About modification and amendments in some resolutions of Central Election Commission of the Republic of Kazakhstan

1. Approve the enclosed list of some resolutions of Central Election Commission of the Republic of Kazakhstan to which changes and additions, according to appendix to this resolution are made.

2. To provide to legal department of the office of Central Election Commission of the Republic of Kazakhstan state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan.

3. Place this resolution on Internet resource of Central Election Commission of the Republic of Kazakhstan after its official publication.

4. This resolution becomes effective since January 1, 2023 and is subject to official publication.

The list of some resolutions of Central Election Commission of the Republic of Kazakhstan to which changes and additions are made

1. In the resolution of Central Election Commission of the Republic of Kazakhstan of August 7, 1999 No. 19/222 "About approval of Rules of opening of the special provisional account and expenditure of means of the election fund" (it is registered in the Register of state registration of regulatory legal acts at No. 870) to make the following changes and additions:

in Rules of opening of the special provisional account and expenditure of the means of the election fund approved by the specified resolution:

1, of 6, of 7, 8 and 9 to state Items in the following edition:

"1. These rules of opening of the special provisional account and expenditure of means of the election fund are developed according to Item 6 of article 34 of the Constitutional law "About Elections in the Republic of Kazakhstan" (further – Rules) and regulate procedure for opening of the special provisional account and expenditure of means of the election fund of candidates for president, deputies of the Senate of Parliament, deputies of the Majilis of Parliament, deputies of the maslikhats pushed according to party lists and also candidates of the Majilis of Parliament and the maslikhats pushed on single-candidate territorial constituencies.";

"6. For opening of the special account the electoral commissions provide to bank of the second level or its branch of data on registration of the candidate or political party, within one working day from the date of their registration:

1) the Central Electoral Commission – about the candidate (candidates) for Presidents of the Republic of Kazakhstan, the list of the political parties which pushed party lists in case of elections of deputies of the Majilis of Parliament of the Republic of Kazakhstan;

2) regional, the cities of republican value and the capital territorial election commissions – about the candidate (candidates) for deputies of the Senate of Parliament of the Republic of Kazakhstan;

3) the relevant territorial election commissions - about the list of the political parties which pushed party lists in case of elections of deputies of maslikhats;

4) the corresponding district selective of the commissions - about the candidate (candidates) for deputies of the Majilis of Parliament and deputies of the maslikhats pushed on single-candidate territorial constituencies.

7. The election fund of the candidate for president of the Republic of Kazakhstan consists from:

1) own means of the candidate and funds allocated to the candidate by the republican public association which pushed him, the total amount which does not exceed the size of minimum wage established by the legislation more than in twelve thousand times;

2) donations of citizens and the organizations of the Republic which total amount does not exceed the size of minimum wage established by the legislation more than in fifteen thousand times.

The extreme sizes of donations of physical person in total shall not exceed the minimum size of the salary established by the legislation of the Republic of Kazakhstan more than a hundred times and the legal entity of the Republic of Kazakhstan - in total more than by five hundred times.

8. The election fund of the candidate of the Senate of Parliament consists from:

1) own means of the candidate which total amount does not exceed the size of minimum wage established by the legislation of the Republic of Kazakhstan more than by two hundred times;

2) donations of citizens and the organizations of the Republic which total amount does not exceed the size of minimum wage established by the legislation of the Republic of Kazakhstan more than by five hundred times.

The extreme sizes of donations of physical person in total shall not exceed the minimum size of the salary established by the legislation of the Republic of Kazakhstan more than by twenty five times and the legal entity of the Republic of Kazakhstan - in total more than by fifty times.

9. The election fund of the political party which pushed the party list in case of elections of deputies of the Majilis of Parliament consists from:

1) own means of political party which total amount does not exceed the size of minimum wage established by the legislation more than in five thousand times;

2) donations of citizens and the organizations of the Republic which total amount does not exceed the size of minimum wage established by the legislation more than in ten thousand times.

The extreme sizes of donations of physical person in total shall not exceed the minimum size of the salary established by the legislation of the Republic of Kazakhstan more than a hundred times and the legal entity of the Republic of Kazakhstan - in total more than by five hundred times.";

add with Item 9-1 of the following content:

"9-1. The election fund of the candidate of the Majilis of Parliament consists from:

1) own means of the candidate which total amount shall not exceed the minimum size of the salary established by the legislation of the Republic of Kazakhstan more than by two hundred times;

2) donations of citizens and the organizations of the Republic which total amount shall not exceed the size of minimum wage established by the legislation more than by five hundred times.

The extreme sizes of donations of physical person in total shall not exceed the minimum size of the salary established by the legislation of the Republic of Kazakhstan more than by twenty five times and the legal entity of the Republic of Kazakhstan - in total more than by fifty times.";

state Item 10 in the following edition:

"10. The election fund of the political party which pushed the party list in case of elections of deputies of maslikhat consists from:

1) own means of political party which total amount does not exceed the size of minimum wage established by the legislation more than in one thousand times;

2) donations of citizens and the organizations of the Republic which total amount does not exceed the size of minimum wage established by the legislation more than in two thousand times.

The extreme sizes of donations of physical person in total shall not exceed the minimum size of the salary established by the legislation of the Republic of Kazakhstan more than by fifty times and the legal entity of the Republic of Kazakhstan - in total more than by two hundred fifty times.";

add with Items 10-1 and 10-2 of the following content:

"10-1. The election fund of the candidate of maslikhats of areas, cities of republican value and the capital consists from:

1) own means of the candidate which total amount shall not exceed the minimum size of the salary established by the legislation of the Republic of Kazakhstan more than a hundred times;

2) donations of citizens and the organizations of the Republic of Kazakhstan which total amount shall not exceed the size of minimum wage established by the legislation of the Republic of Kazakhstan more than by two hundred times.

The extreme sizes of donations of physical person in total shall not exceed the minimum size of the salary established by the legislation of the Republic of Kazakhstan more than ten times and the legal entity of the Republic of Kazakhstan - in total more than by twenty five times.

10-2. The election fund of the candidate of maslikhats of areas and cities consists from:

1) own means of the candidate which total amount shall not exceed the minimum size of the salary established by the legislation of the Republic of Kazakhstan more than by fifty times;

2) donations of citizens and the organizations of the Republic of Kazakhstan which total amount shall not exceed the minimum size of the salary established by the legislation of the Republic of Kazakhstan more than a hundred times.

The extreme sizes of donations of physical person in total shall not exceed the minimum size of the salary established by the legislation of the Republic of Kazakhstan more than five times and the legal entity of the Republic of Kazakhstan - in total more than by fifteen times.";

15, of 16, of 20, of 21, of 22, 23 and 24 to state Items in the following edition:
