I ORDER:

1. Bring in the order of the Minister of Internal Affairs of the Republic of Kazakhstan of December 26, 2014 No. 945 "About approval of Rules of the organization of the warning system of civil protection and the notification of the population, state bodies in case of emergency situations in peace and wartime", (No. registered in the Register of state registration of regulatory legal acts 10151) the following change:

Rules of the organization of the warning system of civil protection and the notification of the population, state bodies in case of emergency situations in peace and wartime, approved by the specified order to be reworded as follows, according to appendix to this order.

2. To department of informatization, digitalization and to provide communication of the Ministry of Emergency Situations of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Emergency Situations of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Emergency Situations of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Emergency Situations of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of the organization of the warning system of civil protection and the notification of the population, state bodies in case of emergency situations in peace and wartime

Chapter 1. General provisions

1. These rules of the organization of the warning system of civil protection and the notification of the population, state bodies in case of emergency situations in peace and wartime (further - Rules), are developed according to subitem 70-2) of Item 1 of article 12 of the Law of the Republic of Kazakhstan "About civil protection" which determine procedure for the organization and involvement of the warning system of civil protection and the notification of the population, state bodies in case of emergency situations in peace and wartime.

2. In these rules the following terms and determinations are used:

1) civil protection – the nation-wide complex of the events held in peace and wartime, directed to the prevention and liquidation of emergency situations of natural and technogenic nature and their effects, the organization and conducting civil defense, rendering emergency medical and psychological assistance to the population which is in zone of emergency situation, including actions for ensuring fire and industrial safety, forming, storage and use of the state material reserve;

2) forces of civil protection – military units of civil defense, rescue services and forming, divisions of the public and non-state fire service, forming of civil protection, aircraft of authorized body in the field of civil protection, service of observation, control of situation and forecasting;

3) services of civil protection – the republican, regional, city, district systems of governing bodies and forces of civil protection intended for accomplishment of special events of civil protection;

4) the warning system of civil protection (further - the warning system) – set of the program and technical means providing informing the population and state bodies on threat of life and to human health about operations procedure in the developed situation;

5) authorized body in the field of civil protection (further - authorized body) – the central executive body performing management and cross-industry coordination, development and realization of state policy in the field of civil protection regarding the prevention and liquidation of emergency situations of natural and technogenic nature, rendering emergency medical and psychological assistance to the population, ensuring fire safety and the organization of Civil defense;

6) notification signal "Attention to all!" – the single signal of the notification transmitted by means of sirens or other alarm means for drawing attention of the population in case of threat of origin or emergence of emergency situations;

7) the notification of the population about emergency situations is bringing to the notification signal population "Attention to all!" and emergency information on the dangers arising in case of threat of origin or emergence of emergency situations of natural and technogenic nature and also on rules of conduct of the population in the circumstances.

3. Task of the warning system is the timely, guaranteed and reliable bringing signals and information of the notification to the population and state bodies, and also year-round functioning and permanent readiness for application in all modes of functioning of the state system of civil protection in peace and wartime.

Chapter 2. Procedure for the organization of the warning system

4. The warning system will be organized on:

1) republican level – the republican warning system with scope of the territory of the Republic of Kazakhstan;

2) territorial level – the warning system of area, city of republican value, the capital with scope of the territories of area, city of republican value, the capital;

3) object level – the local warning system with object territory scope with mass stay of people, the hazardous production facility and the population getting to settlement zone of distribution of emergency situation.

5. The republican warning system provides finishing signals of the notification and information to:

1) populations of the Republic of Kazakhstan;

2) governing bodies of civil protection;

3) forces of civil protection;

4) territorial subdivisions of authorized body.

6. The warning system of area, city of republican value, the capital provides finishing signals of the notification and information to:

1) the area populations (part of the territory of area), the cities of republican value, the capital or to the population of the area, the city of regional value, the area in the city, the cities of district value, the settlement, the village, the rural district according to the order of the akim of the corresponding administrative and territorial unit;

2) local executive bodies and other state bodies;

3) emergency and emergency services;

4) forces of civil protection in the territory of the corresponding administrative and territorial unit.

