Based on article 23 of the Law of the Republic of Belarus of August 27, 2008 "About state regulation of production and turnover of alcoholic, non-food alcohol-containing products and non-food ethyl alcohol, Item 26-1 of the Regulations on state regulation of production, turnover and consumption of the tobacco raw materials and tobacco products approved by the Decree of the President of the Republic of Belarus of December 17, 2002 No. 28 "About state regulation of production, turnover and consumption of tobacco raw materials and tobacco products" the Ministry of Internal Affairs of the Republic of Belarus and the State Customs Committee of the Republic of Belarus DECIDE:
1. Approve the enclosed Instruction about procedure for obligatory support of Department of protection of the Ministry of Internal Affairs of the Republic of Belarus by divisions of the alcoholic, non-food alcohol-containing products and non-food ethyl alcohol, tobacco raw materials and tobacco products moved on the territory of the Republic of Belarus with road transport.
2. This resolution becomes effective since December 1, 2006.

1. The instruction about procedure for obligatory support of Department of protection of the Ministry of Internal Affairs of the Republic of Belarus by divisions of alcoholic, non-food alcohol-containing products and the non-food ethyl alcohol, tobacco raw materials and tobacco products moved on the territory of the Republic of Belarus with road transport (further - the Instruction), is developed based on article 23 of the Law of the Republic of Belarus of August 27, 2008 "About state regulation of production and turnover of alcoholic, non-food alcohol-containing products and non-food ethyl alcohol" (The national register of legal acts of the Republic of Belarus, 2008, No. 212, 2/1526), Item 26-1 of the Regulations on state regulation of production, turnover and consumption of the tobacco raw materials and tobacco products approved by the Decree of the President of the Republic of Belarus of December 17, 2002 No. 28 "About state regulation of production turnover and consumption of tobacco raw materials and tobacco products" (The national register of legal acts of the Republic of Belarus, 2002, No. 143, 1/4234), also establishes single requirements to procedure for obligatory support of Department of protection of the Ministry of Internal Affairs of the Republic of Belarus by divisions (further - divisions of Department of protection) imported (intended for export) on customs area of the Republic of Belarus from customs area of the State Parties of the Agreement on the Customs union and the Common economic space of February 26, 1999 of alcoholic products (except for the imported alcoholic beverages marked by excise stamps), the non-food alcohol-containing products and non-food ethyl alcohol moved on the territory of the Republic of Belarus with road transport or moved with transit through customs area of the Republic of Belarus road transport and also tobacco raw materials and tobacco products, moved with transit through customs area of the Republic of Belarus road transport (further - obligatory maintenance of products).
2. Action of this Instruction does not extend to the obligatory maintenance of the products which are under customs control and moved with road transport, performed according to the resolution of the Ministry of Internal Affairs of the Republic of Belarus and the State Customs Committee of the Republic of Belarus of August 2, 2006 No. 208/61 "About approval of the Instruction about procedure for maintenance and protection by Department of protection of the Ministry of Internal Affairs of the Republic of Belarus of the goods which are under customs control and moved with road transport" (The national register of legal acts of the Republic of Belarus, 2006, No. 132, 8/14850).
3. The customer in this Instruction is understood as the legal entity, physical person or the individual entrepreneur (далеелицо) which on the property right, economic maintaining, operational management possesses products which are subject to obligatory maintenance, and also person which is carrier or the freight forwarder of these products.
4. Import to the territory of the Republic of Belarus from the territory of the Russian Federation and export from the territory of the Republic of Belarus on the territory of the Russian Federation of products which are subject to obligatory maintenance are performed in the places determined by the resolution of Council of Ministers of the Republic of Belarus of November 29, 2005 No. 1346 "About movement of the vehicles used for international carriages through the Belarusian-Russian border" (The national register of legal acts of the Republic of Belarus, 2005, No. 191, 5/16856) for movement of automotive vehicles through the Belarusian-Russian border.
