Rules of form, registration and submission of the certificate of conformity and declaration of conformity

1. General provisions

1.1. These rules determine form, registration and submission of the certificate of conformity and declaration of conformity according to article 13.5 of the Law of the Azerbaijan Republic "About technical regulation".

1.2. The main terms used in these rules have the following values:

1.2.1. the certificate of conformity - the document of certain form confirming compliance of goods, the related processes and methods of production to requirements of the technical regulation;

1.2.2. the declaration of conformity - the document in certain form confirming compliance of goods, the related processes and production methods to requirements of the technical regulation;

1.2.3. safety of goods, the related processes and production methods - lack of cases of causing by goods, the related processes and production methods of harm of life and to human health, the environment, property and interests of the state;

1.2.8. assessment procedures of compliance - the corresponding procedures used for determination of fulfillment of requirements, provided by technical regulations;

1.2.9. schemes (modules) of assessment of conformity - the procedures intended for confirmation of conformity and their sequence;

1.2.10. conformity assessment body - the organizations, legal entities and physical persons accredited according to the Law of the Azerbaijan Republic "About accreditation in the field of assessment of conformity" and performing assessment of conformity of goods to the requirements established by the technical regulation;

1.2.11. goods batch number - the identification number applied with the manufacturer on identical goods with the same characteristics as at the manufacturer, marking, is date productions, the procedure for production used by raw materials;

1.2.12. serial number of goods - the identification number consisting of letters, figures or their combination, applied on goods with the manufacturer;

1.2.13. the register - electronic information resource about the certificate of conformity and the declaration of conformity.

1.3. The certificate of conformity or the declaration of conformity extends to the goods made in the Azerbaijan Republic, the related processes and production methods and also to the goods imported into the Azerbaijan Republic.

1.4. If the documents on compliance of foreign origin issued on the goods imported into the Azerbaijan Republic are not recognized according to "Rules of recognition of the documents on compliance issued in foreign states on compliance to requirements of technical regulations" or in the absence of such documents, assessment of conformity of these goods is performed according to these rules.

1.5. According to article 18.2 of the Law of the Azerbaijan Republic "About technical regulation", before entry into force of technical regulations assessment of conformity of the related goods of processes or production methods is performed on the basis of their standards, and also regulatory legal acts determining the provisions connected with assessment of conformity.

1.6. The certificate of conformity and the declaration of conformity extend to the batch specified in them or series of goods.

1.7. Expenses on assessment of conformity are paid with cash, clearing settlement, mail, plastic card, electronic payment systems or through the Internet at the expense of means of business entities by agreement of the parties.