7. The local warning system (further - LSO) provides finishing signals of the notification and information to:

1) the population getting to settlement zone of distribution of emergency situation;

2) employees of the organization operating hazardous production facility;

3) the physical persons which are in the territory of object with mass stay of people;

4) the rescue services and forming servicing hazardous production facilities;

5) heads and services of the legal entities on duty and dispatching located in settlement zone of distribution of emergency situation.

8. Creation, development and maintenance in permanent readiness of the republican warning system and warning system of area, city of republican value, the capital, including maintenance, planned and running repair of the equipment, the organization and content of communication channels of warning systems, is performed by authorized body, its territorial subdivisions and local executive bodies.

Determination of single technical policy on creation, fitting, upgrade and retrofitting of the capital (installed) equipment, and also the established software (licensed software) of the warning system is performed by authorized body.

9. The organization of placement of technical means of the notification and informing is performed by local executive bodies.

10. Creation, development and maintenance in permanent readiness of the warning system of object level, including operation, maintenance, planned and running repair of the equipment of warning systems, and also the organization and content of communication channels, necessary for their smooth functioning, including to the managing equipment of the warning system of territorial level, are performed by the organizations operating hazardous production facilities and hydraulic engineering constructions, objects with mass stay of people (further – the organizations).

11. Borders of the action area of LSO are borders of the territory (zones) of impact of dangerous factors from accidents on hazardous production facilities and hydraulic engineering constructions, with risk of damnification of life and to health of the population living or performing economic activity outside the territories of placement of these objects and constructions.

Borders of the action area of LSO are determined in case of development of the specification on creation (reconstruction):

hazardous production facilities according to action areas of the major striking factors (assessment of the action area of the major striking factors in case of different scenarios of accidents, incidents), the determined Rules of development of the declaration of industrial safety of hazardous production facility approved by the order of the Minister of investments and development of the Republic of Kazakhstan of December 30, 2014 No. 341 (it is registered in the Register of state registration of regulatory legal acts for No. 10257);

hydraulic engineering constructions according to the inundated areas, borders of zones of harmful effects on the environment determined by the Rules of development of the declaration of safety of dike approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of December 2, 2015 No. 19-2/1054 (it is registered in the Register of state registration of regulatory legal acts for No. 12660).

12. In case of placement of several hazardous production facilities and hydraulic engineering constructions operated by the different organizations in proximity from each other according to the joint solution of management of data of the organizations creation of single LSO is allowed.

At the same time each organization has the separate object warning system within the territory.

13. In case of hit of settlements to the action area of the major striking factors and the inundated area, borders of zones of harmful effects on the environment in case of possible accidents on hazardous production facilities and hydraulic engineering constructions, creation of the warning system of the specified settlements together with local executive bodies is allowed.

LSO are involved from the managing equipment of the warning system of territorial level.

14. Transfer information video and audiomessages by interruption of broadcasts of TV and radio broadcasting for the notification and informing the population, is performed according to the Law of the Republic of Kazakhstan "About TV and radio broadcasting".

15. In case of violation of work of networks of power supply and telecommunications, the notification of the population will be organized with use of available means of informing, cars of the notification of authorized body, office vehicles of the state bodies and services of civil protection having loud-speaking installations.

16. The authorized body and its territorial subdivisions for the purpose of the timely notification of governing bodies of the state system of civil protection about threat or emergence of emergency situations in peace and wartime, create lists of persons, for their notification with use of the existing technical means (further – lists of the notification).

Information for forming of lists is submitted governing bodies of the state system of civil protection to authorized body and its territorial subdivisions, monthly to the 5th day of the next month and/or without delay in case of change of the corresponding data.

17. For the purpose of ensuring reliability of warning systems of all levels, at least once a year readiness check by the republican of the warning system and at least once a quarter check of readiness of the territorial warning system with giving of single signal of the notification "Attention to all is performed!" and transfer of information messages to the population on mass media.

18. For implementation of technical check of the republican warning system and when carrying out republican doctrines on civil protection, the order on involvement of the warning system of republican level is made by the head of authorized body.