5. Obligatory maintenance of products is performed by divisions of Department of protection based on the agreement on rendering security (paid) services in protection of the loads moved with transport signed with the customer (further - the agreement) which form is approved by the resolution of Council of Ministers of the Republic of Belarus of February 11, 2005 No. 154 "About measures for implementation of the Decree of the President of the Republic of Belarus of August 19, 2004 No. 6" (The national register of legal acts of the Republic of Belarus, 2005, No. 26, 5/15592).
6. For the conclusion of the agreement the customer needs to fill and send to one of divisions of Department of protection according to the list according to appendix 1 to this Instruction the request for obligatory maintenance of products in form according to appendix 2 to this Instruction (further - the request) in which are specified:
brands, quantity and registration signs of vehicles with products which are subject to obligatory maintenance;
the name of products which are subject to obligatory maintenance;
traffic route of vehicles with products which are subject to obligatory maintenance;
time and date of arrival of staff of division of Department of protection in the point of departure;
surnames, names, middle names, data of the identity document of the customer representatives transferring to the staff of division of Department of protection vehicles with products which are subject to obligatory maintenance in the point of departure and accepting these vehicles in destination.
The request can go the customer as beforehand (before crossing of the Belarusian-Russian border by vehicles of the customer), and is direct from the places of crossing of the Belarusian-Russian border by vehicles of the customer established by the legislation of the Republic of Belarus. At the same time the vehicles of the customer which crossed the Belarusian-Russian border shall remain in the point of departure before arrival of the staff of division of Department of protection appointed for implementation of obligatory maintenance of products.
7. The number of the employees of division of Department of protection appointed for implementation of obligatory maintenance of products and the following on office vehicles on the traffic route established for this purpose (further - the job specification of maintenance), is determined by the commander of front division of militia of division of Department of protection proceeding from assessment of operational situation and possibility of ensuring obligatory maintenance of products.
8. Arrival time of the job specification of maintenance to the point of departure shall not exceed eight hours from the moment of receipt of the request by division of Department of protection if other is not specified in the request.
9. In case of acceptance of products which are subject to obligatory maintenance in the point of departure the senior of the job specification of maintenance shall:
make sure of powers of the customer representative based on reconciliation of its identity documents, with the data specified in the request;
be convinced of integrity of cargo sections of vehicles with products which are subject to obligatory maintenance, availability and integrity on them of seals, one-time sealing materials;
verify compliance of registration signs of vehicles with products which are subject to obligatory maintenance to numbers specified in the agreement, the request and commodity transport documents;
check availability at the customer of commodity transport documents for products which are subject to obligatory maintenance.
10. Acceptance of products which are subject to obligatory maintenance by the job specification of maintenance in the point of departure and transfer to her customer after delivery of these products in the destination specified in the request are reflected in the delivery-acceptance certificate of products which are subject to obligatory maintenance according to appendix 3 to this Instruction and are certified by signatures of the authorized representative of the customer and employee who is the senior of the job specification of maintenance.
11. During following stoppages in transit on the established traffic route the job specification of maintenance performs external survey of vehicles with products which are subject to obligatory maintenance regarding integrity of cargo sections, availability and integrity on them of seals, one-time sealing materials, protection of these vehicles against illegal encroachments is provided.
During the stops caused by breakdowns of vehicles with products which are subject to obligatory maintenance on traffic route or owing to other reasons which are not allowing these vehicles to continue movement along the established route, the job specification of maintenance provides data protection of vehicles from illegal encroachments, and after elimination of the reasons of stop continues movement in destination.
12. During attack on vehicles with products which are subject to obligatory maintenance the job specification of maintenance takes measures to reflection of attack and detention of offenders, assistance to victims, establishment of witnesses and eyewitnesses, reports on attack in the nearest territorial authority of internal affairs or division of Department of protection and provides protection of the scene before arrival of operational-investigations group.
13. The products which are subject to obligatory maintenance delivered in destination are transferred to the authorized representative of the customer specified in the request. At the same time the senior of the job specification of maintenance shall make sure of powers of the customer representative based on reconciliation of its identity documents, with the data specified in the request.
14. If the accompanied products are delivered in Item of customs clearance, that authorized officer of customs in line 4 acts of priyemaperedacha of products which are subject to obligatory maintenance confirm the fact of its delivery by specifying of the surname and initials, having certified the specified record by print of personal number seal.
