No. 1285 "About approval of the Procedure for carrying out special training of workers of subjects of transportation of dangerous goods" for the purpose of simplification of legal regulation and reduction of administrative load of citizens and business in the field of provision of administrative services in questions of road transportation of dangerous goods ORDER:

1. Approve Changes in some regulatory legal acts concerning road transportation of dangerous goods which is applied.

2. To the head service center Ministry of Internal Affairs () provide to Moiseenko E. submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the deputy minister according to distribution of functional obligations.

Changes to some regulatory legal acts concerning road transportation of dangerous goods

1. In Rules of road transportation of the dangerous goods approved by the order of the Ministry of Internal Affairs of Ukraine of August 04, 2018 No. 656, registered in the Ministry of Justice of Ukraine on September 11, 2018 No. 1041/32493:

1) in the Section I:

in the paragraph the second item 4 of the word and figure "Rules of nuclear and radiation safety in transit of the radioactive materials approved by the order of the State committee of nuclear regulation of Ukraine of August 30, 2006 No. 132, registered in the Ministry of Justice of Ukraine on September 18, 2006 No. 1056/12930" shall be replaced with words also in figures "Rules of safe transportation of radioactive materials (PBPRM-2020), No. approved by the order of the State inspection of nuclear regulation of Ukraine of October 27, 2020 436, registered in the Ministry of Justice of Ukraine on December 30, 2020 for No. 1313/35596";

in paragraph seven of the subitem 3 of Item 9 of the word "DOPNV-svidetelstvo" shall be replaced with words "certificate DOPNV";

2) in the Section IV:

in paragraph one of Item 1 of the word and figures "The technical regulation of pyrotechnic products approved by the resolution of the Cabinet of Ministers of Ukraine of August 03, 2011 No. 839" shall be replaced with words also in figures of "The technical regulation of pyrotechnic products approved by the resolution of the Cabinet of Ministers of Ukraine of January 05, 2021 No. 8";

state Item 9 in the following edition:

"9. The movable equipment working under pressure which is used for domestic road transports of gases of class 2, shall conform to requirements of the Technical regulation of the mobile equipment working under pressure, approved by the resolution of the Cabinet of Ministers of Ukraine of July 04, 2018 No. 536";

"Information displays" in all cases shall be replaced with words 3) in the text of Rules of the word "big signs of danger" in the corresponding cases;

4) in appendix 3 to Rules of the word "flammable gases" in all cases shall be replaced with words "combustible gases" in the corresponding cases.

2. According to the procedure of issue and execution of certificates on the admission of vehicles to transportation of certain dangerous goods approved by the order of the Ministry of Internal Affairs of Ukraine of August 04, 2018 No. 656, No. 1042/32494 registered in the Ministry of Justice of Ukraine on September 11, 2018:

In paragraph six of item 4 of the Section I the word "flammable" to replace 1) with the word of "flammable";

2) in the Section II:

in item 4 to replace the word "it" with the word "them";

in Item 5 of the word "special training (preparation) in questions the admission of vehicles to transportation of dangerous goods" shall be replaced with words "examination on questions the admission of vehicles to transportation of dangerous goods";

state Item 6 in the following edition:

"6. for obtaining/prolongation of the certificate the vehicle owner, carrier or person authorized by them sends the vehicles completed according to appointment, and also the following documents to STs:

the statement on issue (prolongation) of the certificate on assumption of vehicles to transportation of certain dangerous goods (further - the statement) which model is given in appendix 1 to this Procedure;

The certificate (in case of its prolongation or replacement);

the payment document (receipt) certifying payment of cost of the form of the certificate and the state service in execution of the certificate;

for vehicles with departmental registration (except vehicles of the Armed Forces of Ukraine), information on which is absent in the Unified state register of the Ministry of Internal Affairs, - the copy of the document on check of technical condition of the vehicle in accordance with the established procedure;

if the vehicle has the built-in tanks (except mixing and charging machines with tanks with a capacity less than 1000 l), - the copy of the existing certificate on primary, additional, recurring and unscheduled inspection of the tank issued by the subject of the managing, the representative on conducting check of tanks according to the Procedure for test of tanks for transportation of dangerous goods approved by the order of the Ministry of infrastructure of Ukraine, the Ministry of Internal Affairs of Ukraine of May 12, 2015 No. 166/550, No. 663/27108 registered in the Ministry of Justice of Ukraine on June 05, 2015;

if the vehicle has the built-in tanks (except mixing and charging machines with tanks with a capacity less than 1000 l) which are used for transportation of gases of class 2, the applicant represents the copy of the valid certificate on compliance or the certificate on carrying out revaluation of compliance, and also the copy of the valid document confirming conducting periodic, intermediate inspection or the exclusive check issued according to the Technical regulation mobile

the equipment working under pressure, approved by the resolution of the Cabinet of Ministers of Ukraine of July 04, 2018 No. 536.

The statement and documents attached to it are filed personally by the vehicle owner, carrier or person authorized by them, or go by mail with the inventory of investment in paper form with the assurance of receipt, or electronically with observance of requirements of the legislation on electronic documents and electronic document management.

Officials of STs check the data containing in the statement and documents attached to it according to registers and databases, access to which has the Ministry of Internal Affairs.