For implementation of technical check of the warning system of area, the city of republican value, the capital and conducting exercises on civil protection, the order on involvement of the warning system of territorial level is made by the head of territorial subdivision of authorized body.

Chapter 3. Procedure for the notification of the population and state bodies in case of emergency situations

19. The procedure for the notification consists in operational bringing to state bodies of information on threat or emergence of emergency situation for acceptance of adequate measures of reaction, and also bringing to the population of single signal of the notification "Attention to all!" and information messages about threat or emergence of emergency situation and operations procedure in the created conditions.

20. From the moment of receipt of information on emergency situations of global scale, the authorized body approves with the Prime Minister of the Republic of Kazakhstan – the chief of civil defense of the Republic of Kazakhstan involvement of the warning system of republican level by means of which the population, territorial subdivisions of authorized body, state bodies and local executive bodies is without delay notified.

In case of emergency situations of regional scale, the order about involvement of the warning system is made by the head of authorized body.

From the moment of receipt of information on emergency situation of local scale, the operations duty officer of UKS without delay informs CCCS and the head of territorial subdivision of authorized body which approves with the akim of the corresponding administrative and territorial unit, the order about involvement of the warning system of territorial level.

Heads of the organizations for team of the operations duty officer of UKS, or independently in case of threat or emergence of emergency situation on object, notify employees of the organization, rescue services, services on duty and dispatching and the population living in zone of distribution of emergency situation by involvement of warning systems of object level.

21. During action of emergency state, the order about involvement of the warning system of territorial level is made by the commandant of the area where state of emergency according to the Law of the Republic of Kazakhstan "About emergency state" is imposed.

22. After receipt of the order about involvement of the warning system, the operations duty officer of UKS will organize the notification of officials according to lists of the notification, and also giving of single signal of the notification "Attention to all is performed!" for drawing attention of the population.

23. From the moment of giving of single signal of the notification "Attention to all!", the operations duty officer of UKS will without delay organized transfer of information messages about emergency situation and operations procedure of the population in the circumstances by means of:

1) transfers information video and audiomessages by interruption of broadcast of channels of on-air TV and radio broadcasting;

2) transfers of text messages on networks of mobile operators on mobile phones of the population;

3) transfers of sound, graphical, text and voice messages with use of mobile applications on wireless data transmission networks;

4) transfers of sound and voice messages with use of sirenno-speech devices and mobile means of the notification of different departmental accessory;

5) transfers of text messages with use of information terminals in places of mass stay of the population;

6) placements of information on departmental Internet resource of authorized body and its territorial subdivisions, and also in other available mass media.

24. In case of involvement of signal of the notification "Attention to all!" the warning system provides the simultaneous and repeatedly repeated bringing information on threat or emergence of emergency situation to the population and operations procedure of people in the circumstances.

25. On notification signal "Attention to all!" the population uses available means of acceptance of information for obtaining and accomplishment of instructions about actions in the developed situation.

26. Information on threat or emergence of emergency situations of natural, technogenic and social nature, including use of modern weapons of destruction is created by services of observation, control of situation and forecasting, including seismological service, systems of the mudstone notification, control of radiation situation and other competent organizations irrespective of their pattern of ownership and transferred to managements in crisis situations of territorial subdivisions (further - UKS) and Crisis Management Centre (further - CCCS) the Ministry of Emergency Situations of the Republic of Kazakhstan.

Receipt of UKS and CCCS of the above-stated information is the basis for the organization of the notification of the population and state bodies according to Item 22 of these rules.

27. The procedure for the notification and finishing information on threat or emergence of emergency situations of natural, technogenic and social nature, including use of modern weapons of destruction, to staff of military units of Armed Forces, other troops and military forming of the Republic of Kazakhstan and the population of military camps is determined by the corresponding commanders of connections, parts and divisions together with territorial subdivisions of authorized body.

28. In case of involvement of warning systems, actions of operations duty officers UKS and texts of information messages are developed and accepted by territorial subdivisions of authorized body.
