1. The rules of receipt of preschool, primary, main secondary and general secondary education by the foreigners and stateless persons who are constantly living in the Republic of Kazakhstan, approved by the specified order to be reworded as follows according to appendix to the present.

2. To provide to committee of secondary education of the Ministry of Public Education of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on the Internet resource of the Ministry of Public Education of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Legal department of the Ministry of Public Education of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of education of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of receipt of preschool, primary, main secondary and general secondary education by the foreigners and stateless persons who are constantly living in the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of receipt of preschool, primary, main secondary and general secondary education by the foreigners and stateless persons who are constantly living in the Republic of Kazakhstan (further – Rules) are developed according to the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan "About education", "About legal status of foreigners", "About refugees", "About population shift", and also the international treaties ratified by the Republic of Kazakhstan and regulate procedure for receipt of preschool, primary, main secondary and general secondary education in the organizations of education irrespective of their pattern of ownership by the foreigners and persons without citizenship who are constantly living in the Republic of Kazakhstan.

2. The children of foreigners and stateless persons who are constantly living in the Republic of Kazakhstan and also persons who are temporarily living in the Republic of Kazakhstan (the refugees, persons who are looking for shelters, the consular officials, employees of diplomatic organizations, labor migrants working in the Republic of Kazakhstan according to the migratory legislation) are accepted in the organization of education for receipt of preschool, primary, main secondary and general secondary education and citizens of Kazakhstan have the same rights, as well as.

Chapter 2. Procedure for receipt of preschool, primary, main secondary and general secondary education by foreigners and stateless persons, constantly living in the Republic of Kazakhstan, and also driven to the Republic of Kazakhstan for the purpose of reunion of family

3. Parents or other legal representatives of children of foreigners and stateless persons aged up to 16 years, in case of determination of the child in the organization of education, address to governing bodies of formation of area, city of republican value, the capital, area (city of regional value) for receipt of the direction for training, and submit the document on the right of permanent residence in the Republic of Kazakhstan:

the foreigner - type on the foreigner's residence in the Republic of Kazakhstan;

the stateless person - the certificate of the stateless person;

the refugee – the certificate of the refugee;

person who is looking for shelter - the certificate of person who is looking for shelter;

кандас - the certificate of kandas or the reference of bodies of migration.

Governing bodies of formation of area, city of republican value, capital, area (city of regional value) following the results of consideration are returned to the applicant by the document on the right of permanent residence in the Republic of Kazakhstan for submission to the organization of education.

4. Governing bodies of formation of area, city of republican value, capital, area (city of regional value) within three working days from the date of receipt of the statement according to appendix 1 from persons specified in Item 3 of these rules determines the organization of education having surplus of student places by form, issues purposely the direction for training in the organization of secondary education for form according to appendix 2 to these rules.

5. The parent or other legal representatives after receipt of the direction for training, files the following paper documents to the organization of education:

1) the statement of parents or other legal representatives according to appendix form 3;

2) the document determining the status of the parent or other legal representative with mark about registration in the place of residence (the original is required for identification which returns):

the foreigner - the residence permit of the foreigner in the Republic of Kazakhstan;

the stateless person - the certificate of the stateless person;

the refugee - the certificate of the refugee;

person who is looking for shelter - the certificate of person who is looking for shelter;

кандас - the certificate of kandas or the reference of bodies of migration.

3) the medical certificate about the state of health (the form No. 065/at approved by the order of the acting minister of health care of the Republic of Kazakhstan of October 30, 2020 No. KR DSM-175/2020 "About approval of forms of accounting documentation in the field of health care and also instructions for their filling" (it is registered in the Register of state registration of regulatory legal acts at No. 21579) and the form No. 026/u-3, approved by the order of the Minister of Health of the Republic of Kazakhstan of June 24, 2003 No. 469 "About approval of the Instruction for filling and maintaining the accounting form 026/u-3 "Passports of health of the child" (it is registered in the Register of state registration of regulatory legal acts at No. 2423);

4) the direction for training in the organization of secondary education;

5) photos of the child of 3х4 cm in size in number of 2 pieces;

6) report card or reference statement of the current estimates.

6. Heads of the organizations of education in case of acceptance on training of children of persons who are not citizens of the Republic of Kazakhstan will request from one of documents parents of the specified children or other legal representatives, specified in the subitem 2) of Item 5 of these rules.

In case of refusal of parents or other legal representatives of children of submission of the specified documents, heads of the organization of education without delay inform law-enforcement bodies.

7. Heads of the organizations of education enlist in number of the studying children of foreigners and stateless persons on the corresponding classes proceeding from the education level received by them abroad according to education documents, successful socialization of the child in the studying circle in case of the number of children of citizens of the Republic of Kazakhstan at least 85% of payroll number of children of this class.

In the absence of education documents the city (district) department of education creates the commission which determines the educational level of the applicant according to subitem 1-13) of Item 1 of article 27 of the Law of the Republic of Kazakhstan "About local public administration and self-government in the Republic of Kazakhstan".

Transfer is carried out by the decision of the head of the organization of education based on the decision of the commission to number of students.

8. The organization of education no later than three working days places data on acceptance on training of children of foreigners and stateless persons in the National educational database.

9. The foreigners who are temporarily living in the Republic of Kazakhstan receive the relevant documents on education depending on training terms (the certificate about the main secondary education, the certificate about general secondary education, in case of not completion of the education level - the sheet about progress or the reference statement from the cool magazine with estimates in objects, the organizations of education certified by seal).
