About measures for reorganization of agricultural enterprises in farms

For the purpose of enhancement of the economic relations in the village, strengthenings of regulatory framework of reorganization of unprofitable and low-profitable agricultural enterprises in farms, the Cabinet of Ministers decides forming of favorable conditions for their economic activity:

1. Agree with the offer of Government commission on sanitation of agricultural enterprises about reorganization in 2002 of unprofitable and low-profitable agricultural enterprises in farms according to appendices No. 1 and 1 and.

Approve:

offers of khokimiyats of the Syr Darya and Fergana regions on transformation of agricultural enterprises of Mekhnatabadsky, Mirzaabadsky and Yazjyavansky districts in full in farms;

the structure of sowings of agricultural crops on Mekhnatabadsky and Mirzaabadsky districts of the Syr Darya region for 2002 recommended by the Ministry of agricultural and water economy of the Republic of Uzbekistan according to appendix No. 2.

2. Approve:

task on the organization of infrastructure facilities in Mekhnatabadsky and Mirzaabadsky districts of the Syr Darya region in 2002 according to appendix No. 3;

Standard regulations on the commission on reorganization of agricultural enterprise in farms according to appendix No. 4;

Procedure for carrying out selection and tender of applicants for the organization of farm based on the reorganized agricultural enterprise according to appendix No. 5;

Procedure for asset allocation and liabilities by reorganization of agricultural enterprises in farms according to appendix No. 6;

Procedure for regulation of water management relations in the territory of the reorganized agricultural enterprises according to appendix No. 7;

rules of crediting by commercial banks of again organized farms according to appendix No. 8.

3. The republican commission on deepening of economic reforms in agricultural industry together with the Ministry of Agriculture of the Republic of Uzbekistan, the State committee of the Republic of Uzbekistan on land resources, geodesy, cartography and the state inventory, the Research and production center of agricultural industry, Council of farmer, Dehkan farms and owners of garden plots of Uzbekistan, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas:

provide reorganization of unprofitable and low-profitable agricultural enterprises in farms in strict accordance with appendices No. No. 4 - 7;

according to the regulations approved by this resolution to develop on specific examples and to bring the methodical recommendations covering everything aspects of creation of farms based on the reorganized farms to places;

in a month to organize special seminars on places on explanation of processes of reorganization of agricultural enterprises in farms;

establish systematic monitoring of the course of reorganization of agricultural enterprises in farms.

4. To provide to JSB Agrobank, JSB Kishlok kurilish bank, other servicing commercial banks, the Uznefteprodukt and Uzkimesanoat companies, the Ministry of agricultural and water economy of the Republic of Uzbekistan, Council of Ministers of the Republic of Karakalpakstan and khokimiyats of areas creation in the territory of the reorganized agricultural enterprises of the following objects of market and production infrastructure:

branch of commercial bank;

warehouses of territorial joint-stock companies "Uzkishlokhuzhalikkime" SAC Uzkimesanoat on supply of farms with mineral fertilizers and other chemical means;

branch of the respective petroleum storage depot of the Uznefteprodukt company on supply of farms with fuels and lubricants;

the alternative machine and tractor park based on the available equipment of the reorganized agricultural enterprise;

association of water consumers on self-supporting basis (for regulation of water management relations in the territory of the reorganized farms).

5. To the ministry of agricultural and water economy of the Republic of Uzbekistan and Uzagromashservice association in ten-day time to develop and approve recommendations by training of the machine and tractor park about maintenance Dehkan and the farms created based on the reorganized agricultural enterprises.

6. For the purpose of stimulation of development production, financial and material and technical resources of the objects of market infrastructure created in the territory of the reorganized farms to exempt according to the procedure of exception:

divisions on providing farms with mineral fertilizers and fuels and lubricants from the tax discharge on property and the earth for a period of two years;

Determine that the alternative machine and tractor parks created in the territory of the reorganized agricultural enterprises under the terms of the taxation and to calculations for the services (plowing, crops, processing, cleaning, etc.) rendered to agricultural producers are equated to machine and tractor parks of the territorial organizations of JSC Uzagroservice.

7. Determine that:

objects of social infrastructure of the reorganized agricultural enterprises after carrying out inventory count are estimated by the estimative organization according to the procedure, established by the legislation taking into account market prices of the revaluation moment;

the preschool institutions, schools and rural medical Items which are on balance of the reorganized agricultural enterprise are transferred to fixed assets of regional authorities and management in accordance with the established procedure;

other objects of social infrastructure, pipeline highways and gas distribution points, power lines, intereconomic irrigational constructions after revaluation are transferred to fixed assets according to the Uzkommunkhizmat agency, the interregional unitary enterprises of JSC Uztransgaz, the Uzbekenergo company, territorial subdivisions of the Ministry of water economy and other organizations in accordance with the established procedure.

8. To provide to Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas, the Ministry of Justice of the Republic of Uzbekistan, Chamber of Commerce and Industry of the Republic of Uzbekistan, Council of farmer, Dehkan farms and owners of garden plots of Uzbekistan together with the interested ministries and departments creation of necessary network of legal and consulting services, and also the non-state procurement and trade and intermediary organizations on servicing of farms and other subjects of the market.

9.
